Рассмотрено взаимодействие информационных отношений и информационных технологий на примере законодательства об актах гражданского состояния и государственной регистрации юридических лиц и индивидуальных предпринимателей (применительно к определению статуса субъекта); государственной регистрации недвижимости, деятельности по ведению реестра эмиссионных ценных бумаг, реестра владельцев ценных бумаг (применительно к квалификации объекта прав и учету этих прав на него); раскрытия информации в информационно-телекоммуникационной сети "Интернет", ГИС ЖКХ, расчетов с использованием электронных средств платежа, Единой информационной системы нотариата, электронного документооборота (применительно к информационному обеспечению деятельности). In the article, based on the analysis of regulatory legal acts of various levels and law enforcement practice, there are revealed defects in the law and violations of the rights of citizens during termination / restriction of wastewater disposal. It is noted that legal acts provide for both regulatory and restrictive conditions for the termination / restriction of the provision of services in this area, which are procedurally different in terms of sources of law. It is emphasized that the procedure for the implementation of regulatory condition, consisting in the preliminary notification of interested persons, is regulated differently in sources at various levels. The authors give and analyze concrete examples of the actual consequences of the installation of plugs, and state that even in court decisions that are not in the interests of citizens, it is noted that the installation of plugs should not lead to damage to the defaulters personal property. The authors argue that in most cases there is no formal basis for stopping / limiting wastewater, since the law provides for a drainage contract, and not a contractual relationship. It is concluded that the installation of plugs in the drainage system of apartment buildings is a violation of sanitary legislation and creates the threat of the emergence and spread of infectious diseases and mass non-communicable diseases (poisoning) and formulated the basic possible requirements for the protection of violated rights. ; В статье на основе анализа нормативных правовых актов различного уровня и правоприменительной практики выявлены дефекты права и нарушения прав граждан при прекращении / ограничении водоотведения. Отмечается, что в правовых актах предусмотрены как регулятивное, так и ограничительное условия прекращения / ограничения оказания услуг в этой сфере, процедурно различающиеся по источникам права. При этом подчеркивается, что порядок реализации регулятивного условия, состоящего в предварительном уведомлении заинтересованных лиц, регламентируется по-разному в источниках различного уровня. Приводятся и анализируются конкретные примеры фактических последствий установки заглушек, и констатируется, что даже в судебных решениях, вынесенных не в интересах граждан, отмечается, что установка заглушек не должна привести к порче личного имущества неплательщика. Утверждается, что в большинстве случаев отсутствует формальное основание прекращения / ограничения водоотведения, поскольку закон предусматривает наличие договора водоотведения, а не договорных отношений. Делается вывод, что установка заглушек в систему водоотведения многоквартирных домов является нарушением санитарного законодательства и создает угрозу возникновения и распространения инфекционных заболеваний и массовых неинфекционных заболеваний (отравлений), и формулируются основные возможные требования по защите нарушенных прав.

The article analyzes theoretical approaches to the definition of the category of public-private partnership. The definition of public-private partnership is formulated taking into account the unique features of agricultural insurance in Russia. The historical way of formation and development of public-private partnership in the legislation of Russia is investigated: from the Petrine era to our time with the purpose of using time-based legal reception in the newest legislation of the Russian Federation, which regulates legal relations in the field of agricultural insurance. The authors studied the design of the current Russian legislation in the field of agricultural insurance, implemented with state support from the standpoint of public-private partnership, and analyzed the legal forms of this partnership used in US agricultural insurance (Du, Hennessy, Feng, 2014). It is concluded that there is a need to expand the interaction of government and business in Russia with a view to stabilizing the situation of the agrarians, at least, and the development of the entire agricultural sector of our country - as a maximum. Taking into account the temporal analysis of the Russian legislation in the sphere under consideration, as well as the experience of implementing a public-private partnership in the national legal system of the United States in the field of agricultural insurance, the authors examined several options for legal forms of introducing PPP in agricultural insurance of the Russian Federation. Firstly, the functioning of the legal model of PPP in the form of an insurance agrarian corporation with mixed capital of public funds and private insurer funds. Secondly, the creation of a state agrarian insurance company with 100% state capital. And, finally, thirdly, education in the field of agricultural insurance of mutual insurance societies. The conclusion is drawn that the model of mutual insurance societies is the most optimal variant of interaction between the government and business in the field of agricultural insurance, carried out with state support. © 2018.

The current changes confirm the hypothesis that future economic transformations, as well as social and political interaction, will change their direction and that the American-European dominance will be minimized by the active development of the Eurasian and Asia-Africa region. In the medium term, the BRICS countries (Brazil, Russia, India, China and South Africa) will largely determine the world's political and economic agenda. Therefore, issues related to the study of the principles of civil law of the BRICS countries are becoming more and more relevant. The purpose of the article is formulated the following way: an analysis of the characteristics of the national regulation of proprietary rights reveals the specifics of the intercultural conflicts of the investigated area, the elimination of which will lead to the harmonization of the legislation of the considered countries, which will accelerate socio-political and economic-technological interactions between the BRICS countries, and will provide them with the best competitive position in the world economy. The proposed article, using a comparative analysis of the basic rules of the proprietary law of the five BRICS countries and using open economic-statistical, legal and regulatory data posted on the Internet, presented the structural and logical frameworks describing the key approaches of national legislation systems in this area of legal relations. On the basis of the data, it was concluded that the proprietary law of the BRICS countries should be harmonized for the following main reasons: (1) the existence of cross-legal conflicts makes it possible to define the framework boundaries of harmonization of proprietary law in the five BRICS countries; (2) the existing loopholes and gaps in national legislation are sources of legal innovation and motives for the development of an institutional interstate environment within the BRICS. Thus, on the one hand, the article is analytical aimed at the review of the existing features of national regulation of proprietary rights in the BRICS countries. On the other hand, the article suggests a number of practical steps that need to be taken in order to harmonize the national legislation of the BRICS countries. © 2017, by ASERS ® Publishing.
