Abstract
The Covid-19 crisis provided an opportunity for the European Union to offer an alternative regulatory response to the crisis of values by systemically linking European funding to respect for the rule of law. A rule of law conditionality mechanism for spending was introduced in the Recovery and Resilience Facility and in Regulation 2020/2092. It is both positive – in that it encourages Member States to implement reforms and investments aimed at improving the rule of law – and negative – in that it takes the form of financial sanctions. However, the development of the rule of law conditionality is leading to an economisation of the concept of the rule of law, insofar as it mainly concerns those dimensions of the rule of law that are conducive to growth – such as justice systems and the fight against corruption. As a result, it could paradoxically exacerbate the very crisis it is designed to resolve.

La solidarité est l?une des valeurs fondamentales sous-tendant le processus d?intégration européenne. Au centre des discours politiques depuis le début des années 1950, elle a été invoquée comme vecteur de rapprochement des États membres et de leurs populations.0De nombreuses dispositions juridiques, dans les traités européens notamment, s?y réfèrent, et ce dans divers secteurs du droit de l?Union. La solidarité pose néanmoins de très nombreuses questions. Elle est aussi au coeur de tensions entre États, de reconfigurations et d?enjeux majeurs pour l?Europe d?aujourd?hui et de demain.00Cet ouvrage propose une étude interdisciplinaire et comparative approfondie des implications et des défis que la solidarité représente pour l?Union européenne. Il est le produit d?une recherche collective menée au sein de l?Institut d?études européennes de l?Université libre de Bruxelles (IEE-ULB) dans le cadre d?un projet Jean Monnet (Centre d?excellence). Cette recherche allie les approches politique, juridique, historique de l?intégration européenne. This Training Handbook offers an overview of the main challenges in the protection of social rights. Contrary to other legal systems solely dedicated to the protection of social rights (such as the International Labour Organisation or the European Social Charter of the Council of Europe), the EU has a broader political and economic agenda. Social rights in the EU face several challenges, such as keeping social dumping at bay, reconciling high standard labour markets and social security policies with the stringent post-crisis requirements of the Economic and Monetary Union, and finding a harmonious balance between worker's rights and the freedom to conduct business. The Charter of Fundamental Rights of the EU is not always effective when it comes to the social rights it claims to protect. This Handbook aims at detangling the complicated web of EU fundamental social rights protection, highlighting the impact of EU and national jurisprudence on this topic.
