The attacks of Hamas against Israel were deeply shocking. Israel has a right to defend itself against Hamas and at the same time it is obliged to protect the civilian population of Gaza as far as possible from harm and injury. But Israel is currently facing a true dilemma. While Israeli Defense Forces try to evacuate as many residents as possible, Hamas uses civilians as human shields, including hostages. The humanitarian situation in Gaza is dire and mass evacuations further exacerbate the problem.

On the 8th of June 2023, Canada and the Netherlands initiated proceedings at the International Court of Justice (ICJ) against Syria for violating the Convention against Torture (CAT) by inter alia using chemical weapons against the civilian population. This would be the first time ever that the ICJ had the opportunity to deal with chemical weapons in contentious proceedings. This blog post will briefly summarize the most pertinent legal questions and political implications that arise in the context of the ICJ proceedings. It will be demonstrated that the prohibition of chemical weapons is not based on a single legal framework. Rather, we need to look at the chemical weapons taboo comprehensively and from a perspective of multi-normativity.

Hitherto 'less-lethal' weapons, in contrast to classical firearms and other highly destructive weapons, have literally slipped under the radar of public international law. This book is the first monograph addressing and analysing all international legal regimes applicable to less-lethal weapons, ranging from arms control treaties, international humanitarian, criminal and human rights law. In doing so the different scenarios in which less-lethal weapons come to use will be taken into account, such as law enforcement, armed conflict and law enforcement scenarios during armed conflict. The relationships between the different legal regimes will be elaborated thoroughly with a view to examining how international law responds to less-lethal weapons. The final chapter provides guidelines as well as recommendations on appropriate use and regulation of less-lethal weapons, where the different scenarios of application, such as in armed conflict and law enforcement, will be given due account.

The deployment of autonomous weapon systems ('aws') in military operations is a major concern for the international community. While the military in particular argues that increased autonomy mitigates the risks of death and injury for civilians, scientists and civil society emphasise that humans still have to play a decisive role when increasingly outsourcing core competences to machines. In 2017, a Group of Governmental Experts ('gge') met for the first time to discuss legal and ethical issues of aws. The centrepiece of the debate was (and still is) the role humans play in an increasingly automated battlefield. In the past couple of years, consensus has been emerging on the necessity of maintaining human control. It will be argued in this contribution that human control (in abstracto) is not merely a political demand. It is also a legal obligation derived from international humanitarian law ('ihl'). This contribution seeks to analyse relevant rules of ihl with a specific focus on the legal nature of the Martens Clause arguing that human control (in abstracto) is not only politically desired but that it is legally required. That being said, the various concepts aiming to implement and operationalise human control (in concreto) will be examined with a view to offering solutions for a potential regulatory framework on aws at the United Nations ('UN') in Geneva.

Während ein recht breiter Konsens besteht, dass der Mensch auch weiterhin eine maßgebliche Rolle bei der Entscheidung über eine Tötung mit militärischen Mitteln haben muss, gibt es nach wie vor Unklarheit darüber, wie dieses Prinzip der menschlichen Kontrolle konkret ausgestaltet, sprich operationalisiert werden kann. Dies ist ein Grund, warum die internationalen Verhandlungen über LAWS stocken. Die ausbleibende Verständigung über ein Regelwerk hat Folgen für internationale Rüstungsprojekte wie das Future Combat Air System (FCAS), für die Vergabe von Gel­dern aus dem Europäischen Verteidigungsfonds (EDF) und für die Zusammenarbeit in der Nato. Deutschland kann die Operationalisierung des Grundsatzes der mensch­lichen Kontrolle sowohl national als auch international stärker vorantreiben.

Die Group of Governmental Experts (GGE) diskutiert seit 2017 im Rahmen des Waffen­übereinkommens der Vereinten Nationen (VN) über Autonome Waffensysteme (AWS). Russland hat die jüngste Verhandlungsrunde im März in Genf boykottiert. Grund für dieses Verhalten Russ­lands ist sein seit dem 24. Februar 2022 dauernder Angriffskrieg gegen die Ukraine. Eine Regulierung von AWS ist damit in noch weitere Ferne gerückt. Staaten sprechen mit vorgehaltener Hand bereits von einem Scheitern der Genfer Ver­handlungen. Deutschlands Ankündigung im Koalitionsvertrag, die Ächtung von AWS aktiv voran­zutreiben, scheint nun zur Mammutaufgabe zu werden. Da die GGE auf dem Konsens­prinzip beruht und eine konstruktive Zusammenarbeit mit Russland in naher Zukunft nicht zu erwar­ten ist, müssen andere Foren für eine internationale Debatte zu AWS gefunden werden. Deutschland muss sich auf Optionen innerhalb der Nato, der Euro­päischen Union (EU) und der VN vorbereiten. Klar ist, dass nur ein kohärentes Vor­gehen mit den Nato-Bünd­nis­partnern auf sämtlichen Ebenen ziel­führend ist. Um dies zu erreichen, be­darf es einer klaren nationalen Positionierung Deutschlands zum Umgang mit AWS. (Autorenreferat)

The Group of Governmental Experts (GGE) has been discussing autonomous weapons systems (AWS) in the UN arms control context since 2017. Russia boycotted the latest round of talks in Geneva in March, in connection with its 24 February 2022 invasion of Ukraine. Regulation of AWS is an increasingly remote prospect, and some representatives even admit privately that the talks may have failed. The new German gov­ern­­ment's commitment to work to outlaw AWS is increasingly looking like a labour of Sisyphus. Given that the GGE requires unanimity, but constructive cooperation with Russia is off the table for the foreseeable, other forums will need to be found for the international debate on AWS control. Germany must prepare for options within NATO, the European Union and the United Nations. It is clear that any meaningful process presupposes coherent coordination with the NATO partners on all levels. In order to achieve that, Germany must first develop a clear national position on AWS.
