Pasca amandemen Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan, salah satu poin penting yang diatur dalam amandemen undang-undang tersebut adalah amanat untuk membentuk badan legislatif nasional dimana pembentukan badan khusus ini harus segera dilaksanakan agar. untuk mengatasi berbagai masalah regulasi yang selama ini dialami oleh Indonesia. This study aims to analyze concept, the responsibility of Islamic education to children with special needs and its implementation strategy. This research uses library research method. Data analysis was carried out using content analysis, where each finding from the literature search was analyzed in depth to obtain uniqueness. The results of this study indicate that children with special needs should receive special attention so that they can be equal and do not feel different from other normal children. The responsibilities of Islamic education for children with special needs, namely; 1) active role of government. the government has provided, 2) strengthening the mental condition of parents, 3) adequate social support. Regarding the implementation of responsibilities, it is carried out by implementing learning strategies so that they can be optimized by making modifications (content, process, evaluation), functional, task analysis, individual learning, peer learning. In addition, inclusive education can also be carried out which provides opportunities for all students who have disabilities and have the potential for intelligence to participate in education in an educational environment together.
This study aims to examine the concept of restorative justice from the point of view of Indonesian legislation. So far, studies on restorative justice have been limited to criminal law studies alone, so it is interesting to later portray restorative justice from a statutory perspective which is part of the study of constitutional law. Based on the author's investigation, the adoption of the concept of restorative justice in Indonesia is relatively new, which began after the DPR passed Law No. 11 of 2012 on an integrated criminal justice system. This law, although it was formed in 2012, came into effect two years later, namely in 2014. Restorative justice in the SPPA Law is enforced by a diversion method, namely the process of transferring children's cases from the judicial process to outside the court. There are at least two derivative regulations to carry out the mandate of the SPPA Law, first, the Supreme Court Regulation Number 4 of 2014 concerning Guidelines for the Implementation of Diversion in the Juvenile Justice System and second, the Republic of Indonesia Attorney's Regulation Number 15 of 2020 concerning Cessation of Prosecution Based on Restorative Justice. Abstrak Penelitian ini berusaha mengkaji konsepsi keadilan restoratif dalam sudut pandang peraturan perundang-undangan di Indonesia. Selama ini kajian mengenai keadilan restoratif terbatas pada kajian hukum pidana semata sehingga menarik untuk kemudian memotret keadilan restoratif dari perspektif perundang-undangan yang mana menjadi bagian dari kajian hukum tata negara. Berdasarkan penelusuran penulis, pengadopsian konsep keadilan restoratif di Indonesia terbilang baru yakni dimulai pasca DPR mensahkan Undang-undang Nomor 11 tahun 2012 tentang Sistem Peradilan pidana terpadu. Yang mana undang-undang ini meskipun dibentuk pada tahun 2012 namun mulai berlaku dua tahun kemudian yaitu pada tahun 2014. Keadilan restoratif dalam UU SPPA diberlakukan dengan metode diversi yaitu proses pengalihan perkara anak dari proses peradilan menjadi di luar peradilan. Setidaknya terdapat dua peraturan turunan guna melaksanakan amanah UU SPPA ini pertama, Peraturan Mahkamah Agung Nomor 4 Tahun 2014 tentang Pedoman Pelaksanaan Diversi dalam Sistem Peradilan Anak dan kedua, Peraturan Kejaksaan Republik Indonesia Nomor 15 tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif.
AbstrakPutusan Mahkamah Konstitusi (MK) Nomor 22/PUU-XV/2017 membawa angin segar bagi para pencari keadilan di negeri ini. Majelis hakim MK menetapkan bahwa pasal 7 ayat (1) Undang-Undang Nomor 1 tahun 1974 tentang Perkawinan pada frasa "usia 16 (enam belas) tahun bertentangan dengan Undang-Undang Dasar NRI tahun 1945 dan tidak mempunyai kekuatan hukum mengikat serta memerintahkan kepada legislatif untuk melakukan perubahan terhadap Undang-Undang perkawinan khususnya pada rumusan batas minimal usia perkawinan bagi perempuan dalam jangka waktu paling lama 3 (tiga) tahun. Setelah rumusan batas minimal perkawinan bagi perempuan ini dibatalkan oleh Mahkamah Konstitusi, selanjutnya patut ditelaah dan dianalisis bagaimana konsekuensi dan dampak putusan tersebut bagi Undang-Undang Perkawinan dan peraturan-peraturan yang terkait. Idealnya setelah putusan Mahkamah Konstitusi ini dimuat dalam berita negara Indoneisa maka para pembentuk Undang-Undang segera melaksanakan kehendak putusan tersebut demi menciptakan keadilan dan kesejahteraan bagi masyarakat Indonesia.
This study analyzes the accountability of village funds and the key factors. This study uses a qualitative approach by conducting in-depth interviews with informants at every stage of planning, implementing, administering, reporting, accountability, coaching, and supervision of village financial management. The results of this study indicate that village financial accountability is applied by law number 6 of 2014 with the critical factors of the effectiveness of the village government in managing finances independently but is accompanied by a less than the optimal role of the village consultative body (BPD).
Abstract Comunnity empowerment program (PRODAMAS) is an activity of the Kediri city government to improve community welfare. The target of the program is the community in the neighborhood in Kediri City, namely strengthening institutions, training, skills and social activities to increase the response to the awareness of participating in planning is a difficulty in itself. When building basic environmental facilities and infrastructure that should involve community members, the opposite often occurs, namely reluctance from residents because they feel that these activities only benefit certain groups. The result is that the implementation of basic environmental development is not satisfactory because it is not in accordance with the wishes of the resident. The supervision that is expected to arise by itself is ineffective because the making of development planning and the implementation of development activities that should be carried out by the community is still far from being expected because of the assumption that the task of supervising is a committee or government that has been formed so that the community tends not to carry out supervision. On the other hand, there is an attitude of society that is less supportive. For this reason, researchers are interested in analyzing the implementation of Kediri Mayor Regulation No. 40/2014 in Mojoroto District, Kediri City. The analysis used in this research is descriptive analysis. The results of the research and the focus of the research are that the planning stages have been carried out in accordance with the guidelines for implementing the implementation stages. Sasaran program adalah masyarakat di wilayah Rukun Tetangga di Kota Kediri, yakni penguatan kelembagaan, pelatihan, keterampilan dan kegiatan sosial untuk menambah respon akan kesadaran berpartisipasi dalam perencanaan adalah sebuah kesulitan tersendiri. Pada waktu melakukan pembangunan sarana dan prasarana dasar lingkungan yang seharusnya melibatkan warga masyarakat sering terjadi hal sebaliknya yaitu timbul rasa enggan dari warga karena mereka merasa kegiatan itu hanya memberikan manfaat bagi kelompok tertentu. Hasilnya pelaksanaan pembangunan dasar lingkungan kurang memuaskan disebabkan tidak sesuai dengan keinginan warga. Pengawasan yang di harapkan timbul dengan sendirinya tidak efektif karena pembuatan perencanaan pembangunan serta kegiatan pelaksanaan pembangunan yang seharusnya dilakukan oleh masyarakat sedikitpun tampaknya masih jauh dari harapan karena adanya anggapan bahwa yang bertugas melakukan pengawasan adalah pihak panitia atau pemerintah yang telah dibentuk sehingga cenderung masyarakat tidak melakukan pengawasan. Disisi lain ada sikap masyarakat yang kurang mendukung. Dengan alasan itulah peneliti tertarik untuk menganalisis pelaksanaan peraturan Walikota Kediri No 40 Tahun 2014 di Kecamatan Mojoroto Kota Kediri. Analisis yang digunakan dalam penelitian ni adalah analisis deskriptif. This study aims to find out the direction of legal politics in Indonesia regarding the rules for prohibiting former corruption prisoners from registering as legislative candidates. Prohibition of former corruption prisoners registering as legislative candidates is contained in Article 7 paragraph (1) letter h draft of KPU Regulation (PKPU) nomination of members of DPR, Provincial DPRD, and Regency / City DPRD. However, the rules of the KPU are contradictory to Article 240 paragraph 1 letter g of the Election Law, where a former prisoner who has served a sentence of five years or more, may run for as long as the person announces that he has been a prisoner to the public. In fact corruption falls into extraordinary crimes, therefore the KPU plans to provide strict rules, but on the other hand these rules are still contrary to laws and other regulations.

Society that is not facilitated by banking service could build this Kayu Gelam house by self-supporting action, and labor-intensive construction method. This research conducted by Descriptive-Analytics and Comparative methods. Descriptive-Analytics to reveal the innovation of which parts of Kayu Gelam could be explored into architectural façade, so it's applicable to Low-Waged House without made it 'cheap'. While Comparative method used to compare all aspects in it, like technique, price, and its contribution in digging Local Wise potential up in modern constellation.
Problems in electoral law are more complex than those in other legal regimes. The many types of problems and the large number of institutions involved in handling elections and general elections indicate the complexity of electoral law and election problems. There are six types of problems in election and general election law, namely violations of the code of ethics for election and general election organizers, electoral and electoral disputes, administrative and electoral violations, election and general election crimes, election results disputes and administrative disputes election and general election countries. Whereas various institutions involved in the election and general election law include the General Election Commission (KPU), Election Supervisory Body and general election (Bawaslu), Honorary Election and Election Organizing Board (DKPP), Indonesian Police, District Courts and High Courts, Courts State Administration and State Administrative High Court, Supreme Court, Constitutional Court and Indonesian Broadcasting Commission. The complexity of the electoral law and general elections is inherent in the realm of election and general election crimes. The regulation and law enforcement of election and general election are a separate problem, especially in terms of the mechanism for resolving election and general election crimes. Recently the Supreme Court has issued Regulations relating to the settlement of election and general election crimes. This study will examine the mechanism for resolving criminal acts in elections and general elections in the Supreme Court Regulation No. 1 of 2018 concerning the settlement of election crimes and general elections related to the politics of criminal law in Indonesia.
Reformasi telah menjadikan perubahan yang mendasar dalam sistem ketatanegaraan Indonesia yang pada awalnya menganut sistem sentralisasi menjadi desentralisasi. Salah satu efek pemberlakuan desentralisasi di Indonesiaadalah munculnya Perda-Perda Syariah. Sebagian muatanmuatan dari Perda-perda Syariah tersebut telah bertentangan dengan prinsip-prinsip hak asasi manusia yang dimuat dalam konstitusi. Terdapat dua permasalahan yang menjadi fokus kajian tulisan ini, yaitu (1) Mengapa Muncul Perda-Perda Syariah di Indonesia; (2) Bagaimanakah Materi Perda Syariah menurut Perspektif Asas-Asas Pembentukan dan Asas-Asas Materi Muatan Peraturan Daerah. Hasil penelitian menyimpulkan bahwa terdapat 4 faktor yang melatarbelakangi munculnya Perda Syari"ah yakni: latar belakang historis, yuridis, sosiologis dan politis. Dari segi historis, Perda ini mucul terkait dengan sejarah penerapan Syari"at Islam di Indonesia sejak Islam masuk ke Nusantara hingga saat ini. Dari segi yuridis, Perda ini muncul seiring dengan diberlakukannya otonomiDaerah yang merupakan amanat dari UUD NRI 1945 hasil amandemen keempat dan diundangkannya UU No. 22 Tahun 1999 Tentang Pemerintahan Daerah yang kemudian digantikan oleh UU No. 32 Tahun 2004 Tentang Pemerintahan Daerah. Dari sisi sosiologis, Perda Syari"ah ini muncul karena adanya political will pemerintah bersama masyarakat. Sedangkan dari sisi politis, diundangkannya Perda Syari"ah oleh sejumlah Provinsi dan Kabupaten/Kota merupakan kepentingan politik jangka pendek elit politik untuk melanggengkan kekuasaannya di masing-masing wilayah tersebut. Dikaji dari Perspektif Asas-Asas Pembentukan dan Asas-Asas Materi Muatan Peraturan Daerah, kelima Perda yang dikaji materinya bertentangan dengan kedua asas-asas tersebut.
This study aims to determine the effect of government spending in the health on education and infrastructure on the Human Development Index (IPM) in Aceh Tamiang District. The data used are secondary data from 2008 to 2019. The data analysis method uses multiple lineir regression equations, hypothesis testing (t test and F test), and the coefficient of determination (R2) test. Statistical calculations using Microsoft Excel. The regression coefficient 0.015 represents government expenditure on health which has a positive effect on the Human Development Index. The regression coefficient of 0.038 represents government spending on education which has a positive effect on the Human Development Index. The regression coefficient of 0.007 represents government spending on infrastructure which has a positive effect on the Human Development Index. The results of the t test show that government spending in the health sector has a t sig> α5% (0.199> 0.05). It can be stated that government spending on health has no significant effect on the Human Development Index. The value of government expenditure in education is t sig> α5% (0.169> 0.05). It can be stated that government spending on education has no significant effect on the Human Development Index. The value of government spending on infrastructure is t sig> α5% (0.292> 0.05). It can be stated that government spending on infrastructure has no significant effect on the Human Development Index. The results of the F test, F sig α5% (0,199>0,05) dapat dinyatakan bahwa pengeluaran pemerintah bidang kesehatan berpengaruh tidak signifikan terhadap Indeks Pembangunan Manusia. Pengeluaran pemerintah bidang pendidikan diperoleh nilai t sig > α5% (0,169>0,05) dapat dinyatakan bahwa pengeluaran pemerintah bidang pendidikan berpengaruh tidak signifikan terhadap Indeks Pembangunan Manusia. Pengeluaran pemerintah bidang infrastruktur diperoleh nilai t sig > α5% (0,292>0,05) dapat dinyatakan bahwa pengeluaran pemerintah bidang infrastruktur berpengaruh tidak signifikan terhadap Indeks Pembangunan Manusia. Hasil uji F, F sig < α5% (0,000 < 0,05) dapat dinyatakan pengeluaran pemerintah bidang kesehatan, pengeluaran pemerintah bidang pendidikan dan pengeluaran pemerintah bidang infrastruktur berpengaruh signifikan terhadap Indeks Pembangunan Manusia di Kabupaten Aceh Tamiang. hasil uji koefisien determinasi sebesar 0,860 atau sebesar 86% variabel pengeluaran pemerintah bidang kesehatan, pengeluaran pemerintah bidang pendidikan dan pengeluaran pemerintah bidang infrastruktur mempengaruhi Indeks Pembangunan Manusia di Kabupaten Aceh Tamiang. Abstract: The Covid-19 pandemic has spread to various parts of the world, including Indonesia.Various efforts have been made by the government to suppress the impact caused by the virus.Various kinds of efforts have been made by the government to deal with the Covid-19 outbreak, but it cannot be denied that this outbreak has had many major impacts on the country, including the impact on the economy.Therefore, to overcome this problem regarding the economy, it is necessary to have other policies that can help in handling and improving the country's economy.For this reason, this research will answer what policies can help with this.This research method uses library research with a qualitative approach, while the data sources used come from books, journals, articles,newspapers, personal documents, data from the Central Statistics Agency (BPS), data from the Ministry of National Development PPN/Bappenas, articles from the Ministry of Finance and others related to the research conducted by the author.In this study, the authors applied data collection techniques by identifying related data sources.Then the steps taken by the author in carrying out this research are to pre-empt the data related to the research, then analyze the research material that has been collected using descriptive analysis methods.The results of the study show that through its instruments, Islamic fiscal policy can contribute by presenting several solutions that can help restore and escalate the country's economy. In the Era of Disruption 4.0, education should have become one of the media in forming positive attitudes towards various realities. The attitude in question is an attitude of being willing to accept, acknowledge, and respect other people with their respective ethnicities, this is also stated in the slogan "Bhinneka Tunggal Ika". The cultivation of these attitudes and values is the main attraction in the multicultural education system. It is based on this matter that the researcher examines the thoughts of Amin Abdullah. Amin Abdullah's thoughts are very prominent starting from the idea of integration-interconnection, which later became the jargon of UIN Sunan Kalijaga to this day. Then his thoughts contributed significantly to the discourse in creating the concept of tolerant, democratic Islamic education and upholding the values of unity and justice. Writing articles using qualitative research with library methods. This is done in order to get the concepts of Amin Abdullah's thoughts on Multicultural Education. The data sources come from books and journals that are nationally and internationally accredited. Amin Abdullah's thoughts on Islamic education are religious education that breathes peace, has sensitivity to social reality, prioritizes social safety, and is based on the values of unity and justice as contained in the Qur'an and hadith so that students are able to accept, recognize and respect the differences of others.
ABSTRACTThe purpose of this study is to find out: (1) The level of achievement of the realization of the Regional Tax revenue at the Kubu Raya Regency Tax and Retribution Management Agency in 2014-2018. (2) Contribution of Regional Tax revenue in increasing Regional Original Revenue (PAD) to the Regional Management Agency for Taxes and Retribution in Kubu Raya Regency in 2014-2018.The method used is a descriptive qualitative analysis method. Qualitative descriptive research is research that is stated in terms of words, sentences, and numbers. The data used are the Realization of Regional Tax Revenue and Realization of Kubu Raya Regency Original Revenue in 2014-2018. The data that has been processed are then analyzed using qualitative descriptive analysis. The results showed that: (1) Realization of Kubu Raya District Tax revenue for 2014 amounted to 115.62%, in 2015 amounted to 65.77%, in 2016 amounted to 79.77%, in 2017 amounted to 127.82%, in 2018 amounted to 119.09%.
