From the Person to the Institution: Religious Freedom and Institutions in Democratic States
Based on the assumption that the fundamental rights of people in most democratic states are governed by the personalist principle and that, of course, the religious freedom of the individual is an indisputable fundamental right, this paper reflects on the implications of these premises in the institutional field. The article consists of four chapters: the first two chapters are of a more general nature, and the next two chapters apply the general principles to the Spanish context. The first part discusses the personalist foundation that forms the basis of laws in democratic states. The author highlights the fact that the ethical value of the dignity of every human person provides an axiological foundation for the rules and fundamental laws enacted in the democratic constitutional order. The second part of the paper is devoted to the principle of subsidiarity, which – in a way – constitutes a bridge that makes it possible to transpose the dignity of the person to the functioning of the institutions that operate within a democratic state. Subsidiarity is an essential complement to personalism as it prioritizes the activity of the person that should be supported by the institutions of the State. The application of these general principles to the situation in Spain exemplifies them in the context of the understanding and enforcement of the right to religious freedom. By presenting specific legal solutions implemented in Spain in recent years, the author illustrates the challenges that the right to religious freedom is facing in modern democracies. The paper offers a compelling study of the joint effect of the principle of secularism in a democratic State and the principle of cooperation between the State and religious institutions (a concept referred to in the Spanish model as "positive secularism") as they act upon social life to guarantee the implementation of a fundamental right of human persons: the right to religious freedom. ; Od osoby do instytucji: wolność religijna a instytucje w państwach demokratycznych Opierając się na założeniu, że podstawowe prawa człowieka w większości państw demokratycznych podlegają zasadzie personalistycznej i że oczywiście wolność religijna osoby jest niekwestionowanym prawem podstawowym, autor zastanawia się w niniejszym artykule nad implikacjami tych kwestii w przestrzeni instytucjonalnej. Artykuł składa się z następujących elementów: dwa pierwsze mają charakter ogólny, dwa kolejne są aplikacją zasad ogólnych do kontekstu hiszpańskiego. Część pierwsza ukazuje personalistyczny fundament stanowiący podstawę prawną w państwach demokratycznych. Autor naświetla, iż etyczna wartość godności każdej osoby ludzkiej jest aksjologiczną podstawą dla zasad i podstawowych praw ustanawianych w demokratycznym porządku konstytucyjnym. Druga część tekstu poświęcona jest analizie zasady pomocniczości - która jest swoistym mostem pozwalającym przejść od godności osoby do funkcjonowania instytucji działających w ramach demokratycznego państwa. Zasada pomocniczości stanowi konieczne uzupełnienie zasady personalizmu, nadając priorytet aktywności osoby, która winna być wspierana przez instytucje państwowe. Aplikacja tych ogólnych zasad do sytuacji w Hiszpanii stanowi ich egzemplifikację w kontekście rozumienia i egzekwowania prawa do wolności religijnej. Autor, ukazując konkretne rozwiązania prawne podjęte w Hiszpanii w ostatnich latach, ukazuje trudności, z jakimi musi się mierzyć we współczesnej demokracji prawo do wolności religijnej. To znakomite studium możliwości współoddziaływania na życie społeczne zasady laickości demokratycznego państwa oraz zasady współdziałania państwa z instytucjami religijnymi (w modelu hiszpańskim ta koincydencja nosi nazwę sekularyzmu pozytywnego) w celu zagwarantowania realizacji podstawowego prawa osób ludzkich, jakim jest prawo do wolności religijnej.

LA ESTRUCTURA FILOSÓFICA DE LA POSTMODERNIDAD POLÍTICO-JURÍDICA. UNA HERMENÉUTICA ESTRUCTURAL DE LA TEORÍA SISTÉMICA DE NIKLAS LUHMANN
The theory of systems formulated by the sociologist Niklas Luhmann is one of the most notable products theoretical from what has been called post-modernity. His great explanatory capacity makes it very interesting as a model for understanding the social, political and legal reality in the current complex. This work tries to interpret this theory from a structural perspective methodologically, that is, explaining the structure of thought on which rests from a hermeneutics that considers her analogical in relation with the Modernity, in order to understand it in the most philosophical field open as possible, the metaphysician, and in the most concrete of the sociological, political and juridical current theory. ; La teoría de sistemas formulada por el sociólogo Niklas Luhmann constituye uno de los más notables productos teóricos de lo que se ha venido en llamar la postmodernidad. Su gran capacidad explicativa la hace muy interesante como modelo de comprensión de lo social, lo político y lo jurídico en la compleja realidad actual. El presente trabajo pretende interpretar esta teoría desde una perspectiva metodológicamente estructural, esto es, explicitando la estructura de pensamiento sobre la que descansa desde una hermenéutica que la considera analógicamente en relación con la Modernidad, con el propósito de comprenderla en el ámbito filosófico más abierto posible, el metafísico, y en el más concreto de la teoría sociológica, política y jurídica actual.

LA ESTRUCTURA FILOSÓFICA DE LOS MODELOS PROCEDIMENTALISTAS DE JUSTICIA: LOS MODELOS DE 'ÉTICA DISCURSIVA' DE JÜRGEN HABERMAS Y DE KARL-OTTO APEL
This work tries to show the structural community that, from the philosophical point of view characteristic of hermeneutics indebted to the method of André de Muralt's structural analysis of thought, exists between the models of discursive ethics of fundamentation and explanation of politics (specifically of justice), expressed in Jürgen Habermas's theoretical postures and those of Karl-Otto Apel, and the modern contractual models. Ultimately, it seeks to show the close philosophical bonds existing between both in order to clarify the current philosophical-political and philosophical-legal discussion, where these models have a special strength, to verify finally that it is variations (more or less sophisticated) on the same theme, already shown in Modernity. ; Este trabajo trata de explicitar la comunidad estructural que, desde el punto de vista filosófico propio de una hermenéutica deudora del método de análisis de las estructuras de pensamiento desarrollado por André de Muralt, existe entre los modelos de ética discursiva de fundamentación y explicación de lo político (específicamente de lo justo), expresados en las posturas teóricas de Jürgen Habermas y de Karl-Otto Apel, y los modelos iusnaturalistas modernos. En última instancia, se pretende poner de manifiesto el estrecho vínculo filosófico existente entre ambos, con el objeto de clarificar la discusión filosófico-política y jurídica actual, donde estos modelos tienen una pujanza especial, para constatar finalmente que se trata de variaciones (más o menos sofisticadas) sobre un mismo tema, ya explicitado en la Modernidad.
