The role of ethical rules and codes of conduct in the field of art law and international protection of cultural property, together with the adoption of the relevant international conventions, has constantly increased in the last decades. This article considers the main codes of conduct drafted by international organizations as well as international, national, public, and private institutions, federations, and associations. The focus is on their influence on international trade as instruments of art market regulation. Specific attention is paid to the interaction with the private international law approach and to a survey of both direct and indirect effects of these rules on the international circulation of cultural property.

The Musée du Quay Branly held an international symposium, "From Anatomic Collections to Objects of Worship: Conservation and Exhibition of Human Remains in Museums," in Paris on February 22–23, 2008, at the museum's Théatre Claude Levy Strauss. The main purpose of the 2-day conference—opened by the French Ministry of Culture and Communication's Christine Albanel—was to stimulate an international debate on a multidisciplinary basis concerning the roles and responsibilities of museums in the exhibition and repatriation of human remains. The subject turned out to be topical, originating from the case of thetoi moko, the Maori tattooed head belonging to the collection of the Natural History Museum in Rouen, France, since 1875. The restitution of thetoi mokoto the Papa Museum in Wellington, New Zealand, deliberated by the city of Rouen, was recently banned by the Administrative Tribunal of Rouen, on request of the Ministry of Culture at the end of 2007. The head actually belonged to a municipal museum, which was in fact part of the Musées de France, and therefore it was considered part of a public collection. Accordingly, the 2002 French statute providing for the inalienability of state properties was applicable.

L'accord signé à Abou Dabi le 6 mars 2007 entre le gouvernement de la République française et le gouvernement des Émirats arabes unis porte sur la création d'un musée universel à Abou Dabi, de son édification à la constitution de ses collections. Accord «hors normes » dans ce champ de la coopération culturelle, il marque une nouvelle étape en termes de coopération interétatique. Les institutions culturelles déploient des stratégies de rayonnement international de grande ambition, impliquant non seulement une plus grande mobilité des collections mais également la diffusion de savoir faire dans tous les champs de l'action muséale. Au-delà de l'action et du rôle des musées, en particulier le musée du Louvre qui tient une place de premier plan, c'est aussi, plus largement, du rayonnement culturel de la France dont il est question, d'où le choix d'un instrument solennel là où d'autres coopérations du même type sont le plus souvent portées par les institutions concernées.
