Socio-economic rights are those human rights that aim to secure for all members of a particular society a basic quality of life in terms of food, water, shelter, education, health care and housing. They differ from traditional civil and political rights such as the right to equality, personal liberty, property, free speech and association. These "traditional human rights" are now found in most democratic constitutions and are, as a rule, enshrined in a Bill of Rights; which is that part of the Constitution that is normally enforced through mechanisms such as judicial review. The victims of the violation of such rights have a legal remedy. Individual freedom is a primary value underpinning civil and political rights.

Die neue südafrikanische Verfassung ist das Ergebnis von Verhandlung und Kompromiß. Das neue System der Provinzregierungen, deren legislative, exekutive und finanzielle Zuständigkeiten erklärt werden, ist ein Teil dieses Kompromisses. Noch ist die endgültige Form nicht erreicht, da auch der konstitutionelle und politische Neuaufbau Südafrikas noch nicht vollendet ist. Die Schaffung der Provinz ist als Kompromiß zwischen zentraler und dezentraler Staatsform zu sehen. Die Souveränität des Parlaments wurde durch eine übergeordnete und einklagbare Verfassung ersetzt. Dabei wird das neue Verfassungsgericht von besonderer Bedeutung sein. (DÜI-Hlb)

La reactión de la comunidad internacional ante la matanza y el genocidio en Ruanda ha sido, a veces, reticente e inadecuada. Esto se debe, en parte, a la cantidad de recursos humanos y materiales que habrían sido necesarios para restaurar la paz y resolver las cuestiones más fundamentales del derrumbamiento del Estado mismo. Sin embargo, la experiencia de Ruanda también plantea serios interrogantes acerca de la adecuación de las estructuras internacionales y regionales encargadas de mantener y restaurar la paz.

La réaction de la communauté internationale aux massacres et au génocide du Rwanda a été par moments «indécise» et «inadéquate». L'une des explications réside sans doute dans le fait qu'il aurait fallu disposer de ressources humaines et matérielles considérables pour rétablir la paix et pour répondre aux questions plus fondamentales posées par l'effondrement de l'État lui-même. Il n'en reste pas moins que le cas rwandais soulève de graves interrogations quant à l'adequation des structures internationales et régionales responsables du maintien et du rétablissement de la paix.

The response of the international community to the massacres and genocide in Rwanda was at times "reluctant" and "inadequate". This can partly be explained by the amount of human and material resources that would have been required to restore peace and address the more fundamental issues of the failure of the State itself. The Rwandan experience does, however, also raise serious questions about the adequacy of international and regional structures responsible for maintaining and restoring peace.
