La experiencia electoral gaditana y su influencia en los albores de la República peruana

La conmemoración del bicentenario de la promulgación de la Constitución de la monarquía española, el 19 de marzo de 1812, ha sido la ocasión propicia para someter al análisis el proceso de génesis de la convocatoria de las Cortes generales y extraordinarias de Cádiz, así como los aportes más significativos de dicha Carta desde diferentes ámbitos. En este contexto decimonónico se puso de manifiesto el discurso de la soberanía del pueblo junto con el carácter representativo del Poder Legislativo, único capaz de redactarla y aprobarla. Este artículo aborda pasajes del funcionamiento de este colegiado a partir de los temas de soberanía, legitimidad y religión para orientarlos con posterioridad al establecimiento de las bases institucionales del Estado peruano durante sus primeros años.

The rise of the modern State did not just mean the instauration of a political and cultural system capable of articulate the ideas of reason, private property and liberty, but also implied a Copemican twist in the law and its application. Such changes were even more pronunciated in Hispanic America, in which countries imperated a casuistic system of law, established in the judicial arbitrarnent, characteristics that later were replaced by the concept of system and legal application of the rule. Thus, the present study intends to demonstrate the tensions and frictions that were present in the transition from the Spanish Colonial Law to the codificated law in Peru. ; El surgimiento del Estado moderno no sólo significo la instauración de un sistema político y cultural capaz de articular las ideas de razón, propiedad privada y libertad, sino que también implico un giro copernicano en el derecho y su aplicación. Dichos cambios fueron aún más pronunciados en Hispanoamérica, en cuyos países imperaba un sistema de derecho casuista y asentado en el arbitrio judicial, notas que luego fueron reemplazadas por el concepto de sistema y aplicación legalista de la norma. De ahí que, el presente estudio procure develar las tensiones y fricciones que se presentaron en el tránsito del sistema de derecho indiano al derecho codificado en el Perú.

The responsibility and ethics of the University in the social environment ; La responsabilidad y la ética de la Universidad en el entorno social
This article refers to the role that the responsibility and the ethics of the university in the social environment, -considering the permanent changes of the globalized world and the uncertainties due to the permanent changes in the educational field- plays nowadays with submission to greater demands on the quality of education both locally, nationally and internationally as a result of the changes and challenges for quality education and with corporate responsibility and ethics. The university should interact in dialogues with the different actors of students, teachers, companies and representatives of society in order to obtain greater criteria of understanding about their performance and their social responsibility with business ethics, identifying the essential contributions to sustainable human development but considering responsibility and business ethics as synonyms of high quality in university education. The university must focus on the sum of the efforts of all social actors, which involve the community with the management of the socially responsible organization, with academic training, with the production of knowledge and with the participation of sustainable human development, seeking the involvement of clients, suppliers, partners, the environment, communities, government and society in general and the consideration of social, economic, ethical and social factors. ; En el presente artículo se hace referencia al rol que la responsabilidad y la ética de la universidad en el entorno social -considerando los cambios permanentes del mundo globalizado, de las incertidumbres por los cambios permanentes en el campo educativo- juega hoy con sometimiento a mayores exigencias en relación con la calidad de la educación, tanto a nivel local como nacional e internacional, producto de los cambios y de los retos en aras de brindar educación con calidad y con responsabilidad y ética empresarial. La universidad debe interactuar en diálogos con los distintos actores de estudiantes, docentes, empresas y representantes de la sociedad con el fin de obtener mayores criterios de entendimiento acerca de su desempeño y de su responsabilidad social con ética empresarial, identificando los aportes esenciales al desarrollo humano sostenible, pero considerando la responsabilidad y la ética empresarial como sinónimos de alta calidad en la enseñanza universitaria. La universidad debe centrarse en la suma de esfuerzos de todos los actores sociales, que conlleven a la colectividad con gestión de organización socialmente responsable, con formación académica, con producción del saber y con participación del desarrollo humano sostenible, procurando el involucramiento de los actores sociales, relación que incluye clientes, proveedores, socios, consumidores, medio ambiente, comunidades, el gobierno y la sociedad en general, y la consideración de factores sociales, económicos, éticos y responsabilidad social.

Inmigración, derechos humanos y modelo europeo de fronteras Propuestas conceptuales sobre "extraterritorialidad", "desterritorialidad" y "externalización" de controles y flujos migratorios
The migratory flows and refugee crises in Europe since 2015 have motivated a growing concern about the respect of European values and Human Rights in the actions of the EU and the Member States when facing migratory flows and controls of access to European territory in the external borders. This work verifies how border lines are problematic places for the defence, application and protection of the human rights of foreigners, causing a situation of fragility of Human Rights at the external air, land and especially maritime borders of the EU.We are facing a change in the very conception of the border in this post-globalization era, where certain functions are relocated and systematically located outside the territory and border posts of the States. However, territorial and extraterritorial actions must be differentiated from those that occur in foreign action activities in or with third States for purposes of immigration policy and control of migratory flows. The reality is that a new border area to the south and east of the Mediterranean has been configured for migratory flows, which requires a new policy and strategy for external borders. For this reason, the EU is in search of a new 'model' of External Border that provides other parameters of action and management of migratory flows and external controls.On the other hand, the protection of human rights by European States beyond external borders is analysed to determine to what extent the control functions that are deployed outside the territory affect the human rights of immigrants. For this we differentiate between Externalization situations, where those who act are third States; and Extraterritorial action of migratory controls where agents from European States intervene. Both raise issues of human rights protection in migration controls outside the land or maritime territory of the EU Member States, in which we conceive as Deterritorialized border control functions. And both should have, in our opinion, different mechanisms for monitoring, control and supervision of respect for human rights in the functions of migration control.Respect for the human rights of aliens in border controls and management of migratory flows, both within and outside the territories of the EU States, is a vital issue for the identity, values and survival of European integration. ; Las avalanchas migratorias y crisis de refugiados en Europa desde 2015 han motivado una preocupación creciente sobre el respeto de los valores europeos y los Derechos humanos en la actuación de la UE y los Estados miembros al afrontar flujos migratorios y controles de acceso al territorio europeo en las fronteras exteriores. Este trabajo comprueba cómo las líneas fronterizas son lugares problemáticos para la defensa, aplicación y protección de derechos humanos de los extranjeros, provocando una situación de fragilidad de los Derechos humanos en las Fronteras Exteriores aéreas, terrestres y especialmente, en las marítimas de la UE.Estamos ante un cambio en la concepción misma de la frontera en esta era pos-globalización, donde determinadas funciones se deslocalizan y se sitúan sistemáticamente fuera del territorio y los puestos fronterizos de los Estados. Sin embargo, las actuaciones territoriales y extraterritoriales deben diferenciarse de las que se producen en actividades de acción exterior en o con terceros Estados a fines de política de inmigración y control de flujos migratorios.La realidad es que se ha configurado para los flujos migratorios un nuevo espacio fronterizo al sur y este del mediterráneo, que necesita una nueva política y estrategia de fronteras exteriores. Por ello la UE se encuentra en búsqueda de un nuevo 'modelo' de Frontera Exterior que aporte otros parámetros de actuacióny gestión de los flujos migratorios y los controles exteriores.Por otra parte, se analiza la protección de los derechos humanos por los Estados europeos mas allá de las fronteras exteriores, para determinar en qué medida las funciones de control que se despliegan fuera del territorio afectan a los derechos humanos de los inmigrantes. Para ello diferenciamos entre las situaciones de Externalización, donde los que actúan son Estados terceros; y de actuación Extraterritorial de controles migratorios donde intervienen agentes de Estados europeos. Ambas plantean problemáticas de protección de derechos humanos en controles migratorios fuera de territorio terrestre o marítimo de los Estados miembros de la UE, en los que concebimos como funciones desterritorializadas de control fronterizo. Y ambas deben tener en nuestra opinión diferenciados mecanismos de seguimiento, control y supervisión del respeto de los derechos humanos en las funciones de control de inmigración. Gibraltar, ¿costa española? Por una reformulación de la teoría de la 'costa seca' sobre el puerto y las aguas en torno al Peñón ; Gibraltar, Spanish coast? A reformulation of the theory of the 'dry coast' about the port and the waters around The Rock
Una de las facetas legales y políticas específicas de la disputa entre España y Gran Bretaña sobre Gibraltar son las zonas marítimas a su alrededor. La disputa se extiende a las aguas alrededor de la Roca, sus zonas marítimas y la jurisdicción sobre ellas, ya que, con la excepción de las aguas del puerto, España rechaza la existencia de aguas jurisdiccionales británicas alrededor de la Roca, mientras que el Reino Unido siempre las ha reclamado y ejercido jurisdicción de facto sobre ellas. España niega la existencia de aguas pertenecientes a Gibraltar, pero, en la práctica, permite el ejercicio de la jurisdicción británica dentro de una extensión establecida unilateralmente por el Reino Unido, sin distinguir entre las aguas de la Roca y las del istmo. El Reino Unido afirma una supuesta soberanía sobre las aguas alrededor de la Roca, pero su posición inicial de que las aguas que rodean el istmo son británicas es legalmente débil. Dos factores principales explican la evidente falta de coordinación con respecto al régimen legal que rige las aguas alrededor de la Roca. El primero es estructural: está inextricablemente vinculado a los temas centrales de la disputa de soberanía, ya que las aguas son legal y judicialmente inseparables de las otras disputas sobre la cesión de la ciudad, puerto, peñón e istmo, así como de la doctrina de la ONU. en descolonización. El otro factor es temporal: la falta de canales institucionales u otros canales de diálogo para alentar a las partes a abordar cuestiones prácticas de coexistencia y jurisdicción en las aguas. Esto explica la imposibilidad de llegar a un entendimiento sobre las aguas e incluso para alcanzar un modus vivendi simple y provisional sobre el régimen que rige la navegación en ellas. Con el Brexit, sin embargo, se han abierto otras perspectivas de futuro para eventuales acuerdos y coordinación en las aguas, a través del Protocolo sobre Gibraltar del Acuerdo de Retirada de Reino Unido de la UE y los Memorandos de cooperación. La posición de la "costa seca" española no es tan legalmente sólida con respecto a las aguas como a otros aspectos de la disputa, y además debilita la reclamación de España en su conjunto. Esta teoría es de alguna manera incompatible con la práctica española y, además, parece ser bastante joven, ya que se estableció en la década de 1960 durante la dictadura y posteriormente continuó en la democracia española. En este artículo se afirma que el problema de las aguas en torno a Gibraltar es el de la duda histórica sobre la extensión de las aguas del puerto en el frontal oeste del Peñón y el istmo: determinar el alcance hoy de las aguas del puerto y rada de Gibraltar, una vez admitido en 1968 por Reino Unido su no aplicación a las aguas más al norte denominadas "Puerto Canning". Asegurar una mayor coherencia entre la teoría y la práctica españolas en relación con la posición de España en las aguas de la bahía fortalecería la consistencia y la credibilidad de su reclamación sobre las aguas en la disputa de Gibraltar, que parece haber surgido en respuesta a la teoría de la 'costa seca' aplicada por el Reino Unido a España en ese momento Con este planteamiento, España podría considerar reformular la teoría de la costa seca, con una interpretación restrictiva del Tratado de Utrecht que considere no cedida la montaña completa, en particular la cara de levante del Peñón. De esta forma podría ofrecerse una base jurídica diferente a la teoría de la 'costa seca', con una mayor coherencia, ya que la españolidad no derivaría de la no cesión de aguas en Utrecht, sino de que el territorio del este no se cedió –como tampoco se cedió el istmo- por lo que la costa del este de la montaña y sus aguas son españolas. Esta reformulación de la 'costa seca' consistiría en la práctica en la afirmación de costa española en el istmo y este del Peñón, con consecuencias similares a las de la tesis española tradicional: negar espacios marítimos al Gibraltar británico fuera de los espacios en el interior de la Bahía. De esta forma, la reformulación que proponemos daría coherencia a la posición histórica tradicional española, que interpreta el Art X como una cesión que "no reconoce otros derechos y situaciones relativos a los espacios marítimos de Gibraltar que no estén comprendidos en el Tratado de Utrecht". Con esta lectura restrictiva del Tratado de Utrecht, se salvaguardaría en el futuro para los intereses españoles una hipotética expansión británica de espacios marítimos al este de Gibraltar. También el articulo considera la situación en descolonización de Gibraltar y la aplicabilidad la III Resolución de la III Conferencia de Naciones Unidas sobre Derecho del Mar. Igualmente se subraya la vinculación de la controversia en las aguas con la necesidad de tratamiento democrático dentro de España y con Reino Unido de los intereses esenciales británicos, que son los estratégicos, militares, de inteligencia y seguridad. Esta cuestión es probablemente la esencia última de todo el problema, y tiene un déficit democrático estructural, pues hay que contemplar involucrar a las Cortes españolas en el debate real sobre las bases militares británicas, ya que la situación de privilegio militar y estratégico de los británicos no puede mantenerse a costa de la seguridad de los españoles. En suma, con la propuesta que se realiza se pretende una argumentación coherente con la posición tradicional española sobre las aguas de la «Costa Seca», mediante una revisión interpretativa del Tratado de Utrecht y de la práctica española. ; One of the specific legal and political facets of the dispute between Spain and Great Britain over Gibraltar is the maritime areas around it. The dispute extends to the waters surrounding the Rock, its maritime zones and the jurisdiction over them, since, with the exception of the waters of the port, Spain rejects the existence of British jurisdictional waters around the Rock, while the UK has always claimed them and exercised de facto jurisdiction over them. Spain denies the existence of waters belonging to Gibraltar but, in practice, allows the exercise of British jurisdiction within an extension unilaterally established by the United Kingdom, without distinguishing between the waters of the Rock and those of the isthmus. The UK asserts an alleged sovereignty over the waters around the Rock, but its initial position that the waters surrounding the isthmus are British is legally weak. Two main factors explain the evident lack of coordination regarding the legal regime that governs the waters around the Rock. The first is structural: it is inextricably linked to the central issues of the sovereignty dispute, since the waters are legally inseparable from the other disputes over the transfer of the city, port, rock and isthmus, as well as from the UN doctrine of decolonization. The other factor is temporary: the lack of institutional channels or other channels of dialogue to encourage the parties to address practical issues of coexistence and jurisdiction in waters. This explains the impossibility of reaching an understanding about the waters and even to reach a simple and provisional modus vivendi on the regime that governs navigation in them. With Brexit, however, other future prospects have been opened for possible agreements and coordination in the waters, through the Protocol on Gibraltar of the United Kingdom's Withdrawal Agreement from the EU and the Memoranda of cooperation. The position of the Spanish "dry coast" is not as legally solid with respect to the waters as with other aspects of the dispute, and furthermore weakens the claim of Spain as a whole. This theory is somewhat incompatible with Spanish practice and, furthermore, it seems to be quite young, since it was established in the 1960s during the dictatorship and subsequently continued in Spanish democracy. This article affirms that the problem of the waters around Gibraltar is that of the historical doubt about the extent of the waters of the port on the western front of the Rock and the Isthmus: determining the scope of the waters of the port and roadstead today of Gibraltar, once admitted in 1968 by the United Kingdom its non-application to the northernmost waters called "Puerto Canning". Ensuring greater coherence between Spanish theory and practice in relation to Spain's position in the waters of the bay would strengthen the consistency and credibility of its claim on the waters in the dispute in Gibraltar, which seems to have arisen in response to the theory of the 'dry coast' applied by the United Kingdom to Spain at that time. With this approach, Spain could consider reformulating the theory of the dry coast, with a restrictive interpretation of the Treaty of Utrecht that considers the entire mountain, in particular the east face of the Rock, not to be ceded. In this way, a different legal basis could be offered to the 'dry coast' theory, with greater coherence, since the Spanish title would not derive from the non-cession of waters in Utrecht, but from the fact that the eastern territory was not ceded –nor was the isthmus given up– so the eastern coast of the mountain and its waters are Spanish. This reformulation of the 'dry coast' would consist in practice of the affirmation of the Spanish coast in the isthmus and east of the Rock, with consequences similar to those of the traditional Spanish thesis: denying maritime spaces to British Gibraltar outside the spaces in the interior of the Bay. In this way, the reformulation that is proposed would give coherence to the traditional Spanish historical position, which interprets Art X as a transfer that "does not recognize other rights and situations related to the maritime zones of Gibraltar that are not included in the Treaty of Utrecht". With this restrictive reading of the Treaty of Utrecht, a hypothetical British expansion of maritime spaces east of Gibraltar would be safeguarded in the future for Spanish interests. The article also considers the situation in decolonization of Gibraltar and the applicability of the III Resolution of the III United Nations Conference on the Law of the Sea. Likewise, the link of the controversy in the waters with the need for democratic treatment within Spain and with the United Kingdom of the essential British interests, which are strategic, military, intelligence and security, is underlined. This question is probably the ultimate essence of the whole problem, and it has a structural democratic deficit, since it is necessary to contemplate involving the Spanish Cortes in the real debate on the British military bases, since the situation of British military and strategic privilege it cannot be maintained at the expense of the security of Spain and its citizens. In short, the proposal made is intended to make an argument consistent with the traditional Spanish position on the waters of the "Dry Coast", through an interpretative review of the Treaty of Utrecht and of the Spanish practice.

El rescate de personas en el Mediterráneo. Sobre la inviabilidad del modelo de fronteras exteriores europeas en el Mediterráneo
La cuestión del rescate de inmigrantes en el mar y en general de la inmigración en el Mediterráneo plantea de entrada un drama espantoso de seres humanos, que por definición es un tema capital y de primer orden en la integración europea. Además, desde un punto de vista jurídico, estamos ante una problemática muy compleja y de difícil tratamiento coherente de conjunto.

Sovereignty without territory? A symbolic sovereignty proposal for Gibraltar ; ¿Soberanía sin territorio? Una propuesta de soberanía simbólica para Gibraltar
International Society gives rise to paradoxes in the relationship between some of the essential components of states: territory, sovereignty and borders. The paradoxes 'State without Territory', 'Territory without Sovereignty', 'Territory without Borders', and 'Symbolic Sovereignty' are referred. The contradictions or anomalies that these paradoxes express are reframed with the help of international law, but they also reflect a certain readjustment of the concepts or meanings of sovereignty and their exercise in the present. In the case of Gibraltar, these examples can help us explore imaginative formulas of a symbolic nature that would allow for the dissociation of sovereignty, territoriality and the exercise of state or sovereign functions. Indeed, Brexit could be an opportunity to discuss new, unorthodox solutions for the specific and unique case of Gibraltar. The 2016 Spanish joint sovereignty proposal is probably not the right start for a solution. This paper thus proposes exploring new symbolic sovereignty formulas, such as a Principality in the Strait. Specifically, this paper proposes a 'City of the Two Crowns' formula, i.e. an internationalized territory incorporated into the Crowns of Spain and the UK. This could reintegrate the Gibraltarian territory currently under British jurisdiction into the Kingdom of Spain. The key would be the exercise of state functions, entrusted in practice to the UK and Gibraltar under the supervision of the EU and in coordination with Spain. Such an internationalized city would highlight the permanent desire to move away from the legal confrontation, in order to give priority to cross-border cooperation and consolidate a new internationalized border reality at the southern tip of the Iberian Peninsula and in the Straits.

Refugiados y crisis migratorias: fronteras y 'desterritorialidad' en las puertas de Europa
REFUGIADOS Y CRISIS MIGRATORIAS: FRONTERAS Y DESTERRITORIALIDAD EN LAS PUERTAS DE EUROPA La denominada crisis de los refugiados de 2015 ha trastocado muchos aspectos de la integración europea. No se trata solo de la política migratoria o de la acogida a solicitantes de asilo, sino de numerosos aspectos vinculados a la esencia misma y naturaleza de la Unión y de la construcción europea, pues son los valores europeos los que están en juego a la hora de afrontar los desafíos que plantea la presión migratoria actual y futura hacia Europa . En este trabajo analizaremos el impacto de la crisis de refugiados de 2015, en el sistema europeo de fronteras interiores y exteriores, y los nuevos aspectos de control migratorio en las fronteras exteriores, que van más allá de los espacios bajos soberanía o jurisdicción de los Estados. Para ello analizamos (II) la conformación de, espacio europeo de libre circulación «federal» de personas y sus sistema de fronteras en vigor desde 1995; el análisis de la crisis, sus efectos y la reacción de la UE nos llevará a determinar cómo esta concreta crisis se incardina en un marco de flujos y presión migratoria cuyas rutas de acceso a Europa son bien conocidas, y que determinan las vías migratorias que denominamos las puertas de Europa con los Estados vecinos de Turquía, Marruecos y Libia. La situación de las fronteras internas y externas tras la crisis y los retos migratorios presente y futura son igualmente examinados (III). En particular se analizan los obstáculos a la libre circulación, y la situación de las fronteras exteriores en su evolución del control migratorio. Aquí valoramos los problemas de la inmigración por vía marítima, y la preocupación actual por poner en marcha y desarrollar un Sistema Integrado de Gestión de Fronteras Exteriores. El fenómeno conocido como la Externalización de políticas y controles migratorios nos ocupa en el Bloque IV. Abordaremos las diferentes situaciones y propondremos catalogar como «desterritorialización» el conjunto de experiencias, normas y prácticas que se desarrollan más allá de la jurisdicción de los Estados y de la actuación exterior de la UE. Expondremos nuestra opinión sobre la conveniencia de diferenciar entre externalizar las políticas migratorias con terceros Estados, y la actuación extraterritorial de control migratorio fronterizo.

The refugee crisis has shaped a new perception of the migration reality in Europe. The ramifications of its impact on European integration are visible and enduring. The EU's response has included a certain strategic perspective, albeit weighed down by an excess of eurocentrism and a security perception that does not take third countries' interests into balanced account. The major economic effort being made supports a far-reaching strategy, only now beginning to be outlined, to promote economic evelopment in the countries of origin and transit of migrants. Additionally, issues such as the monitoring of respect for migrants' human rights have not yet been suitably globally defined in this strategy. Although the behaviour and response capacity of the EU and its Member States can be assessed in different ways, the truth is that the migration debate has decisively wayed a block of countries that are openly reluctant to engage in intra-European solidarity and accept the new realities and responsibilities entailed by the refugees already present and yet to come to Europe. This position is very negative in the medium and long term, since, as noted, the crisis has also underscored the permanence of migration trends and flows and the consolidation of the routes or gates of entry to Europe. This contribution considers the vulnerability of the European borders designed and in operation in the Schengen Area. The internal borders were the most affected at the start of the migration crisis and are likely to be marked by current regulatory changes, which tend to allow exceptionality as a relatively common occurrence in the European 'federal' area of free movement. Nevertheless, the resilience of this system of the absence of internal border controls in the 'federal' area of free movement is undeniable. The impact on the EU's external borders has been even greater, as it has shown once and for all that, more than fragile or vulnerable, some border controls, such as the sea border ones, are not practicable, especially those on Europe's southern sea borders. It is precisely this infeasibility of border control in marine areas that leads to the accentuation of certain trends on Europe's external borders, such as the externalization of migration controls. New regulatory and strategic planning developments confirm this trend, as well as the current concern for deploying an integrated external border management system. With regard to the phenomenon known as the 'externalization' of migration controls, the literature considers it to refer to EU actions aimed at reducing, sorting and controlling migration flows with the consent of third states in relations that are, by definition, asymmetrical. This article has addressed the different situations that arise, highlighting the advisability of differentiating between externalizing migration policy, on the one hand, and extraterritorial action concerning migration control, on the other. In search of greater conceptual accuracy, the term 'deterritoriality' has been used, as it is more neutral than the other terms mentioned insofar as it evokes the idea of positioning outside the territory certain border control and migration policy functions, to be carried out by other states or by the state itself. Since these are situations and actions linked to migration and border control, they should be conceptually situated outside the territory; the deterritoriality option hypothetically makes it possible to encompass both the externalization and the extraterritoriality of border control functions concerning migration. To this end, this article has focused on the various notions and activities that might be discussed in relation to the 'externalization' and the 'extraterritoriality' of migration controls and border functions, terms that, in sum, refer to migration control and management activities outside the territory, carried out by public officials of the EU states or by third states. On the one hand, externalization is considered to refer to the management and control of migration flows, the activities of adopting agreements, programmes, action plans and measures to encourage third states to monitor their own borders and migration flows in order to control, restrict or impede physical access to the territory of the EU states, accepting the placement in their territory, or the rejection, of refugees and migrants from other states. It does not involve the presence of or direct exercise of control activities by public officials of the EU Member States. In fact, outside European territory it is highly debatable that states are strictly performing border control unctions, as it is an area that may more accurately fall within the more generic field of migration flow control linked to migration policy and European external action. On the other hand, extraterritorialization is understood to entail the performance of border control functions by states themselves outside their own territory. This case should involve the presence of or exercise by Member State public officials of some (effective) border control activities or functions in areas without state jurisdiction or in the territory of third states, with their consent. We are witnessing a change in the very concept of border in this post-globalization era, in which certain functions are offshored and systematically placed outside a state's territory and checkpoints. However, territorial and extraterritorial actions must be differentiated from those occurring as part of external actions in or with third states for the purposes of migration policy and the control of migration flows. The reality is that a new border space south and east of the Mediterranean has been configured for migratory flows, which needs a new policy of external borders for these areas. Therefore, we must reflect on new frontier spaces, with new concepts and approaches to the border that provide other parameters of action towards migratory flows and external controls. Today, the Union needs new instruments and concepts for these new realities, especially so as not to lose sight of the fact that, when it comes to tackling crises such as those related to migration and the rights of foreigners approaching or entering its territory and jurisdiction, Europe is a rational construct entailing a project for civilizational progress. As such, it must permanently incorporate its values and respect for human rights in all its policies, regulatory measures and actions with foreigners and third states, both on its own external borders and beyond them. This is essential for the identity and objectives of the European integration, and for the projection of the EU security, solidarity and values in accordance with the International and European Human Rights Law.

La crisis con Gibraltar ha motivado una fuerte conflictividad por los controles de frontera exterior en la verja, en un contexto de búsqueda de un nuevo formato de negociación ad hoc entre las partes interesadas y de progresiva involucración institucional y normativa de la UE en ciertos aspectos de la controversia. ; La crisis del arrecife artificial en las aguas del istmo de Gibraltar, surgida en el verano de 2013, se ha prolongado durante 2014 originando nuevos frentes y ámbitos litigiosos en el marco de la controversia histórica. Particularmente importante ha sido la nueva controversia abierta por el reforzamiento español de los controles en la verja, que ha motivado denuncias y quejas a ambos lados del paso fronterizo. Precisamente esta disputa sobre controles fronterizos ha llevado a la intervención directa de la Comisión, que ha realizado visitas y emitido valoraciones y recomendaciones a los Estados. En realidad, la crisis ha llevado a una mayor conflictividad en un número cada vez mayor de ámbitos de Derecho de la UE, lo que ha desembocado en la involucración de esta organización internacional en la controversia. Los nuevos grupos ad hoc para el diálogo que reemplazarán al Foro de Dialogo tripartito acogen ya decididamente a la UE junto a autoridades locales y regionales. Esta involucración probablemente será permanente en este nuevo formato de dialogo flexible, que está limitado a la cooperación transfronteriza. Sin embargo, el marco de negociación bilateral de la controversia sobre soberanía ha quedado inoperante con la crisis, y sin perspectivas de revitalización. En este momento los ejes acordados en la transición democrática para el tratamiento de la cuestión gibraltareña parecen hoy inadaptados o superados, por lo que España debería aceptar que al encontrarnos en un nuevo período histórico, hay que acordar y articular nuevos ejes estratégicos para el tratamiento de la controversia histórica con el Reino Unido que redefinan y actualicen los intereses de España respecto a Gibraltar. ; The crisis of the artificial reef in the waters of the isthmus of Gibraltar, which arose in the summer of 2013, has continued throughout 2014, giving rise to new fronts and areas of litigation within the framework of the historical controversy. Particularly important has been the new controversy opened by the Spanish reinforcement of controls at the fence, which has led to denunciations and complaints on both sides of the border crossing. It is precisely this dispute over border controls that has led to the direct intervention of the Commission, which has carried out visits and issued assessments and recommendations to the States. In reality, the crisis has led to greater conflict in an increasing number of areas of EU law, which has led to the involvement of this international organisation in the controversy. The new ad hoc dialogue groups that will replace the Tripartite Dialogue Forum already welcome the EU together with local and regional authorities. This involvement will probably be permanent in this new format of flexible dialogue, which is limited to cross-border cooperation. However, the bilateral negotiating framework of the sovereignty controversy has been rendered inoperative by the crisis, with no prospect of revitalisation. At the moment, the axes agreed in the democratic transition for the treatment of the Gibraltar issue seem today to be unsuitable or outdated, so Spain should accept that as we find ourselves in a new historical period, new strategic axes for the treatment of the historical controversy must be agreed and articulated with the United Kingdom that redefine and update Spain's interests with respect to Gibraltar.
