?Die Regulierung der Ratingagenturen? von Nina Ganglbauer behandelt die Regulierung des Ratingsektors durch die VO (EG) Nr. 1060/2009 aus verfahrensrechtlicher Perspektive.Der verfahrensrechtliche Regulierungsrahmen der RatingVO wird näher dargestellt und bzgl Effektivität und Effizienz bewertet. In ausführlicher Problemanalyse werden Defizite aufgezeigt und Lösungsansätze erarbeitet. Dazu werden Rechtsakte vergleichbarer Refernzgebiete und allgemeine Grundsätze des Europa- und Verwaltungsrechts herangezogen und eine Einordnung in ein Vollzugskonzept der europäischen Mehrebenenverwaltung vorgenommen.Die RatingVO ist im Wesentlichen am Transnationalitätsmodell (TNM) orientiert. Das TNM soll eine einheitliche Rechtslage schaffen. Rechtmäßigkeitsmaßstab des TVwA ist primär das Europarecht, sekundär das europarechtlich überformte Verwaltungsrecht des Herkunfts-MS (HMS).Dem TNM inhärent sind Probleme des Rechtsschutzes, der Staatshaftung und der demokratischen Legitimation gegenüber drittbetroffenen Unionsbürgern. Die RatingVO ist hier mangelhaft, da sich Rechtsschutz uä nur am Recht des HMS orientieren, was rechtsstaatlich bedenklich ist. Es bleibt die Forderung nach einem Europäischem Staatshaftungs- und Verwaltungsverfahrensrecht, bzgl der unklaren Fehlerfolgen, nach einem verbindlichen europäischen Divergenzbereinigungsverfahren.Das Zusammenspiel der drei Akteure (CESR, Kollegium und Aufsichtsbehörden) wird anhand der Verfahren der RatingVO dargestellt. Das Kooperationsmodell führt durch unklare Kompetenzen und hohen Abstimmungsbedarf zu einem schwerfälligen, ineffizienten Verfahren.CRA beeinflussen das öffentliche Schutzgut der Finanzmarktstabilität massiv. Eine rechtsverbindliche Regulierung ist nötig. Warum setzt die RatingVO auf private Unionsverwaltung? Die EU versucht dadurch insb eine genuine europäische Vw-Struktur zu schaffen.Die Defizite der RatingVO könnte die geplante RatingÄVO beseitigen. Legal acts of similar reference fields and general principles of European and administrative law are used to develop solutions and to carry out an assignment to a law enforcement concept of European multi-level governance.The RatingVO is mainly based on the transnationality model (TNM). Through the unclear competences and the high demand for acclamation, the cooperation procedure seems quite cumbersome and inefficient. CRA exert significant influence on the financial stability, which is of public interest. A legally binding regulation is required. Why does the RatingVO relies on private administration of Union interests? The EU hopes to create a genuine European administration structure.The deficit in the RatingVO could be eliminated by the intended RatingÄVO.
