In mature democracies citizens are being gradually empowered to make important decisions about how to handle crime and disorder and to assume an active role in making their communities safer. Do the justifications for this partial shift away from the commitment to adversarial, state-centered criminal justice apply to democratizing countries? Viewed individually, the arguments for public-empowering justice in transitional states are all quite partial. But they can be creatively combined within a framework that has relevance for a number of countries, especially if the argument from democracy incorporates a deliberative perspective. Significant institutional barriers remain, however, as illustrated by the post-apartheid South African state's retreat from its initial interest in community policing, lay assessors in criminal trials, and community courts.

The criminal justice policy that emerged in post-apartheid South Africa is remarkably similar to the "get-tough" strategy implemented in the US. As a result, an interesting relationship has developed between South Africa's new macroeconomic policies & its focus on resolving the epidemic of crime. The result has been state-centered social control & the first signs of repression. It is deemed unfortunate that South Africa's dependence on foreign investment & aid will only encourage the country's move toward hard line law enforcement & harsh punishment. K. Larsen

As a presidential candidate, Bill Clinton maintained that the George Bush administration's "get-tough" policies on drugs had failed, & that this goal would be to get tougher still. Once in office, Clinton's rhetoric focused on the hard-core drug user, thereby refining rather than transforming the images of weakness & pathology in drug users perpetuated by Bush & Ronald Reagan. Thus, "drugspeak" -- an antidrug semantic shaping the problematic character of drug use & users -- is alive & well in Washington, DC, & continues to undergird harsh & ineffective anticrime measures. Key themes of contemporary drugspeak center around the ubiquity of the drug problem, the need for wholesale eradication, the justification of harsh penalties, & the equation of prohibition with social unity. 14 References.
