La consolidación del concepto positivista de "peligrosidad social" sustanciaría lo que determinados juristas denominan como "fraude de las etiquetas" en el circuito penal español en el siglo XX. Este proceso afectó singularmente a la población gitana debido al éxito de la explicación étnica de algunos tipos de criminalidad. Este trabajo, a partir de la exploración de los fondos documentales sobre la "cuestión gitana" custodiados en el Archivo General del Ministerio del Interior, tiene un doble objetivo: (1) el primero y más general, contribuir a generar conocimiento sobre la problematización pública de la "cuestión gitana" en España, tomando como referencia el circuito disciplinario que, llamativamente pese a la importante presencia del colectivo, no ha recibido la suficiente atención por parte de la historiografía española; (2) el segundo y más concreto, analizar su tratamiento policial tanto en las diligencias como en la documentación interna producida por las fuerzas y cuerpos de seguridad del Estado durante la primera andadura democrática. ; The success of the positivist legal concept of "social dangerousness" would entail practices of what certain jurists called "fraudulent labeling" within the Spanish criminal circuit in the twentieth century. Este trabajo se aproxima a la denominada «cuestión gitana» en España, tomando como referencia los estudios existentes de las estrategias coercitivas que sobre este grupo minoritario se han desarrollado en Europa en los siglos xix y xx. En primer lugar, se introducirá el estado actual de conocimientos para otros casos nacionales, con el propósito de dotar de contexto a una propuesta de estudio sobre el tema desde la aplicación del llamado «derecho de culpables», reforzado en el penalismo español por la introducción de la noción de «peligrosidad social». En concreto, partiendo de la existencia de regulación específica sobre el «gitano» durante el periodo de la Restauración, se explorará la coyuntura de entreguerras, con la adaptación republicana de instrumentos de control y resocialización mediante la Ley de Vagos y Maleantes de 1933, y al primer franquismo con la intensificación de la estigmatización penal de determinadas situaciones sociales atribuidas a este colectivo. Para ello, se analizarán textos legales, noticias de su aplicación en prensa, expedientes procesales y publicaciones técnicas producidas en el circuito judicial y penitenciario español en ese amplio arco temporal. ; This work approaches to the "Gypsy Question" in Spain with reference to available studies on coercive measures against this minority group undertaken in Europe throughout the xixth and XXth centuries. This article deals with the implementation of British blacklists in Spain, leading to a case study not widely seen before in the international historiography of the First World War. It shows how British intervention in the southern and eastern Spanish markets set a de facto model for the operation of the embargo system. Under the strong stimulus of economic nationalism, the British actions regarding the commercial vetoes were tested against Spanish local interests during the short war (1914–15). The initiative was supposedly fuelled by a sense of revenge against pre-war Germany's commercial progress as well as the desire to control a very appetizing market share, for the British and French alike. In a climate of inter-Allied commercial rivalry, this study focuses on the key role played by members of the consular service. It explains the spurious motivations that in many cases underlay the practical implementation of the blockade from below, and analyses how partisan procedures which lacked homogenized and clarified criteria for collecting and applying commercial intelligence challenged British strategies and the inter-Allied united front in Spain until well into 1917.

Despite being separated by thousands of miles and shaped by distinctive national histories, the countries of Spain, Italy, and Argentina were intertwined in a variety of ways during the first half of the twentieth century. This collection brings scholars from each nation into conversation with one another to trace these complex historical connections over the period of the two World Wars. Deploying "Latinity" as a novel analytical framework, it gives a broad and dynamic perspective on cases of reciprocal exchange that include the influence of Italian Socialism on Hispanophone leftists; the roots of Argentine liberalism in Machiavelli and Spanish Nationalist thinkers; and the web of connections among Italian Fascism, Argentine Nacionalismo, and Spanish Francoism
