The current article examines the social origins of water scarcity in Rio Bueno basin, Chile. The political ecology's theoretical framework is employed to assess water scarcity as an "hybrid" phenomenon of socionatural nature, highlighting the development of a frame of "water scarcity typologies". By employing a combined methodology, we analyzed quantitative and qualitative water related data to reveal the existing water scarcity typologies, who suffers from water scarcity as well as to which factors this scarcity is attributed. Our results demonstrate the existence of different water scarcity typologies, and that water scarcity does not affect all actors involved, thus revealing anthropological factors in its production. We conclude that the origins of water scarcity are multiple, and that water management in Chile has prioritized economic activities of high national interest over the use of water for human consumption.
During the last decades, the province of Chacabuco, in the north of Santiago, has been profoundly territorially transformed due to the installation of urban mega-projects for well-off social segments in contexts that until then were eminently rural. From the perspective of suburban political ecology, we analyze the different economic, political and metabolic strategies with view to the water and land resources through which large economic-financial groups, supported by the state, have produced an unequal landscape of archipelagos. The methods used in this work include press review, semi-structured with private, public, and community actors, and an analysis of water rights records in the office of Real Estate Curator in the province of Chacabuco. In empirical and conceptual terms, we demonstrate that the production of the new urban periphery and its patterns of socioterritorial and environmental fragmentation are not the result of abstract forces of globalization, but of deliberate actions of commodification, concentration (of property rights) and financialization of natural resources like land and water. ; Durante las últimas décadas la provincia de Chacabuco, en el norte de Santiago, se ha transformado profundamente en términos territoriales debido a la instalación de megaproyectos urbanos para segmentos sociales acomodados, en contextos que hasta ese entonces eran eminentemente rurales. Desde la ecología política suburbana analizamos las distintas estrategias económicas, políticas y metabólicas con vista a los recursos del agua y el suelo a través de las cuales grandes grupos económicos-financieros, apoyados por el Estado, han producido un paisaje desigual de archipiélagos. Los métodos utilizados en este trabajo incluyen revisión de prensa, entrevistas en profundidad con actores privados, estatales, y comunitarios, y un análisis de los registros de derechos de agua en la oficina de Conservador de Bienes Raíces en la provincia de Chacabuco. En términos empíricos y conceptuales, demostramos que la producción de la nueva periferia urbana y sus patrones de fragmentación socioterritorial y ambiental no son resultados de fuerzas abstractas de globalización, sino de acciones deliberadas de comodificación, concentración (de derechos de propiedad) y financiarización de recursos naturales como el suelo y el agua.
This paper presents an analysis of technical-scientific knowledge utilization in the legal water conflicts in Chile, specifically located in Antofagasta and Valparaíso between 2010 and 2017, based on a document analysis of court verdict texts and expert interviews. The results show that technical-scientific proof is treated both as an administrative process and as relevant information in controversial situations. This treatment depends on the institutional context, affected by the lack of court specialization and deference to the administrative authority. Furthermore, the constitutional protection system of the property of water rights existing in the water code and 1980s political constitution influences the assessment of technical-scientific information in the final verdict of the courts. Finally, in conclusion, is highlighted the work of environmental courts and the need for water code changes to confront these problems. ; El presente artículo propone un análisis del uso del conocimiento científico en la jurisprudencia nacional respecto del conflicto hídrico en las regiones de Antofagasta y Valparaíso entre los años 2010 y 2017, a través del estudio de las sentencias y entrevistas a informantes claves. Los resultados indican que las pruebas técnico-científicas tienen una consideración dual en los juicios, como un proceso administrativo previo y como información relevante en situaciones de controversia. Tal consideración está condicionada por un contexto institucional de falta de especialización de las cortes en esta materia y una deferencia hacia la autoridad administrativa. Adicionalmente, el sistema de protección constitucional de la propiedad de los derechos de aprovechamiento en el Código de Aguas y la actual Constitución Política de Chile (1980) influyen significativamente en las posibilidades de apreciación de la información técnico-científica, y en la decisión final de los tribunales.
