El objetivo principal del presente trabajo es el análisis de la reducción prevista en la base imponible del ISD en el caso de la adquisición mortis causa de la vivienda habitual del causante, tanto a nivel estatal como autonómico y foral. Así, además de valorar su viabilidad y estudiar las precisiones que derivan de una realidad compleja, se analizarán los diferentes conflictos normativos que aparecen y que, en algún caso, llegan a ser susceptibles de inconstitucionalidad, acabando con algunas propuestas de mejora para su reformulación.

LABURPENA: Oinordetzen eta dohaintzen gaineko zerga Estatuaren titulartasunekoa da; hala ere, foru-lurraldeetan, araudi autonomoko zerga itundu gisa eratu da, araubide erkidea duten gainerako autonomia-erkidegoei laga zaien bezala. Ondorioz, autonomia-erkidegoek eta foru-lurraldeek, zergaren etekinean parte hartzeaz gain, hainbat eskumen dauzkate aitortuta; hala nola, araudiaren ingurukoak eta ezarpenaren eta berrikuspenaren ingurukoak. Hala, askotariko ahal autonomikoen azterketa egitea da lan honen xede nagusia. Bestalde, agerian jarri nahi dira arazoak, eta hobetzeko proposamenak eman, etorkizuneko eta beharrezko birkonfigurazioari begira.
RESUMEN: A pesar de que el Impuesto sobre Sucesiones y Donaciones sea un tributo de titularidad del Estado, se encuentra configurado como tributo concertado de normativa autónoma en los territorios forales, del mismo modo que se encuentra cedido al resto de Comunidades Autónomas de régimen común. Por consiguiente, las diferentes autonomías y territorios forales no sólo pueden participar de su rendimiento, sino que también tienen reconocidas competencias tanto respecto a su normativa como a su aplicación y revisión. Así, el análisis de estas diversas capacidades autonómicas es el objeto principal del presente trabajo, procurando poner de manifiesto las diferentes problemáticas que se plantean y aportando diferentes propuestas de mejora de cara a una futura y necesaria reconfiguración.
ABSTRACT: In spite of the fact that the Spanish Inheritance and Gift Tax is a State tax, it is configured as a concerted tribute of autonomous regulation in the Historical Territories of Basque Country and in the Foral Community of Navarra, while is set as a ceded tax in the rest of Spanish Autonomous Communities under the common system. Therefore, regional territories can participate in the tax collection, but they also have recognized normative powers and competences related to its application and review. Thus, the analysis of these regional capacities is the main objective of this work, trying to highlight the different problems encountered and suggesting their improvement.

El objetivo principal del presente trabajo es poner de manifiesto los principales problemas que actualmente se presentan, a nivel constitucional, en los impuestos locales respecto a las parejas de hecho, tanto desde la óptica de los principios de justicia tributaria como desde un punto de vista competencial. En concreto, tales conflictos se circunscriben en el Impuesto sobre el Incremento de Valor de los Terrenos de Naturaleza Urbana e, indirectamente, el Impuesto sobre Bienes Inmuebles, donde resultan necesarios, en ambos casos, cambios en la regulación estatal.

El gran desenvolupament normatiu i material que ha experimentat l'Administració tributària espanyola amb relació a la incorporació de les tecnologies de la informació i la comunicació (TIC) no solament l'ha portat a ser un exemple a seguir per a les altres administracions públiques, sinó que també l'ha convertit en tot un referent internacional. En concret, aquelles primeres previsions genèriques previstes en la Llei 30/1992, de 26 de novembre, de règim jurídic del procediment administratiu comú i, essencialment, en la Llei 28/2003, de 17 de desembre, general tributària, s'han convertit avui en una llei de caràcter bàsic en matèria d'Administració electrònica i en una seu electrònica completa, la qual cosa ha derivat en la informatització de tots els procediments i en una nova forma de funcionament. No obstant això, i malgrat els lloables esforços invertits sobre aquest tema, l'assentament ple de la denominada Administració electrònica és un repte encara llunyà. Justament l'objecte d'aquest treball és posar de manifest les qüestions i els aspectes que encara resten pendents per a fer-la realitat. ; The great regulatory and material developments implemented in the Spanish Tax Administration Agency to incorporate the information and communication technologies has made it an example not only for rest of the Spanish public sector but also internationally. Specifically, the first generic provisions of Law 30/1992 (26 November) on the legal framework for the common administrative procedure and, fundamentally, Law 28/2003 (17 December) on general taxation have become the legislative basis for all e-administration matters and for creating an all-encompassing website, which has meant the digitalisation of all procedures and a new form of operation. However, despite the laudable efforts made to date, the total implementation of the so-called e-administration is still a long way off. The aim of this paper is to examine the matters and aspects still to be addressed to make this a reality. ; El gran desarrollo normativo y material que ha experimentado la Administración tributaria española en relación con la incorporación de las tecnologías de la información y la comunicación no solo la ha llevado a ser un ejemplo a seguir para las demás administraciones públicas, sino que también la ha convertido en todo un referente internacional. En concreto, aquellas primeras previsiones genéricas contempladas en la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico del Procedimiento Administrativo Común y, esencialmente, en la Ley 28/2003, de 17 de diciembre, General Tributaria, se han convertido hoy en una ley de carácter básico en materia de e-Administración y en una completa sede electrónica, lo que ha derivado en la informatización de todos los procedimientos y en una nueva forma de funcionamiento. Sin embargo, y a pesar de los loables esfuerzos invertidos en ello, el pleno asentamiento de la denominada Administración tributaria electrónica es un reto aún lejano, y es que justamente el objeto del presente trabajo es poner de manifiesto las cuestiones y aspectos que todavía están pendientes para hacer de ella una realidad.

L'Administració pública s'ha vist obligada a adoptar un paper proactiu en la incorporació de les TIC, així com a donar resposta a les noves necessitats ciutadanes i a vetllar perquè es pugui assentar el nou paradigma de manera definitiva. En conseqüència, les TIC han comportat canvis importants també en aquest àmbit, i és que la seva inclusió ha iniciat un nou estadi en el seu procés evolutiu en el qual s'espera una autèntica transformació institucional. Tot aquest procés de canvi, basat en la interacció ciutadana com a fonament principal del sistema, ha trobat el seu màxim exponent en l'esfera de l'Administració tributària, on el seu tradicional sistema d'aplicació dels tributs ja havia comportat l'adopció de tècniques de gestió en massa . En aquest sentit, la impossibilitat de practicar cas per cas els milions de liquidacions anuals relatives a les més importants figures impositives i el caràcter gairebé permanent de les relacions jurídico-tributàries, van obligar a requerir la participació dels obligats tributaris, de manera que les autoliquidacions i la imposició de nombrosos deures d'informació i col·laboració es van convertir en els principals mecanismes del nou model de funcionament. Així, els ciutadans es van trobar amb la responsabilitat de conèixer, interpretar i aplicar el complex, canviant i, de vegades, fins i tot deficient ordenament tributari, de manera que s'havia de compensar la reducció de l'activitat administrativa amb una forta prestació dels deures d'informació i assistència als obligats tributaris. En aquest sentit, s'havien potenciar totes aquelles actuacions de l'Administració encaminades a donar a conèixer la informació necessària per a l'exercici dels drets i compliment de les obligacions tributàries, així com aquelles tasques que oferien recursos i auxili amb la mateixa finalitat. Tanmateix, la regulació d'aquests deures no ha aconseguit estar a l'altura de la seva rellevància, en tant que la normativa s'ha limitat a contemplar el seu reconeixement general (article 85.1 de la LGT i 62 del RD 1065/2007) i assenyalar algunes de les actuacions per les quals poden veure's complerts (article 85.2 de la LGT i 63 a 78 del RD 1065/2007). A més, els règims jurídics d'aquestes actuacions difereixen en gran mesura, i contenen, en molts aspectes, un marcat caràcter programàtic. Per això, encara no hi ha una definició clara de cada un d'aquests deures ni una delimitació dels instruments que conformen el seu contingut, de manera que tampoc s'ha pogut elaborar la regulació completa de les seves característiques ni la previsió dels diferents efectes jurídics que es poden desprendre. Conseqüentment, el present treball té com a objectiu principal l'elaboració d'un estudi jurídic complet i actual sobre els deures d'informació i assistència de l'Administració tributària en relació directa amb la incorporació, en aquest àmbit, de les TIC. Així, es pretén dur a terme una valoració global de l'impacte dels nous mitjans en aquestes figures tributàries, a més d'aportar una definició actualitzada del seu concepte, una determinació del seu contingut, i una concreció de les seves característiques i conseqüències jurídiques. ; La Administración pública se ha visto obligada a adoptar un papel pro-activo en la incorporación de las TIC, así como a dar respuesta a las nuevas necesidades ciudadanas y a velar para que el nuevo paradigma pueda asentarse de forma definitiva. En consecuencia, las TIC han comportado cambios importantes también en este ámbito, y es que su inclusión ha iniciado un nuevo estadio en su proceso evolutivo en el que se espera una auténtica transformación institucional. Todo este proceso de cambio, basado en la interacción ciudadana como fundamento principal del sistema, ha encontrado su máximo exponente en la esfera de la Administración tributaria, donde su tradicional sistema de aplicación de los tributos ya había conllevado la adopción de técnicas de gestión en masa. En este sentido, la imposibilidad de practicar caso por caso los millones de liquidaciones anuales relativas a las más importantes figuras impositivas y el carácter casi permanente de las relaciones jurídico-tributarias, obligaron a requerir la participación de los obligados tributarios, de modo que las autoliquidaciones y la imposición de numerosos deberes de información y colaboración se convirtieron en los principales mecanismos del nuevo modelo de funcionamiento. Así, los ciudadanos se encontraron con la responsabilidad de conocer, interpretar y aplicar el complejo, cambiante y, a veces, incluso deficiente ordenamiento tributario, por lo que debía compensarse la reducción de la actividad administrativa con una fuerte prestación de los deberes de información y asistencia a los obligados tributarios. En este sentido, debían potenciarse todas aquellas actuaciones de la Administración encaminadas a dar a conocer la información necesaria para el ejercicio de los derechos y cumplimiento de las obligaciones tributarias, así como aquellas labores que ofrecían recursos y auxilio con el mismo fin. Sin embargo, la regulación de estos deberes no ha conseguido estar a la altura de su relevancia, en tanto que la normativa se ha limitado a contemplar su reconocimiento general (artículo 85.1 de la LGT y 62 del RD 1065/2007) y a señalar algunas de las actuaciones por las que pueden verse cumplidos (artículo 85.2 de la LGT y 63 a 78 del RD 1065/2007). Además, los regímenes jurídicos de estas actuaciones difieren en gran medida, y contienen, en muchos aspectos, un marcado carácter programático. Por ello, aún no existe una definición clara de cada uno de estos deberes ni una delimitación de los instrumentos que conforman su contenido, por lo que tampoco se ha podido elaborar la regulación completa de sus características ni la previsión de los diferentes efectos jurídicos que se pueden desprender. Consecuentemente, el presente trabajo tiene como objetivo principal la elaboración de un estudio jurídico completo y actual sobre los deberes de información y asistencia de la Administración tributaria en relación directa con la incorporación, en este ámbito, de las TIC. Así, se pretende llevar a cabo una valoración global del impacto de los nuevos medios en dichas figuras tributarias, además de aportar una definición actualizada de su concepto, una determinación de su contenido, y una concreción de sus características y consecuencias jurídicas. ; In The Spanish Tax Administration, citizens have the responsibility to find out, interpret and apply the complex, changing and sometimes even deficient tax legislation, so that the reduction of the administrative activity has to be counterbalanced with a strong rendering of the information and assistance services to the taxpayers. In this sense, all those Administration actions design to make available all the information pertaining to the exercise of rights and the compliance of tax obligations have to be strengthened, together with those actions offering resources and aid with the same purpose. However, the regulation of these obligations has not measured up to their relevance, for legislation has just acknowledged them in general terms (articles 85.1 of the LGT and 62 of the RD 1065/2007), and pointed out some of the actions through which they can be rendered (articles 85.2 of the LGT and 63 to 78 of the RD 1065/2007). Moreover, legislations pertaining to these actions are in disagreement to a large extent and hold, in many respects, a programmatical character. Therefore, to date, there is no clear definition of any of these obligations or a delimitation of the instruments that make up their content. In addition, neither the comprehensive regulation of their characteristics nor the forecast of their possible legal effects have been done. Accordingly, the main purpose of this thesis is to carry out a comprehensive legal study regarding the information and assistance obligations of the Tax administration, in direct relation to the incorporation of ICTs to its sphere of activity. Thus, the aim is to achieve a global assessment of the impact of ICTs on the application of these obligations, while contributing an updated definition of their concept, establishing their content and specifying their characteristics and legal consequences.

BACKGROUND: The identification of prognostic biomarkers for lung squamous-cell carcinoma (SCC) pathology is crucial because of its poor prognosis. A variant of the FGFR4 (fibroblast growth factor receptor 4) gene, FGFR4-388Arg, has been associated with prognosis and is linked to oncogenesis in vitro in several types of cancer. We analyzed the association of this variant with prognosis and downstream signaling alteration in lung SCC patients. METHODS: The presence of the FGFR4-388Arg variant was determined in 114 formalin-fixed, paraffin-embedded lung SCC tissue samples by DNA genotyping and was correlated with clinicopathologic data. The activation of the protein kinase B (AKT) and mitogen-activated protein kinase (MAPK) pathways was determined by immunohistochemistry, and its association with the presence of FGFR4-388Arg was analyzed. RESULTS: We found that tumor differentiation status and adjuvant chemotherapy administration could be independent prognostic factors for overall survival (OS) in lymph node-affected patients, as expected. The progression-free survival and OS of patients with lymph node involvement (n = 41) and the FGFR4-388Arg genotype were significantly lower than those of patients lacking this variant (P = .035 and P = .042, respectively). Importantly, multivariate analysis supported the independent prognostic role of the FGFR4-388Arg genotype in OS (P = .025). Regarding downstream signaling, the FGFR4-388Arg genotype was not correlated with altered AKT signaling but was associated with increased MAPK activation in the SCC tumor samples (P = .017). CONCLUSION: The FGFR4-388Arg variant may represent a promising prognostic biomarker in SCC patients with lymph node involvement. The mechanism underlying this association has not been addressed in detail in patients with this pathology. Here, we report that this FGFR4 variant induces MAPK and STAT3 activation and causes pro-oncogenic effects in NSCLC in vitro and in vivo. This variant induces the expression of EMT-related genes, such as N-cadherin, vimentin, Snail1 and Twist1. Indeed, the induction of N-cadherin protein expression by this variant is essential for its pro-tumorigenic role. The presence of the FGFR4-388Arg variant correlates with higher N-cadherin expression levels in clinical NSCLC samples and with poorer outcome in patients with FGFR expression. Lung tumors represent a major health problem. In early stage NSCLC tumors, surgical resection is the preferred treatment, but 30-55% of patients will relapse within 5 years after surgery. Thus, the identification of prognostic biomarkers in early stage NSCLC patients, especially those which are therapeutically addressable, is crucial to enhance survival of these patients. We determined the immunohistochemistry expression of key proteins involved in tumorigenesis and oncogenic signaling, p53, EGFR, pAKT and pERK, and correlated their expression level to clinicopathological characteristics and patient outcome. We found EGFR expression is higher in the squamous cell carcinomas than in adenocarcinomas (p=0.043), and that nuclear p53 staining correlated with lower differentiated squamous tumors (p=0.034). Regarding the prognostic potential of the expression of these proteins, high pERK levels proved to be an independent prognostic factor for overall (p<0.001) and progression-free survival (p<0.001) in adenocarcinoma patients, but not in those from the squamous histology, and high p53 nuclear levels were identified as independent prognostic factor for progression-free survival (p=0.031) only in squamous cell carcinoma patients. We propose a role as early prognostic biomarkers for pERK protein levels in adenocarcinoma, and for nuclear p53 levels in squamous cell lung carcinoma. This is an open-access article distributed under the terms of the Creative Commons Attribution License.-- et al. ; Squamous cell lung cancer (SCC) and adenocarcinoma are the most common histological subtypes of non-small cell lung cancer (NSCLC), and have been traditionally managed in the clinic as a single entity. Increasing evidence, however, illustrates the biological diversity of these two histological subgroups of lung cancer, and supports the need to improve our understanding of the molecular basis beyond the different phenotypes if we aim to develop more specific and individualized targeted therapy. The purpose of this study was to identify microRNA (miRNA)-dependent transcriptional regulation differences between SCC and adenocarcinoma histological lung cancer subtypes. In this work, paired miRNA (667 miRNAs by TaqMan Low Density Arrays (TLDA)) and mRNA profiling (Whole Genome 44 K array G112A, Agilent) was performed in tumor samples of 44 NSCLC patients. Nine miRNAs and 56 mRNAs were found to be differentially expressed in SCC versus adenocarcinoma samples. Eleven of these 56 mRNA were predicted as targets of the miRNAs identified to be differently expressed in these two histological conditions. Of them, 6 miRNAs (miR-149, miR-205, miR-375, miR-378, miR- 422a and miR-708) and 9 target genes (CEACAM6, CGN, CLDN3, ABCC3, MLPH, ACSL5, TMEM45B, MUC1) were validated by quantitative PCR in an independent cohort of 41 lung cancer patients. Furthermore, the inverse correlation between mRNAs and microRNAs expression was also validated. Squamous cell lung cancer (SCC) and adenocarcinoma are the most common histological subtypes of non-small cell lung cancer (NSCLC), and have been traditionally managed in the clinic as a single entity. Increasing evidence, however, illustrates the biological diversity of these two histological subgroups of lung cancer, and supports the need to improve our understanding of the molecular basis beyond the different phenotypes if we aim to develop more specific and individualized targeted therapy. The purpose of this study was to identify microRNA (miRNA)-dependent transcriptional regulation differences between SCC and adenocarcinoma histological lung cancer subtypes. In this work, paired miRNA (667 miRNAs by TaqMan Low Density Arrays (TLDA)) and mRNA profiling (Whole Genome 44 K array G112A, Agilent) was performed in tumor samples of 44 NSCLC patients. Nine miRNAs and 56 mRNAs were found to be differentially expressed in SCC versus adenocarcinoma samples. Eleven of these 56 mRNA were predicted as targets of the miRNAs identified to be differently expressed in these two histological conditions. Of them, 6 miRNAs (miR-149, miR-205, miR-375, miR-378, miR-422a and miR-708) and 9 target genes (CEACAM6, CGN, CLDN3, ABCC3, MLPH, ACSL5, TMEM45B, MUC1) were validated by quantitative PCR in an independent cohort of 41 lung cancer patients. Furthermore, the inverse correlation between mRNAs and microRNAs expression was also validated. [Rationale]: The characterization of new genetic alterations is essential to assign effective personalized therapies in non–small cell lung cancer (NSCLC). Furthermore, finding stratification biomarkers is essential for successful personalized therapies. Molecular alterations of YES1, a member of the SRC (proto-oncogene tyrosine-protein kinase Src) family kinases (SFKs), can be found in a significant subset of patients with lung cancer. ; [Objectives]: To evaluate YES1 (v-YES-1 Yamaguchi sarcoma viral oncogene homolog 1) genetic alteration as a therapeutic target and predictive biomarker of response to dasatinib in NSCLC. ; [Methods]: Functional significance was evaluated by in vivo models of NSCLC and metastasis and patient-derived xenografts. The efficacy of pharmacological and genetic (CRISPR [clustered regularly interspaced short palindromic repeats]/Cas9 [CRISPR-associated protein 9]) YES1 abrogation was also evaluated. In vitro functional assays for signaling, survival, and invasion were also performed. The association between YES1 alterations and prognosis was evaluated in clinical samples. ; [Measurements and Main Results]: We demonstrated that YES1 is essential for NSCLC carcinogenesis. Furthermore, YES1 overexpression induced metastatic spread in preclinical in vivo models. YES1 genetic depletion by CRISPR/Cas9 technology significantly reduced tumor growth and metastasis. YES1 effects were mainly driven by mTOR (mammalian target of rapamycin) signaling. Interestingly, cell lines and patient-derived xenograft models with YES1 gene amplifications presented a high sensitivity to dasatinib, an SFK inhibitor, pointing out YES1 status as a stratification biomarker for dasatinib response. Moreover, high YES1 protein expression was an independent predictor for poor prognosis in patients with lung cancer. ; [Conclusions]: YES1 is a promising therapeutic target in lung cancer.
