The Underwater Cultural Heritage is a kind of heritage that is little studied and, for that reason, protection to Underwater Cultural Heritage is yet one of the greatest novelties of the present times. There was no standard to regulate it at the international level by 2001. In turn, at a domestic level, the legislation of the Spanish State fails to have a law to protect it in a specific way, except for Law 16/1985 dated June 25 and issued by the Spanish Historic Heritage - LPHE, which includes it within the archeological heritage.The present legal paper addresses the legislation in force in the Spanish State on Underwater Cultural Heritage, with special attention given to Law 16/1985 dated June 25 of the Spanish Historic Heritage.
Objetivos: El objetivo de este estudio se ha centrado en varias cuestiones. En primer lugar, en la lucha contra la corrupción a través de la mejora del control de las cuentas públicas; en segundo lugar, en el seguimiento realizado por el sector de compliance público y, por último, en la promoción de la tecnología blockchain para la minería de datos y contratos gubernamentales para evitar un sistema en el cual impera la corrupción por falta de transparencia.Metodología: El método seguido para la realización de este trabajo científico ha sido el analítico, el cual se ha apoyado en la doctrina, legislación y análisis de informes sobre el impacto del Covid-19 en Brasil y Colombia.Resultados: Con este trabajo científico se ha puesto de manifiesto que para garantizar una vida digna, la salud debe considerarse como el eje central, por lo que cuando existe una mala gestión, ello repercute en los ciudadanos, pues provoca una sobrecarga y desequilibrios de los hospitales. A mayores, se comprueba que existe corrupción en el sistema y ello provoca un mal funcionamiento de los servicios públicos, lo que implica en, en muchas ocasiones, existan compras y contratos sospechosos con la Administración Pública por falta de transparencia y control público, repercutiendo negativamente en la pérdida de seguridad jurídica y estabilidad democrática.Contribuciones: La contribución de la investigación consiste en presentar los impactos negativos de la corrupción durante la pandemia de Covid-19, así como señalar la implementación de la tecnología blockchain para el control de las cuentas públicas.Palabras Clave: Desarrollo; Tecnología Blockchain; Transparencia; Corrupción; COVID-19 ABSTRACT Objectives: The objective of this study focused on several issues. Firstly, on the fight against corruption through the improvement of the control of public accounts; secondly, on the monitoring carried out by the public compliance sector and, finally, on the promotion of blockchain technology for data mining and government contracts to avoid a system in which corruption prevails due to lack of transparency.Methodology: The method followed for the realization of this scientific work has been analytical, which has been supported by doctrine, legislation and analysis of reports on the impact of Covid-19 in Brazil and Colombia.Results: This scientific work has shown that in order to guarantee a dignified life, health must be considered as the central axis, so that when there is poor management, this has repercussions on citizens, since it causes overload and imbalances in hospitals. In addition, it is proven that there is corruption in the system and this causes a malfunction of public services. On many occasions, there are suspicious purchases and contracts with the Public Administration due to lack of transparency and public control, negatively impacting on legal certainty and democratic stability.Contributions: The contribution of the research consists of presenting the negative impacts of corruption during the Covid-19 pandemic, as well as pointing out the implementation of blockchain technology for the control of public accounts.Keywords: Development; Blockchain technology; Transparency; Corruption; Covid-19.RESUMOObjetivos: O objetivo deste estudo incide sobre várias questões. Em primeiro lugar, no combate à corrupção, melhorando o controle das contas públicas; segundo, no monitoramento realizado pelo setor público de compliance e, por último, na promoção da tecnologia blockchain para mineração de dados e contratos governamentais para evitar um sistema em que a corrupção prevalece por falta de transparência.Metodologia: O método seguido para a realização deste trabalho científico é analítico, o que se apoia em doutrina, legislação e análise de relatórios sobre o impacto do Covid-19 no Brasil e na Colômbia.Resultados: Com este trabalho científico demonstra-se que para garantir uma vida digna, a saúde deve ser considerada como eixo central, portanto, quando há má gestão, esta repercute nos cidadãos, pois acarreta sobrecarga e desequilíbrios dos hospitais. La característica esencial de un Estado de Derecho es el sometimiento de los diferentes poderes públicos al imperio de la ley. Por ello, tanto el poder ejecutivo, como el legislativo y el judicial están sometidos a la ley. Aún así no son los únicos, puesto que los ciudadanos y la propia Administración Pública no son ajenos a ello y también están obligados a cumplir la ley. El propio término Estado de Derecho lleva implícito el de derechos fundamentales, pues sin ellos, no podríamos hablar de Estado de Derecho. ; The essential characteristic of a State of Right is the submission of the different public powers to the empire of the law. Thus, so much the executive power, as the legislative and the judicial are submitted to the law. Still like this are not the only, since the citizen and the proper Public Administration aren't extraneous to this and also are forced to fulfill the law. Objetivo: O presente trabalho investiga os efeitos da pandemia do COVID-19 para o empresário brasileiro, por meio da análise de duas premissas: (i) no ano de 2020, o número de pedidos de recuperação judicial aumentaria de forma exponencial; (ii) as medidas legislativas promulgadas pela Lei nº 14,112/2020 na Lei nº 11,101/2005, em especial, o financiamento à empresa do devedor em recuperação judicial, seriam úteis e efetivas à utilização da recuperação judicial como meio de manutenção e preservação da empresa.Metodologia: Adotou-se o método dedutivo, a partir de pesquisa documental, bem como da análise dos dados coletados por outras pesquisas estatísticas e medidores econômicos oficiais.Resultados: É correto afirmar que as medidas sanitárias de contenção da pandemia afetaram profundamente o empresário brasileiro. Porém, o número de pedidos de recuperação judicial não aumentou, conforme esperado, e as modificações implementadas na legislação falimentar, no que se refere ao financiamento do devedor, ainda não se mostraram eficientes para fomentar a utilização da recuperação judicial.Contribuições: Apesar dos incentivos legais criados em prol do financiamento do devedor em recuperação judicial, ainda existe um alto custo reputacional para o empresário que se socorre dessa ferramenta, tornando o crédito a este concedido mais oneroso, por motivações regulatórias. Finalmente, pode-se mencionar que o pedido de recuperação judicial importa para o devedor a assunção de diversas obrigações que representam uma parcela significativa de despesas para o empresário em crise, desestimulando o pedido.Palavras-chave: Pandemia; Coronavírus (COVID-19); Lei nº 11,101/2005, Crise da Empresa; Recuperação Judicial; Financiamento. ABSTRACTObjectives: The instant work investigates the effects of the COVID-19 pandemia on Brazilians entrepreneur, through analysis of two premises: (i) in 2020, the number of judicial reorganization requests would increase exponentially; (ii) the legislative measures promulgated by law #14,112/2020 upon law #11,101/2005, especially, the financing to debtors under judicial reorganization, would be useful and effective to the utilization of judicial recovery as a means of maintaining and preserving the company.Methodology: The deductive method was adopted, as from document research, as well as from analysis of data collected by other official statistical surveys and economic measurements.Results: It is appropriate to state that the sanitary measures for pandemia containment have deeply affected Brazilian entrepreneurs. However, the number of judicial reorganization requests has not increased, as expected, and the changes implemented upon bankruptcy legislation, as to debtor financing, have not yet proven efficient to foster the use of judicial reorganization.Contributions: Despite legal incentives created on behalf of debtor financing under judicial reorganization, there still is a high reputational cost to the entrepreneur which avails itself of this tool, turning the credit granted to this grantee more financially burdensome, on account of regulatory motivations. Finally, it can be mentioned that a judicial recovery request implies, to the debtor, the taking up of several obligations representing a significant tranche of expenses to the entrepreneur in distress, thereby discouraging such requests.Keywords: Pandemia; Coronavirus (COVID-19); Law #11,101/2005; Company crises; Judicial recovery; Financing.
