This paper discusses the current status quo of legal protection of databases after the Ryanair case (C-30/14). The first part focuses on the subject matter, scope and limits of legal protection for databases according to the Directive 96/9/EC and the related relevant Court of Justice of the European Union case law. Next, it briefly discusses further possibilities of protection for databases not protected by the copyright and/or sui generis database rights. The second part analyses the recent decision of the Court of Justice of the European Union in the case Ryanair (C-30/14). The third part then discusses consequences of this decision with regards to potential monopolisation of synthetic data by contract. Conclusions are summed up in the final fourth part. ; Text se věnuje statu quo právní ochrany databází po rozhodnutí SDEu ve věci Ryanair (C-30/14). První část se věnuje předmětu ochrany, rozsahu a limitům právní ochrany databází v rámci směrnice 96/9/ES a související relevantní judikatuře SDEU. Poté stručně diskutuje další možnosti ochrany databází, které nejsou chráněny autorským právem a/nebo zvláštním právem pořizovatele databáze. Druhá část analyzuje nedávné rozhodnutí SDEU ve věci Ryanair. Třetí část pak diskutuje následky tohoto rozhodnutí ve vztahu ke smluvní monopolizaci syntetických dat. Závěry jsou pak shrnuty ve čtvrté části.
Over the course of the twentieth century, Japan has experienced a radicalshift in its self-perception. After World War II, Japan embraced a peacefuland anti-militarist identity, which was based on its war-prohibitingConstitution and the foreign policy of the Yoshida doctrine. For most of thetwentieth century, this identity was unusually stable. In the last couple ofdecades, however, Japan's self-perception and foreign policy seem to havechanged. Tokyo has conducted a number of foreign policy actions as well assymbolic internal gestures that would have been unthinkable a few decadesago and that symbolize a new and more confident Japan. Japanesepoliticians – including Prime Minister Abe Shinzō – have adopted a newdiscourse depicting pacifism as a hindrance, rather than asset, to Japan'sforeign policy. Does that mean that "Japan is back"? In order to betterunderstand the dynamics of contemporary Japan, Kolmaš joins up the dotsbetween national identity theory and Japanese revisionism. The book showsthat while political elites and a portion of the Japanese public call for re-articulation of Japan's peaceful identity, there are still societal andinstitutional forces that prevent this change from entirely materializing.
Jak jsou využívány nové informační technologie v novodobých válkách alokálních konfliktech? Jak byla vedena válka v Perském zálivu, na Balkáněnebo na Krymu? A jakým směrem se bude vedení konfliktů vyvíjet? V historiiválek hrály informace pro jejich vedení důležitou roli a lze nalézt bezpočetpříkladů využití informací k podpoře válečného úsilí. Nikdy v minulostineměl člověk tak efektivní nástroje komunikace, nikdy předtím však takénebyl v informačním prostředí tak zranitelný. Informace a působení na ně,jejich prostřednictvím či v jejich prostředí se pro vedení válek a vojenskýchoperací staly rozhodující. Problematika informačního působení ve válce nenísama o sobě novým fenoménem. Autor ji zasazuje do širšího rámce vedeníválky a jeho vývoje. K tomu využívá příklady z historických pramenů akoncepce tří civilizačních vln a čtyř generací moderního válečnictví. Napopisu vývoje prostředí je také naznačen možný charakter války vbudoucnosti. Zachycuje informační prostředí, propagandu a její vývoj,strategickou komunikaci, informační operace i válku v kybernetickémprostoru. Vzhledem k aktuálnosti ruského informačního působení vůčiČeské republice a jejím spojencům je pro českého čtenáře v samostatnékapitole podrobněji popsán přístup Ruské federace k vedení informačníválky. Kniha generála Řehky srozumitelným způsobem vysvětluje vedeníválky v informačním prostředí a čtenáři pomáhá vytvořit si základnípředstavu o specifikách války v informačním věku. Cílem je přispět kespolečenské diskusi a vzdělávání v otázkách bezpečnosti a obrany.
The paper presents the additive manufacturing method as a possible alternative to the current subtractive manufacturing methods. Based on literature survey, some of the problematic aspects of the discrepancy between the lengthy development cycles and rapidly changing operational demands responsive to current threats are identified. The paper also includes some thoughts on possibilities of solving inadequacies in the development cycles, as well as related logistical apparatus, by additive manufacturing. For the sake of objectivity, the last part is dedicated to deficits of additive manufacturing, being inherent to technology or possibly to be overcome by further development of the field.
Totalitarian past is not the only tie bringing together Lithuania and the Czech Republic nowadays. Both countries are young democracies that underwent dynamic social, legal and political changes during the 90s to ensure transition toward becoming modern democratic states. Now, both countries are members of the European Union and NATO and they share common interest of the small European countries. However, the totalitarian past remains present and it has certain influence on recent issues arising from the current information society. Totalitarian regimes in both countries left some of the political approaches twisted beyond recognition and adversely affected the very core of the society and ways it approaches itself and the others. The author of the paper is aiming to provide the comparison of Lithuania and the Czech Republic mainly within the field of the cybernetic security, but with certain overlaps to general theory of the information society and the continental legal tradition of distributive rights. In both countries, the cybernetic security presents a new and interesting challenge, because both countries can be perceived as rookies within this particular field. In the first and the second parts, the author describes the very essence of the information society and the informational self-determination as the core principle arising from the information society. Then, in the third part, the author describes reminiscences of the totalitarian past, which could be understood mainly as a general opposition towards limitations of distributive rights, because the means of cyber security are vastly understood as the government trying to regulate the Internet. This is a rather sensitive topic, due to the totalitarian past of both countries. In the fourth part, the author describes the current stateof- art of the cyber security, mainly approaching the United States, the United Kingdom and Germany as countries well-established within the field of cyber security. Estonia, as another small state, is also taken into consideration, providing their very mature legislation and approach toward the cyber security that may act as a role model for Lithuania and the Czech Republic. Part of the paper is also reserved for the comparison between approaches of Lithuania and the Czech Republic, because despite being part of the EU/NATO political background and target of the currently proposed cyber security Directive, there are still differences present due to the national character of the cyber security. This contribution is not intended to be exhaustive and overwhelming source of answers, but rather as the approach to the future while taking into consideration both the present and the past. Main findings could be summarised in the following way: (1) the legislation in Lithuania and the Czech Republic is not as mature as it could be; (2) Lithuania approaches this issue rather more seriously compared to the Czech Republic, given the geographical proximity to Estonia and the 2008 cyber incident as evidenced, for example, by its participation within the NATO Cooperative Cyber Defence Centre of Excellence; (3) public in both Lithuania and the Czech Republic seems to slowly understand the danger of the cyber insecurity, but it also approaches it carefully due to the totalitarian past; (4) cyber security in both countries is insufficient, but given the totalitarian past, the legislators should probably focus more on ensuring the cooperation of public and corporate/private sectors rather than imposing new legal obligations. ; Ir Čekijos Respublika, ir Lietuva yra jaunos demokratijos, patyrusios esminius socialinius, teisinius ir politinius pokyčius devintajame dešimtmetyje, kai vyko jų virsmas moderniomis demokratinėmis valstybėmis. Kibernetinio saugumo užtikrinimas išlieka vienu iš šių valstybių tikslų, nes totalitarinis valdymas praeityje ir vėluojanti politinė evoliucija persekioja jų dabarties ir ateityje numatomą vystymąsi.
Tento text představuje odpověď na příspěvky Ondřeje Kadlece, Jaroslava Benáka, Lukáše Králíka a Arkady Alexandrova a Pavla Ondřejka reagující na knihu Citační analýza judikatury. Jejich reakce a podněty diskutujeme napříč čtyřmi kategoriemi: Povinnost následovat judikaturu a stare decisis, silné a slabé stránky konceptu optimální relevance, silné a slabé stránky "makropohledu" na české citační prostředí, které pak úzce souvisí s otázkami proveditelnosti navrhovaných cest dalšího výzkumu a reflexe navazujícího výzkumu provedeného Alexandrovem a Ondřejkem.
