International Law in its current form is dominated by positivism and voluntarism; yet, it has accepted a number of concepts from the Natural Law tradition that seem on the face of things to ill-fit the dominant normative complex. Of primary concern here are the Natural Law notions of categorical obligation that have been brought into International Law in the form ofjus cogensrules. A number of interesting questions present themselves. What are positivists doing talking about categoricals? How have they found a way to make this fit within their larger doctrine? Have positivists adopted the language of categorical obligation, but only the language, not the correlative practices? Is it simply a matter of smuggling in alien concepts and shoehorning them despite the lack of fit, or have they created something new that only seems not to fit? Ultimately, what we find is that International Law has accepted this idea in a form that ultimately is limited by voluntarism's insistence on the voluntary and specific character of all obligations.

On its face, The Art of World-Making focuses on honouring the career of Nicholas Greenwood Onuf and his contributions to the study of international relations; of equal importance, however, while using Onuf's work as their touchstone, the contributions to this volume range widely across IR theory, making important interventions in some of the most important topics in the field today.

AbstractOne of the insights of Constructivism is that our world is, in part, made by what we say about it. We make things what they are by saying what they are. One way is through the use of metaphor; by asserting that one thing is another thing. Does our saying that a state is a person make it a person?A way to intervene in this discussion is by addressing it not in the abstract, but guided by a cognate question: Can states commit crimes, a uniquely human act? If states can commit and be liable for crimes, they must be able to form intents. If they are indeed persons in the relevant sense, this is no problem; if their personality is trope, however, attribution of criminal responsibility becomes tenuous.To analyse the issue, I trace the development of the trope of speaking of a group as if it were an individual from Roman Law, through to Hobbes, corporate law and IR Theory. Much hinges on Hobbes' elision of 'body' and 'person'. I conclude that it is too much to expect of a metaphor that it act, that it have reasons, beliefs, and desires, and that these sum to intentions.
