La sentenza sul caso Viola c. Italia dichiara per la prima volta l'ergastolo ostativo, di cui al combinato disposto degli artt. 22 cod. pen., 4-bise 58-terord. penit., incompatibile con l'art. 3 C.E.D.U. Ad avviso dei giudici di Strasburgo, i quali richiamano i precedenti esistenti sul punto al fine di conformarvisi, si tratta di una pena non sottoponibile a riesame, non riducibile e, di conseguenza, lesiva dell'art. 3 C.E.D.U., tanto sotto il profilo del divieto di pene e trattamenti inumani e degradanti, quanto sotto quello del necessario rispetto della dignità umana. La pronuncia in esame rappresenta sicuramente un consistente monito rivolto al legislatore italiano, per effetto del quale è ragionevolmente prevedibile, oltre che auspicabile, che si apra un processo di riforma della disciplina dell'ergastolo ostativo. ; The Viola c. Italia judgment declares, for the first time, the italian whole life imprisonment system, due to the conjuction of Articles 22 c.p., 4-bis and 58-ter ord. penit., not consistent with Article 3 of the Convention. According to the Strasbourg judges, who recall the previous case law in order to comply with it, this kind of punishment is not reviewable and not reducible, which means that it violates Article 3 of the Convention, both under the profile of the prohibition of inhuman or degrading treatment or punishment and under the one of the compulsory respect for human dignity. The decision surely gives a great warning to the italian lawmaker, so that it's reasonably predictable, as well as desirable, that a reform process is about to begin.
