Wenn eine Agentur Letztentscheidungsbefugnis in sämtlichen Fällen von Konflikt hat, dann hat sie diese Befugnis auch bezüglich aller Konfliktfälle, die sie selbst involvieren. Dementsprechend muss erwartet werden, dass der Monopolist nicht bloß als Vermeider und Schlichter von Konflikten tätig wird, sondern dass er insbesondere auch selbst Konflikte herbeiführt oder provoziert, um sie dann zu seinen eigenen Gunsten zu entscheiden. Wenn man nur an den Staat appellieren kann, um Gerechtigkeit zu erfahren, wird Gerechtigkeit zunehmend zugunsten des Staates pervertiert. Hieran können auch "Verfassungen" und "oberste Gerichte" nichts ändern. Denn es handelt sich hierbei doch immer um Staats-Verfassungen und Staats-Gerichte. Welche "Begrenzungen" diese Verfassungen einem Staat in seinem Tun auch immer auferlegen mögen, die Entscheidung darüber, ob sein Handeln rechtens oder unrechtens ist, wird in allen Fällen von Personen getroffen, die selbst Agenten des Staates sind. Es ist daher voraussehbar, dass die Definition von Privateigentum und Eigentumsschutz kontinuierlich zugunsten der legislativen Gewalt des Staates verändert und ausgehöhlt wird. An die Stelle eines ewigen, unverrückbaren - erkenn- und einsehbaren - Rechts tritt willkürliche Gesetzgebung. Motiviert wie jedermann durch Selbstinteresse und Arbeitsleid, aber ausgestattet mit der einzigartigen Befugnis, Steuern zu erheben, ist darum zu erwarten, dass die Agenten des Staates stets versuchen werden, die Ausgaben für Sicherheit zu maximieren und gleichzeitig die tatsächliche Produktion von Sicherheit zu minimieren. Je mehr Geld man ausgeben kann und je weniger man dafür leisten muss, umso besser dran ist man. (ICF2)
