The United Nations Convention on the Law of the Sea (UNCLOS) offers a legal framework for the sustainable development of the oceans and their natural resources. However, recently there have been calls to amend the Convention due to some ambiguous provisions which are unable to address a variety of contemporary maritime issues. This article analyzes China's policy approach to dispute settlement through the angle of its attitude on international law, especially the role of third‐party compulsory mechanism in solving international disputes. It explains China's position of no acceptance and no participation in the South China Sea arbitration case and discusses the legal implication of the arbitration case and its political and security impacts on the South China Sea (SCS). A compulsory dispute settlement mechanism may not be the only or the best option for addressing the disputes in the SCS. A model of maritime dispute management is proposed with the goal of achieving peace and stability in the region of the SCS. This article suggests a practical four‐tiered model of maritime dispute management in the SCS, namely, environmental security as a driving force of cooperation in the SCS, fisheries cooperation as a start of the SCS dispute resolution, United Nations Convention on the Law of the Sea as a framework for ocean governance in the SCS, and lastly, transformation of ways of thinking as a foundation to lead policy and research direction.

This book project evaluates the applicability and effectiveness of UNCLOS as a settlement mechanism for addressing ocean disputes. Focus is placed on the South China Sea (SCS) dispute, one of the most complex and challenging ocean-related conflicts in the world. The book examines how the emphasis on sovereignty, contention on energy, significance of the geographic location, threat to maritime security, overlapping maritime claims caused by the new established maritime regimes authorized by UNCLOS are all sources of the SCS dispute. The book considers the internal coherence of the Law of the Sea Convention regime and its dispute settlement procedures. It looks at the participation in the UNCLOS negotiation, maritime legislation, and dispute settlement practice of relevant States party to the dispute. The book goes on to explore the relationship between UNCLOS and other regimes and institutions in general in the SCS, particularly in regard to maritime security, marine environment protection, oil and gas joint development and political interaction. Nong Hong suggests practical mechanisms to solve the dispute and offers conclusions on the effectiveness of UNCLOS for settling disputes"--

This paper critically reviews four international legal instruments in addressing piracy and maritime terrorism – UNCLOS, SUA, PSI and the ISPS Code. Piracy on high seas is currently becoming key tactics of terrorist groups – many of today's pirates are also terrorists with ideological bents and a broad political agenda. The intertwining of piracy and maritime terrorism poses substantial risks for global markets, understanding that much of the world's energy and cargoes being shipped through pirate-infested regions like Southeast Asia. Through investigating the contributions and limitations of the stated instruments, several constructive recommendations are offered to improve their effectiveness in controlling and deterring piracy and maritime terrorism from threatening the well-being of the maritime industries in the post-2008 world.
