En raison d'un sentiment d'illégitimité à vivre, de difficultés à braver les normes et de l'effritement du capital de résilience face aux rejets et discriminations, des personnes trans de tous âges et de tous milieux renoncent à la vie en se suicidant. D'autres sont assassinées et viennent allonger la liste des victimes de transphobie. Ces personnes font l'objet de réassignations post-mortem, dont on trouve des traces depuis leivesiècle. Le sujet demande d'être abordé avec précaution car ces expériences de vie sont liées au genre et plus précisément au franchissement de genre, pour des personnes qui correspondent peut-être aux cas de figure que l'on comprend auxxesiècle sous le terme transgenre. Dans cet article, nous nous proposons d'interroger des franchissements de genre à travers les âges en mesurant les effets des réassignations post-mortem, voire des effacements, à l'aide d'exemples. Les réassignations et leurs conséquences seront aussi décrites et analysées à partir de contenus identifiés dans les médias contemporains, particulièrement quand la mort de personnes trans est traitée dans le registre du fait divers et quand le genre devient un outil de mise en scène. La proposition d'ouverture à l'intersectionnalité a pour objectif de montrer que le traitement médiatique et les réassignations post-mortem révèlent la persistance des inégalités parfois même sous de nouvelles formes.

Nous montrerons que la construction de figures archétypales consensuelles pose la question de leur interprétation/construction (une co-écriture) par les médias, le grand public et les personnes concernées. S'attacher à comprendre les mécanismes de pouvoir et de domination à l'œuvre dans la médiatisation des politiques trans (le montrable et l'in-montrable) - et leurs influences sur les contre-publics transidentitaires - nous engage également à penser le sujet politique trans.

En 1982, le professeur René Küss plaide à la télévision pour un protocole appelant à distinguer entre « vrais » et « faux » trans' : de « vrais trans' » ne causent aucun trouble dans le genre : on leur accorde une aide exceptionnelle (l'opération) par laquelle – hommes devenus femmes ou femmes devenues hommes – ils rentrent dans l'ordre du genre et de l'identité. Telle est l'une des premières expressions de ce que nous proposons d'appeler le « bouclier thérapeutique ». Les trois décennies qui suivent voient s'affronter les affirmations transidentaires et l'idéologie dominante des « traitants ». Appareil de légitimation d'un ordre ancien, le « bouclier thérapeutique » ne serait-il plus aujourd'hui pour ses partisans que le dernier vestige d'une ère marquée par l'effritement d'un deuxième bouclier, juridique celui-ci, garantissant que la libre disposition de l'état civil reste une exception ? Sur ces questions qui interrogent profondément les représentations que nos sociétés se font d'elles-mêmes, peut-être le temps est-il venu d'ouvrir la route tracée par la recherche en sciences sociales et humaines aux nouveaux paradigmes amorcés par les Études de Genre.

Is this "therapeutic shield", still used today as a device to legitimize the ancient order, not the last remnant of an era marked by the erosion of a second "legal shield" guaranteeing that free disposal of the civil status remains a unique legal exception? Such issues deeply question the lenses through which our societies represent themselves. The application for recognition of knowledge, expertise ground trans-identity were confronted, in the early eighties, with Shield therapy, which can be defined as the ultimate argument of the medico-legal proceedingswhich concerned the subject of the trans-sexual, excluding other topics/trans paths, to render remote any intervention of the political, social sciences and humanities in what has become a theoretical paradigm: sex change is primarily a cultural change of gender. Finally, it is a situation where the medico-legal community attempts to ignore its own politicization and militancy. Split between the will to resist and to participate face/with an inadequate protocol, ineffective and culturally obsolete, the field has produced its own movements calling into question the actual spirit of the method.
