The Term Which best sums up the current international economic situation is the word "crisis." This crisis exists not only in the economies of the South, harassed over the past five years by external debt and the adjustment measures which it has spawned, but also in the economies of the North, often saddled with substantial deficits.Surrounding the state of crisis is a general sense of confusion as to the proper direction to take to deal with this crisis. The future appears opaque, which renders the choice of remedies even more difficult than would normally be the case under better circumstances.

H-a-ser-origen, máquina de remendar, invoca un ejercicio de in-flexión a través de la(s) memoria(s) cultural(es) en los pliegues/remiendos de la experiencia de tiempo y espacio (vividos) en la emergencia de "lo pedagógico". Es ahí cuando surge una imagen del "acto pedagógico/paralógico" como ese instante fugaz en que el territorio se toca con la semilla, donde espacio-tiempo se entrelazan en potencia de hacer/a ser origen y mi vox/voz como artista profesor se trasluce en máquina de remendar el (propio) territorio. Específicamente, este trabajo de maestría da cuenta de una manera de comprender y hacer una propuesta artístico-pedagógica en la que el re-conocimiento del territorio como espacio de memoria y acción cobra particular relevancia en los procesos de educación desde las artes, una apuesta política por los lugares de las artes en el concierto de la sociedad. ; H-a-ser origen [word play in Spanish:" to make/to become an origin"], a mending machine, summons an exercise of in-flection through the cultural memory(ies) inside the foldings/patched up patterns of the time and space experience (lived) in the appearance of "the pedadagogical". There the image of the "pedagogic/para-logic act" emerges as a fleeting instant when both territory and seed come in touch, where time and space are interwoven in the potency of making/becoming origin, and my vox/voice as artist and teacher is revealed through a machine for patching up the (own) territory. In specific, this thesis for a major degree, acknowledges a way to understand and develop an artistic-pedagogical experience where the recognition of the territory, as a space full of memory and action, is relevant for arts education programs; a political stand for the place of arts in the society's concert. ; Maestría

SummaryThe concept of risk requires preventative measures as well as measures of liability and redress in the case that damage is actually caused. The Cartagena Protocol on Biosecurity limits itself in Article 27 to the establishment of a mandate for the elaboration of norms and procedures in regard to liability and redress. The fulfillment of this mandate requires, first, a definition of the concept of damage to the conservation and sustainable use of biological diversity; second, a survey of the extent of damage to health; and, third, the consideration of socio-economic aspects. In this context, this article analyzes the concept of damage in the international instruments that deal with this material, taking into account levels of implantation. The article concludes by presenting a definition of damage for use in the context of the development of the content of Article 27, using an administrative focus in regard to the concept of damage for civil liability in domestic law.

P. 87-124 ; Se trata de una contribución como artículo para un número monográfico de la revista científica francesa L'Observateur des Nations Unies dedicado al Continente americano y el Derecho internacional. La aportación lleva a cabo un examen exhaustivo de la acción del Consejo de Seguridad en el ejercicio de función primordial del mantenimiento de la paz y la seguridad internacionales durante el período de la Guerra Fría. El objetivo fundamental del trabajo se centra en la exposición de la evolución histórica de la práctica del Consejo de Seguridad acorde con la evolución de las circunstancias políticas en las que se estuvo inmersa la sociedad internacional al término de la Segunda Guerra Mundial y, en especial, en el Continente americano. El estudio lleva a cabo una exposición de la práctica desarrollada en las situaciones que fueron consideradas una amenaza para la paz y la seguridad internacionales tanto en el ámbito de las Naciones Unidas y que estuvieron en el orden del día del Consejo de Seguridad como, en determinados supuestos, por la Organización de Estados Americanos. Con este objetivo, se examinan cada una de las nueve situaciones denunciadas por los Estados o sobre las que existe unanimidad en la doctrina como situaciones que debían haber sido consideradas por el Consejo de Seguridad. Con independencia de la disparidad de las situaciones, se pone de manifiesto en el examen de todas y cada una de ellas, y de las resoluciones adoptadas, que durante 40 años el Consejo de Seguridad únicamente fue capaz de adoptar un número muy limitado de medidas según el Capítulo VII. Con ello, el Consejo de Seguridad se convirtió en una instancia de discusión y propaganda política cuando los problemas no se podían resolver sobre el terreno político o militar. El sistema de veto, que bloqueó la acción del Consejo de Seguridad, fue capaz de evitar una conflagración nuclear ya que era imposible adoptar una medida coercitiva contra una gran potencia. P. 297-377 ; Análisis en profundidad de la situación en Haití que dio lugar a una acción armada de una fuerza multinacional para restituir al Gobierno legítimo y de la posible legitimación de la misma en el reconocimiento de un incipiente derecho de los pueblos a un régimen democrático en el Derecho internacional. Se muestra que el considerado como derecho humano a la participación política constituye una manifestación del derecho a la autodeterminación de los pueblos. Igualmente, se hace un estudio de la existencia de un reconocimiento del principio de régimen democrático en numerosos textos internacionales. La estrecha conexión entre la paz y la seguridad internacionales y los regímenes de carácter democrático aparece también constatada en la realidad social internacional. Sin embargo, se considera que, en el actual Derecho internacional, no puede entenderse que el principio de régimen democrático constituya una base para legitimar una acción armada destinada a restituir un Gobierno legitimo. No se descarta la posibilidad de emprender este tipo de acciones cuando la situación lleve aparejada una masiva violación de los derechos humanos fundamentales como en el caso de Haití ; SI
