Material differences between the project of a constitutional pact & the idea of a constitutional charter for the European Union clearly indicate that the same semantic reference -- constitutionalization -- can conceal different & sometimes opposing realities. One project regroups the fundamental principles of the treaties into a constitutional body. This could represent a preliminary part to the Union Treaty or a codification in the material sense, destined to enhance the intelligibility of the treaties. The second approach seems to raise the process of simplification & codification of the treaties, whose perspectives have been revised downward as a result of the prior negotiations of the Treaty of Amsterdam. There are constant pitfalls. Either one proceeds to a codification in the material sense where the final product has no judicial value, or one proceeds with a codification in the formal sense, where the final product has to be submitted for ratification to each state with the risk of reopening debates regarding the collective acceptance of the original law.
