This book examines the ways in which collective bargaining addresses a variety of workplace concerns in the context of today's global economy. Globalization can contribute to growth and development, but as the recent financial crisis demonstrated, it also puts employment, earnings and labour standards at risk. This book examines the role that collective bargaining plays in ensuring that workers are able to obtain a fair share of the benefits arising from participation in the global economy and in providing a measure of security against the risk to employment and wages. It focuses on a commonly neglected side of the story and demonstrates the positive contribution that collective bargaining can make to both economic and social goals. The various contributions examine how this fundamental principle and right at work is realized in different countries and how its practice can be reinforced across borders. They highlight the numerous resulting challenges and the critically important role that governments play in rebalancing bargaining power in a global economy. The chapters are written in an accessible style and deal with practical subjects, including employment security, workplace change and productivity, and working time.

Las instituciones tradicionales de relaciones laborales, basadas en la premisa del derecho laboral del desequilibrio de poder entre trabajador y empleador, están siendo socavadas por cambios globales sin precedentes en los patrones de trabajo y de empleo. Ello, junto con la aparición de formas alternativas de representación de los trabajadores, plantea un gran reto al sindicalismo tradicional, a los encargados de las políticas y a los estudiosos de las relaciones laborales. Este número monográfico pretende contribuir al debate sobre la evolución futura.

Les institutions des relations professionnelles, nées de l'hypothèse fondatrice de la législation du travail selon laquelle le rapport de forces entre travailleurs et employeurs est déséquilibré, sont affaiblies par la mutation des modalités du travail et de l'emploi. A cela s'ajoute l'apparition de nouvelles formes de représentation des travailleurs, pour constituer un défi sans précédent non seulement pour le syndicalisme, mais aussi pour les politiques et pour la recherche. Ce numéro spécial se veut une contribution au débat en cours sur les évolutions à venir.

AbstractIn her introductory paper, the coordinator of this Special Issue puts the selection of subsequent contributions into context. Traditional industrial relations institutions, born of labour law's premise of unbalanced power relations between the worker and the employer, are being undermined by unprecedented global changes in patterns of work and forms of employment. This trend, compounded by the emergence of alternative forms of worker representation, poses a major challenge not only to conventional tradeunionism but also to policy and to industrial relations scholarship. This Special Issue is intended as a contribution to the ensuing, ongoing debate about the direction of future change.

ResumenA partir de datos sobre cobertura de la negociación colectiva en 80 países, los autores analizan las ventajas de la extensión de los convenios colectivos como herramienta política para preservar unos mínimos en cuanto a condiciones de trabajo y empleo. Como instrumento regulador, la peculiaridad de un convenio de eficacia general es que se fundamenta en el acuerdo entre organizaciones independientes, autónomas y representativas, pero es emitido por las autoridades públicas, lo que le confiere tanto las ventajas de un contrato como las de un estatuto. La extensión puede así amparar a trabajadores vulnerables que, de otro modo, quedarían desprotegidos, sin menoscabar la adaptabilidad de esta modalidad reglamentadora.

RésuméLes auteurs utilisent des données sur la couverture conventionnelle dans 80 pays pour évaluer l'apport des mécanismes d'extension des conventions collectives en tant que moyen d'instaurer des normes sociales et des conditions d'emploi minimales. Ce mode de réglementation, qui dépend des autorités publiques, a pour spécificité de reposer sur des compromis négociés par des organisations indépendantes, autonomes et représentatives. Il présente de ce fait certains avantages du contrat, en plus des caractéristiques des textes de loi. Particulièrement souple et adaptable, il permet de couvrir des travailleurs vulnérables, qui seraient privés de protection autrement.

AbstractUsing data on collective bargaining coverage for 80 countries, the authors analyse the merits of using the extension of collective agreements as a policy tool for creating a floor for conditions of work and employment. Issued by public authorities, this regulatory instrument is distinctive in that it is based on agreement between independent, autonomous and representative organizations. This gives it some of the advantages of a contract as well as those of a statute. The extension of collective agreements by public authorities can provide coverage for vulnerable workers who may not otherwise have access to social protection, while offering a highly responsive form of regulation that can be adapted to particular circumstances.

"By examining the evolution of industrial relations institutions in the emerging economies of Brazil, China, India, South Africa and Turkey, the authors in this book assess the contribution of these institutions to inclusive development. Industrial Relations in Emerging Economies uses real-world examples to assess the relevance of the conceptual frameworks used to examine employment relations. The chapters focus on the evolution of industrial relations institutions and the role that these have played in periods of economic and political transition. They demonstrate that rather than acting as a constraint on development, trade unions can contribute to stability, security and equity. The contribution of industrial relations institutions to inclusive development nonetheless remains the subject of debate, viewed by some as increasingly irrelevant to the vast numbers of workers in the informal economy. The authors here, however, reveal a continuing demand for independent collective interest representation in labour relations, whether in the informal economy or in rapidly industrializing districts.
