Quand on parle de l'Etat, c'est plus pour dire ce qu'il fait, les politiques publiques qu'il met en oeuvre, que ce qu'il est. L'Etat nous est ou nous semble familier. Nous n'éprouvons pas le besoin de nous poser les questions : qu'est-ce que l'Etat, d'où vient-il ? Nous avons au moins deux bonnes raisons pour ne pas nous poser ces questions. L'une est « l'amnésie de la genèse » de toute institution réussie, nous dit le sociologue Pierre Bourdieu. Une institution est réussie lorsqu'elle a réussi à s'imposer comme allant de soi, à faire oublier sa genèse. L'institution réussie fait oublier qu'elle a eu une naissance, un commencement. Elle existe. C'est ainsi, c'est comme çà. On ne se pose pas de questions sur ses origines. C'est le cas pour l'Etat, qui a été institutionnalisé. Une autre raison est que l'Etat, ce qu'il est, n'est pas enseigné. Ce sont les questions de gestion, de management qui ont monopolisé l'attention, mais la réflexion évolue. Il y a une abondante littérature sur l'Etat, émanant de juristes, sociologues, philosophes, économistes, historiens. Pierre Rosanvallon, en annexe à son livre « L'Etat en France entre 1789 et nos jours », publié en 1990, présentait sur le thème de l'Etat une bibliographie de près de 2000 titres et depuis cette date de nombreux ouvrages ont été publiés. Récemment le directeur de l'Ecole nationale d'administration écrivait ceci : « L'ENA doit d'abord être une école où, au-delà du management, sont enseignés l'Etat, le rôle de l'Etat, le sens de l'Etat » Les réformes de l'Etat, de ses missions, de son organisation, doivent être préparées par une réflexion sur ce qu'est l'Etat. C'est dans ce but qu'a été organisé par le Conseil d'Etat de 2013 à 2015 un cycle de conférences sur le thème « Où va l'Etat ? », avec une première conférence sur le concept d'Etat, l'Etat comme objet de philosophie politique et comme construction historique. C'est la question : qu'est-ce que l'Etat ? Dans son discours introductif à ce cycle de conférences, le Vice-président du Conseil d'Etat, Jean- Marc Sauvé, rapporte une anecdote significative sur l'importance de la philosophie de l'Etat. Une délégation des élèves de l'Ecole nationale d'administration rend visite en 1976 à notre célèbre écrivain et ancien ministre André Malraux. Les élèves lui présentent les divers enseignements suivis à l'Ecole. C'est alors qu'André Malraux s'esclaffe « Mais enfin vous préparez un diplôme de technicien. Ce qu'il faut enseigner à l'ENA , ce sont des cours sur la problématique et la philosophie de l'Etat » Il y a des définitions bien connues de l'Etat. Une première définition nous a été donnée par les juristes allemands et français à la fin du 19ème siècle « L'Etat est la nation juridiquement organisée » Dans une version plus moderne, on parle de l'Etat comme de « la société juridiquement organisée » En effet la Nation n'a pas toujours précédé l'Etat. Par exemple en France, c'est l'Etat qui a produit, construit la Nation. Il y a aussi cette autre définition classique des juristes. L'Etat, c'est un territoire, une population, une autorité souveraine et on ajoute parfois un quatrième critère, la reconnaissance en tant qu'Etat par la communauté internationale. Mais l'Etat, est-ce cela ? ou plutôt n'est-ce que cela ? ; Svaka rasprava o ideji države nadilazi okvire državne aktivnosti. Ako je to slučaj, onda se mora voditi računa o javnim politikama koje država proizvodi. Autor naglašava da postoji nekoliko razloga zašto često nema potrebe postavljati pitanja o tome što je i odakle potječe država? Mišljenje sociologa Pierrea Bourdieua dano je kao jedan od razloga. Naglašava se "amnezija geneze" svake uspješne institucije. Naime, prema mišljenju P. Bourdieua, institucija je uspješna kada se uspije nametnuti kao očigledna i time ne postavlja pitanje njezina podrijetla. Institucionalizirano stanje jednostavno postoji. Državna reforma, njezine misije i organizacija moraju se namjerno pripremati prema onome što čini državu. Imajući to u vidu, Državno vijeće je od 2013. do 2015. godine organiziralo nekoliko konferencija na temu: "Gdje je država?" O tome se govori i u ovomwe tekstu. Nadalje, autor postavlja pitanje o nastanku samog pojma: kada, gdje, tko, kako, zašto? Kako je stvoren koncept države? Što su, prema mišljenju odvjetnika, glavne značajke države? U svjim odgovorima autor naglašava da je država kontinuirana tvorevina. ; When the idea of state is discussed, that discussion exceeds the framework of state activity. Présenter la propriété publique sous l'angle de la délimitation des biens peut paraître réducteur pour un sujet qui a, pendant deux siècles, donné lieu à de grands débats doctrinaux. En conclusion, on constate que le bornage a toujours eu une place dans la délimitation des choses ou des biens relevant du domaine public. Le concept même de domaine public a évolué dans le temps, s'est diversifié. Différentes procédures de délimitation par acte administratif, différentes procédures de bornage ont été instituées pour prendre en compte cette diversité. En l'absence d'une législation spéciale organisant la délimitation de dépendances du domaine public artificiel par rapport aux propriétés privées contiguës- et c'est le cas pour de nombreux biens publics affectés à des services publics- la personne publique a la faculté d'exercer, comme tout propriétaire, son droit de bornage amiable pour fixer la limite séparative entre sa propriété et les propriétés privées riveraines. U predmetnom radu važno je napomenuti kako ograničenje uvijek ima mjesto u određivanju stvari ili imovine u javnoj domeni. Sam pojam javne domene razvio se tijekom vremena i pritom je raznoliko definiran. Razlikuju se razni postupci razgraničenja određeni upravnim aktom, uspostavljeni su različiti posebni (granični) postupci kako bi se uzela u obzir sva različitost. U nedostatku posebnog zakonodavstva kojim se uređuje ograničavanje ovisnosti javnih domena u vezi s neprekinutom privatnom imovinom - a to je slučaj kod mnogih javnih dobara dodijeljenih javnim službama - javna osoba ima pravo, kao i svaki vlasnik, njegovo pravo ograničiti i omeđiti granice između javnog vlasništva i privatnih nekretnina koje graniče s njom. ; Presenting public property from the viewpoint of limiting property can seem reductive given the large indoctrinated discussion which has been led over two centuries. In this paper, it is important to note that limitation always has a place in determining things or property in the public domain. The very concept of the public domain has developed over time and therefore its definition is varied. Various procedures of limitations are determined by administrative law. Various special (limiting) procedures have been established in order to take into consideration all differences. There is a lack of special legislation which regulates limitation of the dependence of the public domain in relation to uninterrupted private property. This is the case with many public goods given to public services. The public person has the right, as has every owner to limit and restrict the boundaries between public property and bordering private property.

A- Priroda stvari: odabir upravnosudske politike Priroda stvari je izraz koji doktrina rabi za opis stanja upravnog spora kojeg odlikuje jasna razlika između spora pune jurisdikcije i spora za ocjenu zakonitosti, diobu ovlasti između uprave i suca, zabrana da sudac u postupku ocjene zakonitosti ide dalje od poništenja. Ova "priroda stvari" rezultat je odabira upravnosudske politike. Ona je dugo vremena bila dominantan trend, sve do kraja 20. stoljeća, u kojem se rješavanje sporova općenito oslanjalo na to pripada li upravna stvar jednoj ili drugoj velikoj kategoriji sporova. B- Svrha: Vladavina prava U sporovima koji, uzimajući u obzir prirodu stvari, izgledaju kao da pripadaju sporu pune jurisdikcije, uvijek je postojao dobar razlog zašto sudac nije vršio ovlasti pune jurisdikcije: stručnost predmeta, novi sporovi, sporovi zbog naknada skromnih iznosa. U stvarnosti, radilo se o oportunom odabiru kojeg je opravdavala povijesna težina tužbe za ocjenu zakonitosti, povlaštenog instrumenta u stvaranju i razvoju pravne države. I- Priroda stvari i sudačka dužnost Važna promjena nastupila je od 1995. kada je zakonodavac povjerio upravnom sucu ovlast da izdaje naloge upravi za izvršenje pravomoćnih odluka. A- Sudačka dužnost Sudac se navikao uzimati u obzir posljedice svojih odluka o poništenju, provoditi ovlasti koje mu se čine najprilagođenijima za učinkovito rješavanje spora, s obzirom na prirodu stvari. B- Alati prilagođeni prirodi stvari 1- Spor pune jurisdikcije predstavlja samo jednu mogućnost 2- Poništenje zbog ocjene zakonitosti nadopunjeno definiranjem posljedica Danas, sudac ima na raspolaganju druge alate u sporu o ocjeni zakonitosti, a ne samo da zamijeni odluku uprave svojom odlukom. I. Nature of things and judicial duty. An important change has occurred since 1995 when the legislator gave the administrative judge power to issue court orders to the administration for implementing enforceable decisions. A- Judicial Duty. The judge is used to taking into account the consequences of his/her decisions on quashing, implementing powers which seem most appropriate for effective dispute resolution given the nature of things. B- Tools adapted to the nature of things. 1. Full jurisdiction dispute represents only one possibility. 2. Quashing due to an evaluation of legality completed with the definition of consequences. Today, the judge has at his/her disposal other tools in the dispute on evaluation of legality and not just to change administrative decisions by his/her judgement. However, together with these tools is putting the claimant before administration to reach a new decision. 3. Opportune choice of full jurisdiction dispute. Some subjects demand shifting to full jurisdiction dispute. In recent court practice we can differentiate two types of solutions which match two different types of claimant demand situations. A) Control of legality and after examining the legal situation. B) Only examining the legal situation.
