Environmental degradation in the world in general, and in Africa in particular, is occurring on a scale of increasing concern. The challenge for public policy is to change the relationship between people and their environment in order to reverse this trend. To this end, in an internal and an international context characterized by, on the one hand, the establishment of democracy and the rule of law and, on the other, by the globalization of environmental law following the Rio Conference (1992) in particular, the rule of law has naturally emerged as the key tool for these transformations. The aim of this article is to identify and analyze the African legal instruments and the actions of transformation in the relationship between the regional legal framework and international environment law, with the goal of the sustainability of natural resources and sustainable living environment as the key environmental issues in a fragile region. Africa is in the processes of decision making and adopting environmental protection methods as it embarks on a normative production process, with the aim of producing a law combining international standards and local norms and practices. The contemporary issues of environmental protection in Africa are analyzed in an interdisciplinary approach.

However, one must be aware of the constraints, weighing on both partners, which hinder implementation of the agreed strategies.

The aims of this contribution is to check the validity of the old theory, which goes back to Jellinek but is still dominant, which states that secession as well as the process of forming a new state, fall under the scope of a "simple fact" and thereby escape through definition to any law of way. According to this theory, secession is not a question of "Law" but a question of pure fact, failure or success: if a secessionist movement succeeds in establishing a new effectiveness, that is to say, puts in place the "Constituent elements" of a state, a new state is born. It is interesting to observe that with the phenomenon of the rise or the collapse of States, from the global perspective of international order and especially from the point of view of international law, the States concerned are, in practice, not simply left to their fate. On the contrary, the rise or the collapse of a State anywhere in the world is seen as a matter of concern for the international community, since the international system as a whole is felt to be affected. In such cases, international reactions have not been manifested primarily through the States as such, either indi-vidually or together. Basically, these reactions had to cope with the dilemma of choos-ing between two fundamental principles of legitimacy in international law: on the one hand, the sovereignty and equality of States and, on the other, the right of peoples to self-determination.

Przedmiotem niniejszych rozważań, dotyczących współczesnych stosunków międzynarodowych są z jednej strony suwerenność, a z drugiej – bezpieczeństwo międzynarodowe oraz analiza związku pomiędzy systemem bezpieczeństwa zbiorowego a suwerennością państw w kontekście utrzymania trwałego pokoju i stabilności na świecie. Państwa są tradycyjnie przywiązane do idei suwerenności, jednakże do najbardziej charakterystycznych cech stosunków międzynarodowych naszych czasów należy narastanie różnego rodzaju zagrożenia, zarówno ze strony państwa (np. Iran, Korea Północna), jak i ze strony innych podmiotów (np. Al-Kaida). Bezpieczeństwo i suwerenność to dwa podstawowe pojęcia w literaturze i doktrynie prawnomiędzynarodowej. Dzieje się tak z dwóch powodów: po pierwsze – głównymi aktorami w stosunkach międzynarodowych są państwa, będące suwerennymi podmiotami, a stosunki czy też współpraca między nimi oparte są w zasadzie na poszanowaniu owej suwerenności; po drugie – kwestia bezpieczeństwa jest podstawowym zagadnieniem i warunkiem niezbędnym do wykonywania w pełni suwerennych praw tychże państw oraz zapewnienia współpracy międzynarodowej i rozwoju społeczno-gospodarczego. W artykule tym poruszono również problem konieczności instytucjonalizacji legalnego użycia siły, zarówno w organizacjach ogólnoświatowych, jak i na gruncie struktur regionalnych organizacji międzynarodowych, aby szybko i skutecznie zarządzać sytuacjami i konfliktami zagrażającymi pokojowi i bezpieczeństwu międzynarodowemu. W artykule zwrócono również szczególną uwagę na rolę i miejsce organizacji międzynarodowych w procesie utrzymania pokoju i bezpieczeństwa międzynarodowego, zarówno na poziomie ogólnoświatowym, jak i regionalnym.

Na przestrzeni wieków ludzkość zmagała się z różnymi epidemia, co zawsze wiązało się z koniecznością kompleksowego działania na płaszczyźnie międzynarodowej. Zdaniem Rady Bezpieczeństwa ONZ epidemia spowodowana wirusem ebola, która wybuchła pod koniec 2013 r., stanowi szczególne zagrożenie dla pokoju i bezpieczeństwa międzynarodowego, ponieważ zdobycze w obszarze budowania pokoju i rozwoju krajów najbardziej dotkniętych epidemią mogą zostać zaprzepaszczone. To z kolei podważa stabilność krajów najbardziej nią dotkniętych. Jeśli nie zostanie opanowana, to sytuacja taka może doprowadzić do wybuchu nowych niepokojów i napięć społecznych, pogorszenia klimatu politycznego, stygmatyzacji i wzmocnienia poczucia niepewności. Podjęta w tej sprawie przez Radę Bezpieczeństwa ONZ rezolucja ma wymiar historyczny, gdyż po raz pierwszy problem zdrowia publicznego został zaklasyfikowany jako zagrożenie dla pokoju i bezpieczeństwa międzynarodowego. Stało się tak, mimo że mobilizacja międzynarodowa była spóźniona o kilka miesięcy, chociaż konieczność podjęcia działań była wówczas oczywista.

Over the centuries, mankind has been confronted with a variety of epidemics that have always required a comprehensive action at the international level. According to the UN Security Council, the outbreak of the Ebola virus at the end of 2013 poses a particular threat to international peace and security, as the peace-building and development achievements of the countries most affected by the epidemic are jeopardised and may end in vain or be lost altogether. This in turn undermines the stability of the countries most affected. If the disease is not brought under control, this situation might lead to a new unrest and social tensions, and worsening of the political climate, or stigmatisation and a higher sense of uncertainty in the region. The resolution adopted by the UN Security Council on this matter has a historic dimension, as it has for the first time classified a public health problem as a threat to international peace and security. This happened despite the fact that international mobilisation had been delayed by several months, despite the obvious urgent need for action.

The subject of these reflections on the contemporary international relations is, on the one hand, sovereignty and, on the other, international security, and the analysis of the relationship between the system of collective security and the sovereignty of states in the context of sustainable peace and stability in the world. States have traditionally been tied to the idea of sovereignty. However, among the most characteristic features of the international relations of our time is the growing number of various types of threats originating in states (e.g. Iran, North Korea), in organisations or other entities (e.g. al-Qaeda). Security and sovereignty are two basic concepts most commonly discussed in literature and international legal doctrine. There are two reasons for that: (i) firstly, the main actors in international relations are states which are sovereign entities and the relations or cooperation between them is based on respect for the principle of that sovereignty, and (ii) secondly, the issue of safety is a key issue and a prerequisite for the performance of fully sovereign rights of these countries, necessary to ensure international cooperation and socio-economic development. This paper discusses the need to institutionalise legitimate use of force in global organisations as well as in their regional structures, and to rapidly and effectively manage situations and conflicts intercept to international peace and security. Soft law facilitates cooperation between international actors. Already, the elaboration of international law is a matter of shared competence between States, traditionally recognized as the only subjects of international law, international organizations and the typical actors. International organizations have initiated a movement towards the adoption of flexible forms of regulation of international relations. They will profoundly change the way in which international law will be created and presented to the recipients of the rule of law. From the very beginning of their activities, organizations preferred a method other than hierarchical command to encourage international cooperation. They will develop a consistent legal technique, aimed at persuading and not compelling their Member States to adopt conduct consistent with the legally binding standard. This article proposes a reflection on soft law and the results of its increasing use in international practices.

This paper describes the role and the place of the woman in African society, with particular focus on the issues of leadership, peace and security. Although women in Africa are more numerous than men, their position is not an enviable one. Thus this work will attempt to describe the causes which prevent the female kind from coming to the fore and being truly equal to men. In order to achieve that aim, one should consider the place of the woman, not only in the traditional society but also in what one sees as the contemporary realities of Africa. The author demonstrates that in most African countries, women had long been excluded from enjoying political rights, and that they have gained such entitlement only recently. Among the reasons which would account for this absence of women in the realm of leadership, one should draw attention to the patriarchal model of authority one acquires as a child and the burden of ancestral tradition which hinges upon the primacy of the male. There are also the additional burdens imposed over time by religions, which had always relegated the woman to the background.The woman has always been associated with the weaker sex, while being the one who gave life. The scope of this paper is limited to the presence of women in the public sphere, that is to say to their leadership in the affairs of peace and security, where women have or may have a certain influence. Certain difficulties encountered by African women with respect to leadership are also experienced by women in other parts of the world. With a few exceptions, all societies have been and continue to be governed by the same principles of exclusion. In Africa, just as everywhere else, there is no need for profound studies to conclude that feminist literature is not particularly abundant. This paper represents an exploration of a subject of no minor importance, namely the leadership of women in preventing and management of conflicts in Africa. Nevertheless, it is limited to a general view and does not analyse specific cases in each of the African countries.

The article sets out the nature, the history and the general structure of the crime against humanity and provides a comprehensive analytical commentary of the elements of such crimes as a problem of international law. The contextual element determines that crimes against humanity involve either large-scale violence in relation to the number of victims or its extension over a broad geographic area (widespread), or a methodical type of violence (systematic). This excludes random, accidental or isolated acts of violence. In addition, Article 7(2) (a) of the Rome Statute determines that crimes against humanity must be committed in furtherance of a State or organizational policy to commit an attack. The plan or policy does not need to be explicitly stipulated or formally adopted and can, therefore, be inferred from the totality of the circumstances. In contrast with genocide, crimes against humanity do not need to target a specific group. Instead, the victim of the attack can be any civilian population, regardless of its affiliation or identity.
