Deliberative democracy is a normative ideal of democracy. This model is a proposal for the regeneration of the legitimacy of our institutions, but also a mechanism for decision making. It is based on two different dimensions: a procedural dimension where the model demands the inclusion and an equal capacity to influence the final decision of all those affected (Cohen, 1989; Bohman, 1996; Habermas, 1992 .) and a substantive dimension where the political decisions are made through a collective procedure of argumentation and public discussion. If these conditions are recognized, the decisions will be more rational and better decisions. This paper has two aims. First I will present the key elements of this epistemic conception of political legitimacy. Second I will show the challenges it faces. La madrugada del 13 de septiembre de 1923, Miguel Primo de Rivera cumplió su ultimátum al rey y al Gobierno, y declaró el estado de guerra en Barcelona. Al amanecer, su golpe de Estado había vencido y Alfonso XIII había fracasado en su tentativa de encauzar el acto de fuerza por vías constitucionales. Durante la actual pandemia de SARSCoV-2 distintas voces han coincidido en el uso de términos y expresiones de carácter bélico. Pero… ¿Hablamos de una anécdota o acaso hay algún tipo de motivación que explique el uso de esta lógica marcial a la hora de referirse a una crisis sanitaria? Y, si así fuese, ¿es nuevo este fenómeno?
Para responder a estas cuestiones proponemos el estudio de la polifacética (y polémica) figura del periodista y crítico artístico Eugenio Noel (1885-1936). Un autor gracias al cual podremos ver cómo los discursos higienistas del siglo XIX y XX hicieron uso de un lenguaje médico en el que abundaban las referencias militares y autoritarias, así como la influencia decisiva que tuvieron estas mismas ideas en el devenir del mundo artístico europeo del siglo XX (especialmente en lo que se refiere a la aparición de estilos como la pintura y escultura fascistas).
Esta revisión del pasado nos permitirá hacer un ejercicio de memoria, que nos ayude a entender nuestro presente más inmediato e interrogarnos sobre nuestra responsabilidad como investigadores y artistas.

Throughout the current SARS-CoV-2 pandemic, different voices have insisted on the use of terms and expressions with a military origin. But. Are we talking about an anecdote or is there some kind of justification that explains the use of this military logic while referring to a health crisis? And, if that was the case, is this something new? In order to answer these questions we propose the study of the multi-faceted (and polemical) figure of the journalist and art critic Eugenio Noel (1885-1936). An author through whom we can see how the hygienist discourses from the 19th and 20th century used a medical language in which abounded war and authoritarian references. Furthermore, we can also see the decisive influence that these same ideas had on the development of the European artistic world in the 20th century (especially in relation to the appearance of styles such as the fascist painting and sculpture). Este artículo investiga las elecciones al Congreso de los Diputados de 1923. Celebradas bajo el Gobierno de la concentración liberal, fueron las últimas con la ley electoral de 1907 y el último intento de reconstruir el turno de partidos. Por ello, la historiografía las considera demostrativas de un estancamiento del comportamiento electoral de la Restauración, anclado en la desmovilización y el falseamiento de los resultados. El aparato empírico de este artículo, sostenido en el uso intensivo de las fuentes parlamentarias, gubernativas y hemerográficas, permitirá evaluar hasta qué punto el marco de competencia vigente en 1923 continuaba propiciando las distorsiones mencionadas. También si hubo cambios relevantes en el comportamiento del voto susceptibles de redefinir la función de las elecciones en aquella Monarquía constitucional. Este análisis y la comparación con otros comicios coetáneos constatan que los de 1923 presentaron un comportamiento marcadamente transicional, donde la apatía y el fraude no fundamentaban ya los alineamientos del voto o las mayorías parlamentarias. ; This article researches the elections to the Congress of Deputies of 1923. Held under the government of the concentración liberal, they were the last ones with the electoral law of 1907 and a last attempt to reconstruct the Spanish turno of parties. For this, the historiography considers them demonstrative of the stagnation of the electoral behavior of the Restoration, anchored in the demobilization and falsification of the results. The new data of this article, coming from parliamentary, governmental and newspaper sources, will allow to evaluate if the competition framework of 1923 continued propitiating the aforementioned distortions. Also, if there were relevant changes capable of redefining the role of elections in Spanish Restoration. This analysis and the comparison with other contemporary elections show that those of 1923 advanced a transitional behavior, where apathy and fraud didn´t explained the voter alignments, nor the parliamentary majorities.
