Der europäische Integrationsprozess war eine der Erfolgsgeschichten des letzten Jahrhunderts. Dabei war es stets das vorrangige Bestreben die Integration voranzutreiben, indem die gegenseitige Zusammenarbeit immer weiter vertieft wurde ("ever closer Union"). Der Brexit hat diesem Konzept offensichtlich ein Ende gesetzt. Ist dies - horribile dictu - der Beginn des Endes der EU? Um diese komplexe Frage zu beantworten, werden in diesem Band eine Reihe wichtiger Aspekte der sich abzeichnenden '-xits' analysiert - sei es Brexit, Grexit oder Plexit. Die Autoren entwickeln vielfältige Lösungsansätze für die entstehenden Probleme, wie die Neuausrichtung und Abgrenzung der Zuständigkeiten der EU, einen neuen normativen Rahmen für einen geordneten Rückzug aus der Eurozone und eine stärkere Betonung der Rolle der Regionen in Europa
On December 6, 2017, the European Commission published a set of proposals to reform the euro area. These proposals include, inter alia, the creation of a post of European Finance minister, a euro area budget-line and the establishment of a European Monetary Fund (EMF). The latter will be at the centre of this article. The Commission does not intend to set up the EMF anew from scratch. Rather, the new EMF is to be built on the well-established structure of the European Stability Mechanism (ESM). The new EMF will thus succeed to and replace the ESM, with the latter's current financial and institutional structure essentially preserved. However, the new institution will also take on a number of additional functions, such as providing a financial backstop for the Single Resolution Fund (SRF), enhanced monitoring tasks and the responsibility to report regularly to the European Parliament. But will these changes make EMU more efficient, coherent and democratic? And has the EU the competence to establish such a mechanism at all? AbstractSince the precarious state of Greece's public finances was revealed last October, efforts to save the 'cradle of Europe' are in full swing. Hence a huge rescue package for Greece was agreed on in April 2010. This was followed by an even larger EU Stabilisation Fund worth €750 billion for States encountering financial problems. While the economic aspects of these rescue mechanisms have been debated intensively, their legality has escaped closer examination. Rushed through parliaments as an 'economic emergency', the peoples of Europe were more or less presented with a 'fait accompli'. But are these measures really legal under EU law? What about the notorious 'no bailout' clause? And what about the alternatives to the rescue packages: Would it have been legal to withdraw from EMU? Or to expel a State from EMU? This chapter will shed some light on these important aspects of EU law.
