La negación del Holocausto está cada vez mas presente en nuestra sociedad. La negación, la justificación o la trivialización del Holocausto o de otros genocidios y crímenes de lesa humanidad complican y aumentan el paisaje de los fenómenos racistas que pueden manifestarse a través de actos pero también a través de las palabras. Por esta razón, la mayoría de los legisladores europeos (a nivel interno e internacional) han introducido un tipo penal ad hoc para perseguir estos fenómenos. Tomando como punto de partida el fallo del TC español sobre el delito de negación del genocidio, este artículo trata de investigar esta tendencia. Las legislaciones examinadas han sido aplicadas o cuestionadas en diversos juicios ante tribunales internos, Cortes supremas y frente al Tribunal Europeo de Derechos Humanos. La criminalización del negacionismo plantea muchas cuestiones, y especialmente la de los límites que puede introducir el derecho penal a la libertad de expresión y también la de identificar el instrumento penal (el derecho y el proceso) como medio para proteger y conservar la memoria histórica.Denial of Holocaust has a growing presence in our society. Propaganda denying, justifying, or minimizing the Holocaust, other genocides, and crimes against humanity surreptitiously complicate and augment the landscape of racist phenomenologies that manifest themselves through acts or words. For this reason, most European legislators (on a national and supranational level) have introduced ad hoc criminal laws punishing acts of denial into their legal systems. This essay —assuming as a point of depart the important judgment of the spanish Tribunal Constitucional concerning the crime of denial of genocide— aims to investigate this reality. The laws examined have been challenged in a series of legal proceedings before domestic trial courts, constitutional courts, and the European Court of Human Rights. Analysing denial as a crime means having to deal with the limits that criminal law imposes on freedom of expression and the question of whether the law and criminal trials can become the primary instrument for protecting and constructing memory.
