PENERAPAN PIDANA TERHADAP TINDAK PIDANA YANG MENGEDARKAN SEDIAAN FARMASI BERUPA OBAT TANPA IZIN EDAR (Studi Perkara No: 360/Pid.Sus/2012/PN.Ta)
Abstract Pharmaceutical preparations in the form of circulatory drugs must obtain permission from the Ministry of Health as stipulated in Article 106 paragraph (1) of Law Number 36 of 2009 concerning health and terms of permission stipulated in Article 2 of Republic of Indonesia Government Regulation Number 72 of 1998 concerning Safeguarding of pharmaceutical preparations and equipment health. Case Study Number 360 / Pid.Sus / 2012 / PN. The defendant has been found guilty of imprisonment of 7 (seven) months and a fine of Rp. 300,000 (three hundred thousand rupiahs). The formulation of the problem is (1) How is the criminal application of the perpetrators of Criminal Acts Circulating Pharmaceutical Preparations without Circular Permits and (2) What is the Judge's consideration in imposing a criminal sentence in decision Number 360 / Pid.Sus / 2012 / PN.Ta. This study used a normative juridical approach. This study examined court decisions. Court decisions are collected by document studies. Data was analyzed qualitatively. Based on the research, it was concluded that: (1) The criminal application of criminal acts intentionally circulating pharmaceutical preparations without distribution permits, which is imposed on the defendant in accordance with legal facts both witness testimony, defendant's statement, charges and demands with the threat of criminal sanctions and criminal penalties in Article 197 Law No. 36 of 2009 concerning Health. (2) Considerations of Judges in criminal acts intentionally circulating pharmaceutical preparations that do not have this distribution permit are correctly based on considerations as stated in the decision.Keywords: criminal, pharmaceutical preparations, circulation, drug
