On transitions to viable democracy in Latin America (Marini, 1976), Mexico was part of the regional waves of judicial reforms implemented since the 1980s that would modernize the political system by adapting its regulatory frameworks to neoliberalism and international trade in the late twentieth century. These reforms have increased the weight of the judiciary in the State structure, enabling it to resolve conflicts in the political arena. Then, the judiciary began a process of politicization while politics became the object of judicialization, where the law is used as a strategic tool to achieve particular interests while neglecting social welfare.In this way, the judicial route was institutionalized to continue the political war in democratic contexts, giving rise to lawfare as a resource against the non-neoliberal governments that the Latin American majorities have chosen in the 21st century. From this perspective, this article seeks to make visible a series of elements that could be shaping a lawfare process against the political project chaired by Andrés Manuel López Obrador: in the strategic sectors of electricity, hydrocarbons, infrastructure and telecommunications;in lawsuits against potential political leaders;and in the judicialization of the 2021 elections. Keywords: Judicial reforms; neoliberalism; judicialization; lawfare; AMLO ; En las transiciones a la democracia viable en América Latina (Marini, 1976), México formó parte de las olas regionales de reformas judiciales implementadas desde la década de 1980 que modernizarían el sistema político adaptando sus marcos regulatorios al neoliberalismo y el comercio internacional de fines del siglo XX. Estas reformas han incrementado el peso del poder judicial en la estructura estatal, habilitándolo como autoridad para dirimir conflictos del terreno de la política. Así, el poder judicial inició un proceso de politización mientras que la política se fue tornando objeto de judicialización, donde el derecho es usado como herramienta estratégica para alcanzar intereses particulares descuidando el bienestar social. De esta manera, se institucionalizó la vía judicial para continuar la guerra política en contextos democráticos, dando origen al lawfare como recurso en contra de los gobiernos no neoliberales que las mayorías latinoamericanas han elegido en el siglo XXI. Este artículo busca visibilizar los elementos que estarían perfilando procesos de lawfare contra el proyecto político presidido por Andrés Manuel López Obrador: en los sectores estratégicos de la energía eléctrica, los hidrocarburos, la infraestructura y las telecomunicaciones; en las demandas judiciales contra liderazgos políticos potenciales; y en la judicialización de las elecciones de 2021. Los planes antinarcóticos, la redefinición de las amenazas a EE. UU. y la presencia de China y Rusia en América Latina y el Caribe, han reanimado el debate sobre la asistencia en seguridad, que implica componentes tanto económicos como militares. Diversos actores y el Gobierno estadounidense alegan resultados "fallidos" de la guerra contra el narcotráfico y sugieren aumentar el rubro de dicha asistencia. Este artículo revisa la definición y el modo en que el Gobierno, la academia y laboratorios de pensamiento distinguen el apoyo militar del económico. Los datos oficiales de 2010-2022 arrojan que un 90 % de la asistencia exterior correspondería a la asistencia económica y solo un 10 % a la militar. Para contrastar esta información, se propone la reclasificación de los rubros de la asistencia mediante un análisis crítico que arroja resultados diferentes en el que en el mismo período la asistencia en seguridad asciende al 35 % del total. Esto es un indicio del modo sistemático, a lo largo de diferentes administraciones estadounidenses, en que los bienes y servicios de seguridad tienden a ser ubicados en programas de seguridad no militares, como parte de la asistencia económica, cuando por origen y objetivos, se corresponden con el ámbito militar.
