A differenza di molti altri comuni d'Italia Roma non si è dotata di un disciplinare che permetta ai cittadini di prendersi cura dei beni comuni. Ciò non impedisce di rintracciare sul territorio tante esperienze di natura civica che ugualmente permettono ai cittadini di dare un contributo al miglioramento della qualità della vita urbana, ma tutto ciò avviene in assenza di una regia complessiva. Si assiste così a tante sperimentazioni di ordine diverso, alcune che restano limitate al piano sociale, altre che provano a stabilire connessioni di riconoscimento pubblico o limitate ad alcuni settori specifici, come quelli del verde urbano. Esiste una difficoltà significativa dell'apparato amministrativo a comprendere questi fenomeni, ma in fondo vi è anche l'incapacità del ceto politico di esprimere un indirizzo politico che investa davvero in questo senso.
Nowadays the urban regeneration is the main tool through which the Italian Regions strive for the limitation of land consumption. This new objective for planning is not only a way of balancing different general interests, but it is becoming a benchmark for social, economic, and cultural interests too. The essay examines the concrete samples of the urban regeneration in Italy by comparing those coming from the Regional legislators with the ones based on civic initiatives. The author underlines both positive aspects and negative sides of them both. At the end, nevertheless, the Author tries to draw a more general conclusion, by arguing the environmental sustainability is a comprehensive curb even beyond the normative provisions. That way he considers that environmental sustainability is the main driver for territorial policies.
Tra i fini della legge istitutiva del servizio sanitario nazionale del 1978 si trova quello di curare la prevenzione e correggere gli squilibri socio-sanitari. Le politiche pubbliche sanitarie degli ultimi trent'anni hanno perseguito obiettivi diversi, con il risultato che l'assistenza sanitaria territoriale e i servizi di base mostrano carenze evidenti, che hanno prodotto nuove diseguaglianze. La pandemia ha rappresentato l'occasione per adottare misure organizzative dal centro in controtendenza che sembravano oramai impensabili, ma rimane incerto se questo cambiamento resisterà dopo l'emergenza. ; Prevention and correcting socio-health imbalances are important targets of the law establishing the Italian health service in 1978. However the public health policies of the last thirty years have pursued different objectives, with the result that local health care and basic services show shortcomings, which have given rise to new inequalities. The pandemic was an opportunity to adopt measures in countertrend from the centre the now seemed unthinkable, but it remains uncertain whether this change will last after the emergency.
Il processo di "normalizzazione" della gestione delle emergenze perseguito in Italia è sfidato all'occorrenza di eventi calamitosi, quando la necessità di fronteggiare gravi calamità induce il legislatore ad approntare misure ad hoc di natura amministrativa che finiscono per sovrapporsi con le ordinarie responsabilità delineate dal legislatore. Questo scritto, prendendo spunto da un evento specifico, quello della scia sismica che sconvolto l'Italia centrale tra il 2016 e il 2017, verifica nel concreto la reazione dei poteri pubblici, mettendo in evidenza la sovrapposizione tra due modelli di amministrazione che riflettono un'accezione diversa della funzione dell'emergenza. L'a. ritiene che questa sovrapposizione, definita in base a una supposta e chiara distinzione tra le funzioni di soccorso e le funzioni di ricostruzione, profila numerosi problemi sia in termini di legittimazione sia in termini di efficacia dell'azione pubblica. Eppure, questa condizione non provoca un reale conflitto tra poteri, tanto da supporre che la reazione così definita sia in realtà il frutto di un "concordato delle burocrazie". ; The process of 'normalisation' of the management of emergencies carried out in Italy is challenged following the occurrence of disastrous events, when the need to face serious calamities induces the legislator to prepare ad hoc measures of an administrative nature which end up overlapping with the ordinary responsibilities outlined by the legislator. This paper, drawing on a specific event - that of the series of earthquakes that shook central Italy between 2016 and 2017 - verifies the reaction of public authorities in concrete terms, highlighting the overlapping between two models of administration that reflect a different acceptation of the function of emergency management. The author believes that this overlapping, defined on the basis of a supposed and clear distinction between the functions of aid and reconstruction, presents a range of problems, both in terms of legitimisation and in terms of efficacy of public action. And yet this condition does not provoke a real conflict between powers, to the point of supposing that the reaction thus defined is in actual fact the upshot of an 'agreement between bureaucracies'.
