In the aftermath of mass conflict how is it possible to address violent and traumatic pasts, reconcile divided nations, and strengthen state institutions? This study explores the connections between transitional justice and visual art in order to answer that question. Garnsey argues that art can engage and shape ideas of justice. Art can be an inquiry into, and an alternative experience of, justice. Art embeds justice on different political levels - both local and global. Art becomes a radical form of political participation in times of transition. Arising out of extensive fieldwork at the Constitutional Court of South Africa and the South Africa Pavilion at the Venice Biennale, which included 130 interviews with key decision makers, the book provides the first substantive theoretical framework for understanding transitional justice and visual art, and develops novel conceptions of visual jurisprudence and cultural diplomacy as forms of transitional justice.

Abstract
Thinking about artistic representation as a form of political representation enables a better understanding of what can be seen and said, who has the ability to see it and say it, and how it is possible to know and do politics in different ways. In the case of Australia's immigration system, this understanding is critical. Australia's treatment of people seeking asylum and refugees is widely criticised by the international community as violating international human rights and humanitarian laws and norms. The legal and bureaucratic frameworks surrounding refugees in Australia not only render their stories largely invisible but continue to perpetrate harm and suffering which goes unaddressed. In the absence of state protection, artistic representation becomes an important intervention into the practices and narratives surrounding Australia's treatment of people seeking asylum and refugees. In this article, I explore Hoda Afshar's video and photographic artwork Remain (2018) which documents the experiences and struggles of a group of stateless men who were left to languish on Manus Island, Papua New Guinea, in the aftermath of the Australian government closing its Manus Regional Processing Centre. Remain is one of the only available avenues open to the men to share their stories and to communicate the harm caused by national policy and practices. I argue that the artistic representation of Remain becomes a crucial form of political representation in this aftermath; political representation which would not otherwise be possible.

The South African Constitution affirms "the democratic values of human dignity, equality and freedom". The Constitutional Court in Johannesburg was established as a key institution in South Africa's new democracy. Built on the site of a former prison, the Court is not only distinctive architecturally including integrated artworks in the fabric of the building, it is a unique space by international comparison because it houses a large visual art collection developed by and for the Court—the core theme of which is respect for human dignity. Drawing on six months fieldwork at the Constitutional Court—which included fifty-four interviews with judges, staff, artists, advocates, and visitors to the Court—this paper examines the connections between human dignity and art at the Court. The aim is to investigate whether the realisation of human dignity by the Court, is disconnected from the aesthetics of the art collection. Is the performance of dignity in the art collection a utopian ideal, achievable objective, or unrealised potential? The art collection is a kind of visual jurisprudence which responds to, but also comprises, conceptions of human dignity as a right, a value and a touchstone of democracy—conceptions which are closely entwined with South Africa's human rights governance, but that manifest in very different ways. The collection envisages the journey to human dignity as ongoing; it is promised but remains ungraspable. In this way, the Court is simultaneously a 'good place'—a site constituting human dignity—and a 'no place', a prospect yet to be realised—a sight of human dignity. This tension is important in calibrating an idea of human dignity within a transitioning human rights discourse in South Africa.
