The article is devoted to the research of legal issues of protection of the violated rights, determination of the effectiveness of the mechanism of ensuring the rights, investigation of alternative ways of protection of rights, analysis of the functioning of ODR platforms and prospects of their functioning. The article notes that with the widespread use of the Internet, legal institutions are changing, especially with regard to dispute resolution. The emergence of e-commerce has led to the emergence of online dispute resolution platforms that are already in use on all continents. The e-commerce market in Ukraine and in the world is gaining momentum, so Ukraine's desire for closer interaction with EU Member States and integration into the common market necessitates a detailed study of the experience of the EU and foreign countries to introduce the most effective and advanced mechanisms for securing the rights of e-commerce participants. The study concludes that it is advisable to use online dispute resolution (ODR) procedures, which are a cross-border alternative dispute resolution, as a fast and versatile way to resolve disputes, as a substitute for the ineffective existing forms of IPR protection. Based on the analysis of the existence of alternative dispute resolution methods, it is established that online dispute resolution due to its specific legal nature is an independent way of resolving disputes.

The relevance of the problem under study is due to the need to monitoring the general situation to respect to human rights. The establishment, provision and realization of human rights is an important indicator in a state, which indicates its democracy, sociality, as well as the fact that such a state is legal. Purpose of the article in the study the issues of legal protection of vulnerable categories of population in the context of formation of active human rights policy of state aimed at increasing the capacity of socially vulnerable groups and reducing the risks of growing social tensions in society. The leading method for studying this problem is the legal sociological method, which allows us to study the effectiveness of state and legal regulation of human rights protection. The article presents an analysis of the results of the European experience in combating intolerance and discrimination. Its types main determined have been. Highlighted the criteria by which discrimination is prohibited. The legal system of human rights protection mechanisms is analyzed. The article presents scientific categories: discrimination, hate crimes, vulnerable groups. The practical significance lies in the development of proposals for improving domestic legislation.

PurposeThe purpose of the paper is to study the factors that influence the effectiveness of the professional and qualification and innovative potential of youth in a university environment. The authors focus on the main institutional factors of the external and internal character, which are the barriers to this reproduction process and do not bring the expected result—renovation of the qualitative structure of the workforce. The authors determine the essence and main characteristics of the process of reproduction of innovative and professional and qualification potential in higher school by the example of Russia.Design/methodology/approachMethodology of the work includes SWOT analysis, which allows distinguishing the potential (D) of strong (F) and weak (G) opportunities and the level of indicators of realization of (R) opportunities (V) and threats (U) of the research object.FindingsIt is substantiated that factors-barriers of innovative and professional and qualification potential could be overcome with the help of the formation of the mechanism of interaction of labor market, market of educational services, and innovative university complexes.Practical implicationsThe obtained results allow determining the main threats with a high probability of implementation in the process of formation of professional and qualification potential in the system of higher education and forming the perspectives of solving this problem.Originality/valueOriginality of this study consists in the totality of obtained results, which show the specific features of reproduction of innovative and professional and qualification potential of youth: determination of strengths and weaknesses, opportunities and threats of the process of formation of innovative and professional and qualification potential in the system of higher education.
