Este artículo trata sobre el proceso de justicia de transición en Uruguay. De un modo didáctico, para facilitar el tratamiento del tema, se divide este proceso en etapas según tres modelos teóricos de intervención para la solución del conflicto que ocasiona la reacción contra los crímenes cometidos durante la dictadura cívico-militar. El proceso de justicia de transición en Uruguay es un problema abierto que aun enfrenta a algunos actores del conflicto y presenta problemas jurídicos que no habían sido abordados por el sistema político y jurídico. Dicho proceso refleja la contradicción a nivel local entre el resultado del ejercicio de soberanía popular y el análisis constitucional llevado a cabo por el máximo órgano de justicia, que ha motivado la discusión parlamentaria sobre la necesidad de derogar o dejar sin efectos jurídicos a la ley de caducidad de la pretensión punitiva del Estado, muy a pesar de la voluntad de la mayoría de la población. El problema se vuelve más complejo con las recientes sentencias de la Suprema Corte de Justicia que han declarado a dicha ley contraria a la Constitución y con la primera sentencia de condena contra el Uruguay emitida en 2011 por la Corte Interamericana de Derechos Humanos, que obliga a la eliminación de aquella ley del ordenamiento jurídico nacional. Este mandato supranacional refleja también la contradicción entre la solución local y la solución global, cuando se trata de la protección de los derechos humanos. El artículo plantea los problemas actuales que sufre el proceso uruguayo de justicia de transición considerado como un problema abierto.This article verses on the Justice Transition Process in Uruguay. For the better understanding of this matter a didactic approach is followed. Within such framework, the mentioned process is divided in to three stages according to three different theoretical models of intervention aimed at the resolution of the conflict provoked by the reaction against the crimes committed during the civicmilitary dictatorship. Uruguay's Justice Transition Process is still an open problem that generates conflict among its actors and presents legal challenges that have not yet been dealt with by the legal and political system. At a local level, this process reflects a contradiction that arises from the result of popular sovereignty as compared to the constitutional analysis carried out by the highest judicial organ in Uruguay. This contradiction has led to a parliament discussion as to weather is it necessary to abolish or withdraw the effects of the Expiration of the State Punitive Pretensions Law, despite the fact that the majority of the population is against such initiative. The problem has become more complex due to the following factors: the Supreme Court has recently deemed the mention law as unconstitutional and on 2011, for the first time, the Human Rights InterAmerican Court has imposed upon Uruguay the obligation of withdrawing such law from its national legal system. Again, this international command reveals the contradiction between the local and the global solution in relation to Human Rights protection.
Abstract. This article discusses the process of transitional justice in Uruguay. In a didactic manner to facilitate treatment of the subject this process is divided into stages according to three theoretical models of intervention to resolve the conflict that causes a reaction to the crimes commited during the civil-military dictatorship. The transitional justice process in Uruguay is an unresolved problem that still confronts some actors in the conflict and presents legal problems which were not addressed by the political and legal system. This process reflects a contradiction at a local level between the outcomeof the exercise of popular sovereignty and the constitutional analysis conducted by the highest body of justice, which has led to a parliamentary debate on the need to repeal or render null and void the Amnesty Law of the punitive claim by the State, in spite of thewill of the majority of the population. The problem becomes more complex with recent decisions by the Supreme Court of Justice which have declared such law to be contrary to the Constituion and with the first sentence of condemnation againt Uruguay issued in 2011 by the Inter-American Court of Human Rights, which requires the removal of such law from the national codes of law. This supranational court order also reflects a contradiction between the local solution and the global solution, when it involves the protection of human rights, The article discusses the unresolved problems experienced by the Uruguayan process of transitional justice considered as an open problem. ; Resumen. Este informe tiene como objetivo responder a dos preguntas: ¿Uruguay está obligado a cumplir con las decisiones y resoluciones de los principales órganos interamericanos de protección de los derechos humanos?, y ¿en qué argumentos jurídicos se fundamenta dicho cumplimiento? El análisis de esta cuestión comprende la recepción y ejecución por parte de las autoridades nacionales de las decisiones interamericanas que incumben al Estado uruguayo en materia de responsabilidad por violaciones a la Convención Americana de Derechos Humanos (cadh). El informe no pretende responder a la pregunta de sobre si la jurisprudencia uruguaya se adhiere a los fundamentos o razones del Sistema Interamericano de protección de los Derechos Humanos, sino a otra cuestión específica: ¿la decisión misma ha sido cumplida o desatendida por el Estado uruguayo? Todo el análisis se lleva a cabo con una mirada crítica en relación con algunas exigencias de la Corte Interamericana de Derechos Humanos (cidh) referidas a cuestiones de derecho penal y de los derechos materiales y formales de los justiciables. ; This report aims to answer two questions: Is Uruguay obliged to comply with the decisions and resolutions of the major Inter-American bodies for the protection of human rights? And on what legal arguments is such compliance based? The analysis of this matter involves the reception and implementation by national authorities of Inter-American decisions concerning the Uruguayan government liability for violations of the American Convention on Human Rights (ACHR). The report does not intend to answer the question of whether Uruguayan law adheres to the grounds or reasons of the Inter-American system of human rights protection, but it does address another specific question: Has the decision itself been met or neglected by the Uruguayan government? The analysis is carried out with a critical perspective on some requirements of the Commission regarding issues of criminal law, and the formal and material rights of individuals.
Este artículo se ocupa de la jurisprudencia de la Corte Interamericana de Derechos Humanos referida al derecho a la verdad que tiene la víctima individual y colectiva y su relación con el proceso penal, especialmente cuando se trata de crímenes de lesa humanidad. Se presenta someramente la evolución del derecho a la verdad en el ámbito interamericano y en los organismos internacionales y se analiza críticamente si estamos frente a un derecho de la víctima de conocer la verdad o frente a una obligación del Estado de investigar y sancionar. El trabajo se concentra en la relación entre el derecho de la víctima a la verdad y el crimen de desaparición forzada, y pretende responder a la pregunta de si el procedimiento penal es el mecanismo adecuado para esclarecer la verdad cuando se trata de la justicia de transición, cuyas exigencias de justicia, verdad y reparación tienen que ser satisfechas considerando aspectos jurídicos y políticos que permitan la mejor reacción a los crímenes contra los derechos humanos y no impidan la elaboración del pasado. ; This article deals with the case law of the Inter-American Court of Human Rights with respect to individual and collective victims' right to the truth and its relation to criminal proceedings, particularly in the case of crimes against humanity. It briefly presents the evolution of the right to the truth in the Inter-American sphere and in international organizations and offers a discussion of whether this is in fact the victim's right to know the truth or the State's duty to investigate and punish. The work focuses on the relation between the victim's right to the truth and the crime of forced disappearance, and attempts to establish if a criminal proceeding is the adequate mechanism for shedding light upon the truth in cases of transitional justice. Such processes involve providing justice, truth and reparations while considering the legal and political aspects for a response to crimes against humanity which does not preclude coming to terms with the past.
El artículo trata de la situación actual de una política criminal que procura medios menos formales para la resolución de los conflictos penales. Para lograr este objetivo «desformalizador» el legislador portugués da ingreso a la mediación dentro de la sistemática penal como un medio alternativo al procedimiento penal. Este ingreso de la mediación en el sistema penal no está exento de problemas. En este artículo se analiza comparativamente si la mediación corresponde a una institución típica del common law o, por el contrario, se asienta en las raíces de un derecho continental, así como si la mediación debe interpretarse con la óptica de la justicia restauradora o de la justicia tradicional. En segundo lugar se debate la necesidad de dar ingreso a la mediación en el sistema penal, cuando ésta cumpliría una función similar a la del instituto de la «suspensión condicional del proceso». Por último, se menciona el peligro de construir un sistema para la resolución de los conflictos penales que prescinde de los jueces, cuya función es asumida por el representante del Ministerio Público ; The present article focus on criminal politics which are currently looking for alternatives methods for the resolution of criminal conflicts. The criminal system in Portugal advocates recently for the use of mediation to deal with criminal offences. In a comparative way this article refers to the institute of mediation regarding to the common and continental law criminal systems. It analyses the mediation regarding to principles of restorative justice and the main characteristics of the traditional justice. In conclusion this work advises to pay more attention at the risk of building a criminal system without judges
En este artículo se analiza la posibilidad que brinda el parágrafo 153a.1 del StPO (Código del Proceso Penal alemán) de ejercer la discrecionalidad, sustituyendo la acción penal tradicional por la imposición de obligaciones, condiciones o instrucciones, así como la modalidad prevista en el parágrafo 153a.2 del StPO que permite suspender provisoriamente el procedimiento penal a cambio del cumplimiento de obligaciones, condiciones o instrucciones que, una vez satisfechas, excluyen la punibilidad. La norma en cuestión indica, de forma taxativa, las cargas que pueden ser impuestas para que se efectivice, con el consentimiento del supuesto autor, la suspensión del proceso. De todas las posibles obligaciones, condiciones o instrucciones que ofrece el legislador, me refiero exclusivamente a la figura de la reparación que, en mi opinión, cumple una función de «equivalente funcional de la pena». El análisis del tema se realiza ofreciendo, por una parte, los aciertos y errores político-criminales del parágrafo 153a del St- PO y, por otra, señalando los errores y aciertos de este tipo de normas procesales a partir de una perspectiva dogmática y de derecho material. El artículo niega la reparación como una tercera vía de reacción punitiva atendida la actual discusión dogmática en torno a su fundamentación ; Die Arbeit untersucht die Möglichkeit zum Ermessensgebrauch gem. § 153 a Abs. 1 St- PO. Unter der Voraussetzung der Erfüllung von Auflagen und Weisungen wird hier das herkömmliche Strafverfahren eingestellt. Ferner analysiert vorliegender Artikel die vorläufige Einstellung des Strafverfahrens unter Erteilung von Auflagen und Weisungen gem. § 153 a Abs. 2 StPO, wobei deren Erfüllung die strafrechtliche Verfolgbarkeit ausschließt. In § 153 a StPO sind die Verpflichtungen, die dem Tatverdächtigen auferlegt werden können, abschließend aufgeführt. Dessen Zustimmung ist Voraussetzung für die Einstellung des Verfahrens. Der Artikel behandelt lediglich die Figur der Wiedergutmachung als eine der gesetzlich vorgesehenen Auflagen und Weisungen, die nach Ansicht des Autors eine der Strafe gleichstehende» Aufgabe erfüllt. Este aporte tiene como base un amicus curiae en una causa judicial en la República del Perú sobre la fundamental relación de dos principios constitucionales elementales en el Derecho Penal: la contradicción entre el derecho al honor de los funcionarios públicos y el derecho a la libre expresión de los ciudadanos. El análisis de derecho se realiza según el sistema penal alemán como aporte a la discusión doctrinaria peruana y colaboración con la judicatura peruana en la búsqueda de los mejores argumentos. ; This contribution is based on an amicus curiae regarding a criminal case in the Republic of Peru about the fundamental relation of two elementary constitutional principles in the Penal Law: the contradiction between the right to be respected in one's social standing (honor) on the one side and the right to freedom of expression on the other. The legal analysis is conducted according to the German penal system, aiming at contributing to the Peruvian legal doctrine and collaborating with the Peruvian judiciary in the search of the best legal arguments.
