The Italian Constitution defines property not as a fundamental right, but as a right "recognized and guaranteed by law… with the objective to secure its social function". For this reason, many authors have emphasized that its inclusion in the European Convention on Human Rights as well as in the Charter of Fundamental Rights of the European Union, could be considered as a blameworthy return to ancient (and excessively liberal) views. In truth, as this paper will try to demonstrate, the notion of "social function" is not stranger to European Law, which even extents this concept and its significant implications to many other rights and freedoms protected in modern Charters of Rights. ; La Constitución italiana contempla la propiedad no como un derecho fundamental, sino como un derecho "reconocido y garantizado por la ley. con el objetivo de asegurar su función social". Por esta razón, muchos autores han subrayado que su inclusión en la Convención Europea de Derechos Humanos, así como en la Carta de los Derechos Fundamentales de la Unión Europea, podría considerarse como un regreso censurable a antiguas (y excesivamente liberales) opiniones. En realidad, como se intentará demostrar en este trabajo, la noción de "función social" no es ajena al Derecho Europeo, que incluso extiende este concepto y sus significativas implicaciones, a muchos otros derechos y libertades protegidos en las modernas Cartas de Derechos.

The Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), signed on 4 November 1950 in Rome, by the representatives of the Member States of the Council of Europe, allows individuals to sue their governments for violation of human rights. Despite its importance in guaranteeing the supreme interests of the person, 70 years after the signing of the ECHR, there are still many doubts regarding the real effectiveness that this Convention should have in the hierarchy of sources at national level. In Italy, some judges started disapplying national norms conflicting with the ECHR. But, in 2007, the Corte Costituzionale decided to put a stop to this trend, which constituted an undue 'constitutional exception' to constitutional supremacy and derogated from centralized constitutional review. This approach suffers some criticism. In order to ensure a real effectiveness of the ECHR system, there is a need to strengthen and enhance the authority of Convention rights at national level, also by ensuring rapid and effective implementation of the judgments of the Court. ; 1. La necessità di riconoscere alla CEDU il giusto ruolo (centrale) in Europa nella garanzia dei diritti dell'uomo. ; A Convenção para a Proteção dos Direitos Humanos e das Liberdades Fundamentais (CEDH), assinada em 4 de novembro de 1950 em Roma pelos representantes dos Estados Membros do Conselho da Europa, permite que indivíduos processem seus governos por violação dos direitos humanos. Apesar de sua importância em garantir os interesses supremos da pessoa, 70 anos após a assinatura da CEDH, ainda existem muitas dúvidas sobre a real eficácia que esta Convenção deve ter na hierarquia de fontes em nível nacional. Na Itália, alguns juízes começaram a desaplicar normas nacionais em conflito com a CEDH. Mas, em 2007, a Corte Costituzionale decidiu interromper essa tendência, que constituiu uma "exceção" indevida à supremacia constitucional e derrogou a revisão centralizada. Essa abordagem sofre algumas críticas. Para garantir uma eficácia real do sistema da CEDH, é necessário fortalecer e aumentar a autoridade dos direitos da Convenção em nível nacional, garantindo também a implementação rápida e eficaz dos acórdãos do Tribunal de Estrasburgo.

This article aims to bear further discussion on the disputed legal issue that centres on identifying a possible ontological qualification of the embryo. Notably, this article explores how scientific research and various medical treatments can affect the legal status of embryos. We consider, from a comparative point of view, domestic and international legal orders as well as specific legal venues such as courts, to show how the law and judicial interpretation of it can interact as legal formants to influence the legal qualification of the embryo. This article considers the law as a mere legal venue for establishing a possible uniform ontological qualification of the embryo hinging on the concept of human dignity. In fact, human dignity, as opposed to legal formants, can be used to define the internal and external limits to a proper legal qualification of the embryo. This is because human dignity informs the discourse on 'life', and we term this approach as a predetermined and unqualified connotation of life itself. Indeed, this approach can now be used to construct a possible limit to any interference, modification, or evaluation that can directly affect the legal qualification of the embryo tout court.

Objective: This paper aims to compare the legal systems of Poland and Italy in relation to rights recognized to unmarried same-sex couples.Methodology: The legal research is mainly conducted through the methodology of comparative law. This is the main criterion to highlight limits and perspectives of the European legal systems through a detailed analysis of their respective legal formats, namely judicial decisions and statutory laws.Results: The comparative study is not only showing similarities and differences, but it is contextualizing provisions' conflicts and tensions between domestic and international legal environments where the rights to a family life for instance is considered as one of the most important human rights to be recognized to de facto couples as well as to unmarried same-sex couples.Contributions: The paper argues that a multi-level dimension of rights can shape national rights as well as being the main changing force to further nurture social changes and political reforms towards a more equal and one could say fairer legal system where European legal principles can coexist with different national rights within a complex and multi-level legal order.Keywords: Comparative law; Democracy; Human rights; Legislative reforms; Same-sex couplesRESUMOObjetivo: o objetivo deste artigo é comparar os sistemas jurídicos da Polônia e da Itália em relação aos direitos reconhecidos aos casais não casados do mesmo sexo.Metodologia: A pesquisa jurídica é realizada principalmente por meio da metodologia do Direito comparado. Este é o principal critério para evidenciar os limites e perspetivas dos sistemas jurídicos europeus em uma análise detalhada dos respectivos formatos jurídicos, nomeadamente decisões judiciais e leis.Resultados: O estudo comparativo não mostra semelhanças e diferenças, mas contextualiza os conflitos e tensões das disposições entre os ambientes jurídicos nacionais e internacionais onde o direito à vida familiar, por exemplo, é considerado um dos direitos humanos mais importantes a serem reconhecidos para casais de facto, bem como para casais não casados do mesmo sexo.Contribuições: O artigo argumenta que uma dimensão multinível dos direitos pode moldar os direitos nacionais, além de ser a principal força de mudança para promover mudanças sociais e reformas políticas em direção a um sistema jurídico mais igualitário e mais justo, onde os princípios jurídicos europeus podem coexistir com diferentes direitos nacionais dentro de uma ordem jurídica complexa e multinível.Palavras-chave: Direito comparado; Democracia; Direitos humanos; Reformas legislativas; Casais do mesmo sexo.
