Policy mismatch is the relevant term to describe the inconsistence between problems met by the people and financial policy being chosen. Improper quality of public services especially in health and education did not correlate significantly with the provincial financial policy. The problem of accessibility and service quality in both fields is not progressively getting better. Although the amount of annual government's expenditure in both field always increase, the percentage is getting reduced yearly. As the result, the financial allocation function did not effectively work to overcome those problems. And finally, as public goods, the availability and accessibility of health and education services can not prevalently being consumed by the people.
What about the development of Islamic criminal law in Nusantara? This question should have been raised for the position of Islamic civil law is widely related to positive law, both as an influencing element or as a modification of religious norms formulated in civil law, even stated in the substantial legal scope of Law No.7 1989 dealing with religious justice. While Islamic law in the field of criminal justice - to mention another term of the Islamic criminal law - has not attracted much attention like the field of Islamic civil law. Apart from that, the available academic studies are often political in nature and broaden the distance between the understanding of positive criminal law and Islamic law in the field of criminal law. From a macro-historical perspective, the plurality of laws is inevitably a historical reality. The Positivism School believes that: the development of law is formalized for the sake of the law only. These circles strongly reject political interference in law, law by law, legal science in the form of value-free science while political science especially when associated with social science can be in the form of value-loaded science. According to this group's view, the procedure of finding, forming, and implementing law are in the hand of legal apparatus, the law can only be found through the judge's decision. The legal formation process is limited to legitimator products passed by the law. Law is a command of the law giver.
Meritocracy is still a fundamental problem in political recruitment in Indonesia, especially in political parties. Although reform has penetrated all state institutions and the entire life of the nation and state, political parties became one of the institutions that remained unmoved by the old tradition even with several adaptations to follow the demands of democratization. This research was conducted with a qualitative approach to study the process of political recruitment in the Banten Province Golongan Karya Party, ahead of the 2019 General Election. It was chosen because of its existence as the most experienced major party. The results of the study prove that the poor face of political recruitment of legislative candidates is more determined by financial strength and nepotism. Formal selection is done, but the process is not accountable enough as well as the results. As a result, it will be closely related to the election of members of the legislature who have not only doubted their capabilities but also their integrity as reflected in the low quantity and quality of policies produced and the proliferation of corruption cases involving many legislative members at the central and regional levels.
Penelitian ini menggunakan dasar awal dari hasil penelitian kritis, diantaranya Laclau, Mouffe, Foucault, Marxis, yang mendasarkan pada asumsi bahwa privatisasi, komersialisasi dan komodifikasi sumber daya air dengan melanggar kedaulatan hak asasi rakyat atas air oleh Pemerintah (khususnya Kabupaten Serang-Banten, Indonesia) dan masuknya Aqua – Danone sebagai company (diartikan dengan kompeni = penjajah oleh masyarakat Padarincang khususnya) seperti Foucault sebutkan, "berimbas pada 'pembentukan kekuatan, menjadikan masyarakat baru yang bangkit, dan menata masyarakat untuk menyongsong demokrasi melawan praktek yang penuh kontrol, kekuasaan, dan keuntungan. Penghancuran terhadap segenap gagasan terhadap ideologi kapitalis melalui kekuatan pengetahuan dan beragama dengan teguh memegang prinsip ber-Qur'an. Melalui konsep kajian budaya (cultural studies), penelitian ini menunjukkan bagaimana suatu perusahaan, khususnya pabrik Aqua Danone (PT. Tirta Investama), yang menggunakan kekuatan modal dan kekuasaan dalam strategi ekspansi pasar. Data diperoleh melalui wawancara dengan masyarakat Padarincang melalui teknik snowball sampling terhadap masyarakat Padarincang, baik yang pro, yaitu mereka yang menjual tenaganya yang tunduk pada (kekuasaan) modal, dan setiap orang yang terlibat dalam relasi-relasi sosial yang lain maupun pihak yang kontra Danone, termasuk para NGO dan mahasiswa yang terlibat dalam gerakan sosal masyarakat Padarincang
An earthquake that struck Palu City, Central Sulawesi Province on September 28, 2018 rose potential problems. One of them is the permanent housing (huntap) provision for 6,504 earthquake-affected households. With a descriptive qualitative approach, this research focuses on the social and political aspects of providing permanent housing for disaster victims. Public opinion, both conveyed by refugees targeted for permanent housing and NGO activists and media workers, is expected to improve the policy of providing permanent housing for earthquake victims in Palu. The public hopes that the houses built for earthquake victims are to replace their lost homes and function as a place for psychological recovery. Therefore, the social aspects of housing provision are essential to receive government priorities, such as guaranteeing a sense of security, comfort, and relocated land status. Assistance and advocacy for displaced victims to obtain their rights should be appreciated, exceptionally due to the lack of political function of Regional House of Representative Council (DPRD) roles in guarding disaster victims. Legislators are unable to make a greater effort due to their status as part of the regional government. Simultaneously, the mass media's attention to housing provisions is still vital for the government to formulate, implement and evaluate its policies. This study also discovered conditions where local governments have limited authority to provide shelter for displaced victims. Centralized government authority forces local governments to rely on the president and his staff.
