El control electoral como elemento indisociable de toda democracia: los orígenes de la administración electoral española

Concebido el control electoral como uno de los elementos inherentes a todo Estado de Derecho, su efectiva implantación fue prácticamente inexistente a lo largo del constitucionalismo histórico español. Así sucedió, en efecto, no tanto por la calidad de las normas electorales, que fue mejorando con el paso de los años, como por su deficiente puesta en práctica, con unos partidos políticos que hicieron del fraude electoral y de la corrupción su habitual modus operandi. Solo tras comprender la verdadera magnitud de ese sistemático falseamiento estaremos en condiciones de valorar, en su justa medida, el logro que para nuestra democracia ha supuesto la consolidación de una auténtica Administración electoral autónoma e independiente respecto de una Administración pública que, pese a todo, sigue conservando importantes funciones para el correcto desarrollo del proceso electoral.
LOS DERECHOS FUNDAMENTALES EN ESTADO DE ALARMA: UNA SUSPENSIÓN INCONSTITUCIONAL

al estado de alarma para hacer frente a la pandemia provocada por el
COVID-
19, en lo que supone la generalización de una serie de medidas restrictivas
que pondrán a prueba la fortaleza del orden constitucional establecido. Siendo
el estricto confinamiento domiciliario la más importante de todas ellas, este artículo
pone de manifiesto los vicios de inconstitucionalidad en que ha incurrido
un estado de alarma claramente extralimitado, ello desde el momento en que impone
la suspensión general de derechos fundamentales sin las correspondientes
garantías constitucionales exigidas para ello.

Saturday, March 14, 2020. The Spanish government has decided to
use the state of alert to tackle the pandemic caused by COVID-19, which involves
the generalisation of a series of restrictive measures that will test out the strength
of the established constitutional order. With strict home confinement as the most
important of these actions, this article shows the unconstitutionality of a state
of alarm that has gone completely beyond its limits, since it imposes a general
suspension of fundamental rights without the corresponding constitutional
guarantees required for this purpose.

BIBLIOGRAPHY.Summary: constitutional normality consists of the regular and general application of a series of pre-established legal rules, with the objective of achieving the peaceful coexistence of citizens. However, there are extraordinary danger situations in which some ordinary rules may not be enforced, in order to restore political-constitutional normality. Although it is impossible to anticipate all the anomalous circumstances likely to occur, it is in the interests of legal security that at least the most common threats should be foreseen. This is what the majority of Spanish doctrine agrees to call a state of exception or exception right, understood in a broad sense.This work rejects the latter terminological conception, and this under a new taxonomic proposal applicable to the field of constitutional abnormality. On the basis of the differentiation between situations of regulated and non-regulated constitutional emergency, we defend the true legal exception is manifested when, in the absence of applicable regulation in case of a specific threat, the state reaction finds no other limits than the respect for the principle of proportionality in the defense of democratic legal values. It is the latter, in fact, which makes it impossible to confirm the total suspension of the Law in the face of a non-regulated exceptional circumstance, all these legal premises belonging to what we understand to be constitutional emergency law. ; La normalidad constitucional consiste en la aplicación habitual y general de una serie de reglas jurídicas preestablecidas, ello con el objetivo de ordenar la pacífica convivencia ciudadana. Sin embargo, existen situaciones de peligro extraordinario en las que deberá estar justificado que las reglas habituales cedan en gran medida, ello con el objetivo de lograr una pronta restauración de la normalidad político-constitucional. Aunque anticipar todas las circunstancias excepcionales susceptibles de producirse es tarea del todo imposible, va en beneficio de la seguridad jurídica la previsión de, al menos, las amenazas más comunes. En esa regulación consiste lo que la doctrina española mayoritaria conviene en denominar estado de excepción o derecho de excepción, entendidos en sentido amplio.Este trabajo rehúye la anterior concepción terminológica, y lo hace en el marco de una nueva propuesta taxonómica aplicable al ámbito de la anormalidad constitucional. Así, partiendo de la diferenciación entre situaciones de emergencia constitucional reglada y no reglada, defendemos que la verdadera situación jurídica de excepción se manifiesta cuando, no existiendo regulación aplicable frente a la amenaza concreta, la reacción estatal no encuentra más límites que el respeto al principio de proporcionalidad en la defensa de los valores democráticos consagrados en la Constitución. Es esto, además, lo que impide afirmar la suspensión total del derecho frente al hecho excepcional no regulado, perteneciendo todas estas premisas jurídicas a lo que nosotros entendemos que es el derecho de emergencia constitucional.

Abstract:2017 witnessed important events in relation to the phenomenon of the right-wing ideology in Germany. First, in January, the Federal Constitutional Court ruled against the prohibition of the NPD, despite recognizing the anti-democratic nature of its objectives; then, in July, a constitutional reform came into effect to exclude from the state funding those political formations that, contravening the democratic order, are not prohibited as they lack the necessary potential to achieve their objectives. To conclude, September ended with the holding of federal elections and the entry of the AfD into the Bundestag, as the country's third largest force. In light of all this, the present work is committed to the analysis of the main legal implications derived from these events, this with the aim to offer the reader an updated view on the legal control applicable to theideology of political parties in Germany. ; Resumen:El año 2017 fue testigo de importantes acontecimientos en relación con el fenómeno de la ideología de ultra derecha en Alemania. Si en enero, el Tribunal Constitucional Federal fallaba en contra de la prohibición del NPD pese a reconocer el carácter antidemocrático de sus objetivos, en julio entraba en vigor una reforma constitucional para excluir de la financiación estatal a formaciones políticas que, siendo contrarias al orden democrático, no sean objeto de prohibición al carecer del potencial necesario para alcanzar sus objetivos. A modo de colofón, septiembre finalizaba con la celebración de elecciones federales y la entrada de la AfD en el Bundestag como tercera fuerza política. A la luz de todo ello, en el presente trabajo se apuesta por el análisis de las principales implicaciones jurídicas derivadas de dichos hechos, ello con el ánimo de ofrecer al lector una visión actualizada sobre el control jurídico aplicable a la ideología de los partidos políticos en Alemania.Summary1. LOS NUEVOS GRUPOS POLÍTICOS SIGNIFICATIVOS EN LA COBERTURA INFORMATIVA ELECTORAL

Las elecciones generales de 2015 supusieron un golpe contra el
bipartidismo imperfecto imperante en España desde la restauración de la democracia
¿la repetición de las mismas en 2016 no sirvió para que éste recuperase
demasiado terreno¿, ello en favor, sobre todo, de dos formaciones políticas noveles
en unos comicios de este ámbito: Podemos y Ciudadanos. En este sentido,
y habida cuenta de que uno de los aspectos en los que estos grupos partían con
mayor desventaja era el comunicativo, es importante comprobar cómo la Junta
Electoral Central fue adaptando al nuevo contexto político el régimen jurídico
de la cobertura informativa electoral proporcionada por los medios durante el
período electoral. El presente trabajo se dedica precisamente al análisis de esa
cuestión, centrándose en las novedades introducidas en 2015 para los grupos
políticos significativos que, por debutar en unos comicios concretos, carecen de
referencias anteriores equivalentes que les permita justificar un trato informativo
preferente con respecto a otras candidaturas. En ese contexto, se estudiarán
los aspectos normativos más controvertidos, realizándose distintas sugerencias
de lege ferenda.

Ildo horretan, eta kontuan izanik talde hauen desabantaila handienetako bat
komunikazioaren ingurukoa zela, garrantzitsua da egiaztatzea Hauteskunde Batzorde
Zentrala, pixkanaka, testuinguru politiko berrira egokituz joan zela hauteskunde-
kanpainan hedabideen aldetik hauteskunde-informazioari buruz egindako
estalduraren araubide juridikoa. Lan honen xedea, hain zuzen, gai hori aztertzea
da, eta 2015ean formazio politiko esanguratsuentzat sartutako berrikuntzetan zentratzen
da, izan ere, talde politiko horiek, maila honetako hauteskundeetan debuta
egiten zutenez, ez baitzuten maila bereko aurreko erreferentziarik, beste hautagaitza
batzuekiko lehentasunezko informazio-tratua justifikatzeko. Testuinguru horretan,
arautegiko alderdi eztabaidagarrienak aztertuko dira, eta zenbait iradokizun
egiten dira de lege ferenda.
The parliamentary elections of 2015 came as a blow to the
imperfect bipartisanship set in Spain since democracy was restored ¿the
rerun of the elections in 2016 did not help this phenomenon to recover too
much ground¿, and this benefited, most of all, two new political groups firsttimers
in an election of such geographic scope: Podemos and Ciudadanos. In
this regard, and given that the media was one of the aspects in which these groups were starting from a position of greater disadvantage, the successful
adaptation by the Central Elections Commission to the new political context of
the regulation on electoral media coverage during the election period should
be highlighted. Well, it is precisely this issue which is addressed in the current
paper, with a particular emphasis on the regulatory developments introduced
in 2015 for those significant political groups which, for being first-timers in
specific elections, lack previous equivalent references allowing them to justify
preferencial informative treatment over other candidacies. In this context,
the most controversial legal aspects will be studied, making also various
suggestions de lege ferenda.

<p>Los procesos electorales desempeñan un papel fundamental en el funcionamiento de cualquier Estado democrático, pues es a través de ellos como se hace posible la alternancia en el poder. En este sentido, y teniendo en cuenta que la lucha por alcanzar tal objetivo suele dar lugar a tensiones y controversias, se antoja primordial la existencia de un sistema de control electoral que vele por el correcto desarrollo de los comicios, dando respuesta a las impugnaciones que por distintos motivos puedan presentarse.
