"Drawing on a range of expert contributions, this book explores how the European Green Deal is being deployed in practice and observes how the EU tries to promote the protection of the environment in third countries. The book begins by assessing the state-of-the art in terms of the key conceptual issues and analyses sectoral initiatives that are particularly relevant for the deployment of the European Green Deal external dimensions. These include the Carbon Border Adjustment Mechanism, the EU's regulatory action in the control of maritime emissions, the 2030 Biodiversity Strategy, the Deforestation Initiative, the Zero Pollution Initiative, the From Farm to Fork Initiative, and the Climate Neutrality and Clean Energy Initiative in the context of the Energy Charter Treaty. Next, the authors deal with horizontal aspects of the European Green Deal that also have external dimensions, such as the Green Deal Diplomacy, the Green Public Procurement, funding measures, initiatives related to corporate sustainability and due diligence, and the implementation and enforcement of EU environmental law. The volume concludes with a cross-cutting analysis, focusing on how the EU can strengthen the impact of its normative power on international environmental governance, while also noting its limitations. Provisions on investment in the Comprehensive Economic and Trade Agreement (CETA) between Canada and the EU, both on substance and on dispute settlement procedures, are the culmination of a long process of replacement of the original EEC approach to establishment by the approaches followed by the GATS, the North American Free Trade Agreement (NAFTA) and Bilateral Investment Treaties (BITs). The article analyses this process; it focuses in particular on the law of external relations but takes into account the evolution of the law of the internal market and can also be read from this perspective as, in the authors' opinion, the evolution in the former throws light on the latter. The article intends to leave the legal facts to speak by themselves. By unveiling their rationale, it also gives rise to political concerns regarding the evolution of the law. As CETA limits the ability of the EU to legislate and erodes the ECJ's role, the article leads to the conclusion that the underlying rationale for the evolution, both in the internal and the external areas, has not been that of promoting integration but that of deregulation.

La discusión en torno al proteccionismo y el librecambismo se mantiene, especialmente cuando la crisis económica mundial plantea escenarios en donde los estados y los gobiernos contemplan soluciones y políticas las cuales puedan inclinarse más a favor de una doctrina u otra. En este sentido este articulo intenta establecer los motivos de fondo del porque Colombia tenía que insertarse en el proceso de apertura económica que hasta ahora sigue promoviendo el sistema multilateral de comercio; y cuáles han sido, además, a nivel general, los beneficios de haber tomado esta decisión dentro de su política comercial. De igual forma se pretende caracterizar en el tiempo durante los últimos 20 años, desde 1995 hasta 2015, los efectos de implementar políticas proteccionistas en ciertos sectores industriales en Colombia; también se busca analizar el comportamiento del sector industrial en el país desde su inserción a la OMC como asimismo identificar el nivel de apertura económica respecto a algunos países para finalmente establecer algunas conclusiones en torno a lo que ha significado todo este proceso de liberalización comercial y económica.

In this sense, this article establish the main reasons that Colombia had to be inserted into the process of economic liberalization which still it is promoted by the multilateral trading system and which are also, in general, the benefits of taking this decision in its trade policy. Likewise the article aims to characterize during the past 20 years, from 1995-2015, the effects to implement protectionist policies in some industrial sectors in Colombia; also it seeks to analyze the behavior of the industrial sector in the country since its inception to the WTO and also identify the level of economic liberalization respect other countries, to finally establish some conclusions about the meaning of this process.
