The country of origin principle (COP) sparked a major controversy surrounding the draft services directive that is currently going through the EU's legislative process. This paper uncovers some of its most important premises and implications. Following an introduction, chapter B sets out the content of the COP as proposed by the 2004 draft. Chapter C then places the COP in th e context of existing EC law concluding that its legislative introduction would break new ground both with regard to previous legislation and the case law of the ECJ. A se lection of its potential implications is discussed in chapters D and E: It is shown that the COP would operate to the detriment of legislative harmonisation and could possibly lead to greater regulatory competition between Member States. It is also demonstrated that the COP entails a structural enforcement deficit which could be further exacerbated by tactics of circumvention.Chapter F concludes the argument with a comparative glance at the amended proposal presented in April 2006.
