Niniejszy artykuł stanowi część I artykułu, którego celem jest zbadanie wzajemnych relacji między materialnymi i proceduralnymi prawami do środowiska na tle typologii materialnych praw do środowiska i wyzwań napotykanych przy projektowaniu prawa do zdrowego środowiska. Część I zawiera analizę kontekstu w tym zakresie. Przedstawiono w niej pochodzenie terminu "prawo do środowiska" oraz różne podejścia do jego znaczenia, w szczególności różnice pomiędzy "prawem do dostępu do środowiska naturalnego" a "prawem do zdrowego środowiska". Następnie przedstawiono dwa możliwe podejścia do znaczenia terminu "prawo do zdrowego środowiska" i ich konsekwencje. Na tej podstawie artykuł przedstawia trzy główne metody rozwiązywania problemów dotyczących jakości środowiska w ramach systemu praw człowieka oraz relację między podejściem antropocentrycznym i ekocentrycznym. Następnie w artykule przedstawiono główne wyzwania napotykane przy tworzeniu "prawa do zdrowego środowiska", w szczególności kwestię dopasowania tego prawa do istniejącego systemu ochrony praw człowieka oraz ograniczenia związane z "zazielenianiem" innych praw człowieka. Niniejszy artykuł zawiera też krótki przegląd rozwoju odpowiednich przepisów prawnych dotyczących praw środowiskowych, w tym zarówno praw człowieka, jak i praw przyrody. Część I kończy się kilkoma uwagami na temat tendencji do rozwijania proceduralnych praw środowiskowych i oczekiwań wobec Konwencji EKG ONZ z Aarhus oraz jej roli w ochronie materialnych praw środowiskowych i demokracji uczestniczącej - co jest łącznikiem z częścią II, w której szczegółowo omówiono te kwestie i stwierdzono, że przepisy dotyczące dostępu do wymiaru sprawiedliwości w ramach Konwencji z Aarhus ani nie zapewniają wystarczających środków ochrony praw środowiskowych, ani - w świetle koncepcji leżących u podstaw Konwencji - nie powinny być traktowane jako pełniące jedynie taką rolę.

The article provides a brief overview and assessment of the proposed measures against the respective political and legal background. It shows that the proposed measures, while generally guided by legitimate objectives, were not properly balanced with the other EU environmental policies. In this context it claims lack of a profound debate regarding the scope and means for such balancing and considers this as a fundamental issue to be addressed before submitting any concrete measures. It then compares the proposed measures with some of the official proclamations in the Europesan Green Deal and shows issues of concern in relation to some of the concrete proposed measures. Finally, it assesses some of the proposed measures as being not controversial and presents proposals for other possible measures to be used for the purpose. The article is based on a presentation given 24th November 2022 in the context of the annual general meeting of the Environmental Law Network International.

This paper is a report on the online webinar "Revision of the Industrial Emissions Directive: in search of consistency with climate, energy and circular economy policies?" that took place on 15th of June 2021 as part of an elni webinar series. The main speakers were Aneta Willems (European Commission), Christian Schaible (EEB) and Prof Jerzy Jendrośka (Professor at the Opole University, Poland). The reported discussions focused, inter alia, on whether the revision of the IED would concern a radical change or merely fine-tuning. Main findings include that the IED does not create enough incentives for innovations and the penalties provided are still very low. A new revision proposal is expected in the beginning of 2022.

This article reviews the conference of the Environmental Law Network International (ELNI) dedicated to "EU Environmental Impact Assessment Directive - challenges and perspectives in the light of the past experiences and the recent proposal for amendment", which took place at the University of Wrocław in Poland on 23 and 24 May 2013. The conference was addressed to both experts from the practice and academics dealing with different aspects of Environmental Impact Assessment (EIA) and brought together almost 250 participants from 24 countries worldwide. The aim of the conference was to review and discuss the recent proposal of the European Commission to amend the EIA Directive and bring it face to face with practical experiences with EIA at international and national level, in particular in the light of the jurisprudence of the Court of Justice of the EU and national courts.

One of the main goals of the Directive 85/337/EEC, on the assessment of the effects of certain public and private projects on the environment ("EIA Directive"), expressed in its Preamble, is to ensure that projects that are likely to have significant environmental impact proceed only after prior assessment of their likely effect on the environment, based on appropriate information supplied by the developer and with proper avenues for public participation. The European Court of Justice (ECD) repeatedly narrowed down the (originally large) scope of discretion of the member states in deciding whether a project shall be subject to EIA or not by requiring the environmental impact assessment for any project which is likely to have serious impacts de facto.
Central to this article is a description of the typical and most important gaps of implementation of the EIA directive, emerging from the specific traffic infrastructure cases. Prior to that, some general remarks on the typical characteristics and problems concerning transposition of the EIA Directive are made.

While the immediate trigger for this initiative of the newly appointed European Commission under Ursula van Leyen was the need to address the challenges associated with climate change and to move towards carbon-free and circular economy – its goals seem to be much more ambitious: to put into practice the concept of sustainable development. Against the background of the concept of sustainability and its various ambiguities and interpretations, the article provides a brief description and analysis of the key pillars of the Green Deal, namely: the financial framework for promoting sustainability, the climate and energy strategy, and the strategy for industry and circular economy. It also presents and critically assesses the horizontal goals of the Green Deal i.e. improving involvement of the public into the decision-making and assuring equal opportunities for marginalised groups.

Podczas gdy bezpośrednim powodem dla tej inicjatywy nowo wyznaczonej Komisji Europejskiej pod przewodnictwem Ursuli van Leyen była potrzeba rozwiązania wyzwań związanych z zmianami klimatycznymi oraz zapoczątkowania tworzenia niskoemisyjnej gospodarki o obiegu zamkniętym - jego cele wydają się być znacznie bardziej ambitne: realizacja w praktyce koncepcji zrównoważonego rozwoju. Na tle koncepcji zrównoważonego rozwoju i różnych sposobów jej rozumienia i interpretacji, artykuł zawiera krótki opis i analizę kluczowych filarów Zielonego Ładu, a mianowicie: ram finansowych promowania zrównoważonego rozwoju, strategii klimatycznej i energetycznej oraz strategii dla przemysłu i branży i gospodarki o obiegu zamkniętym. Prezentuje również i krytycznie ocenia horyzontalne cele Zielonego Ładu, mające na celu poprawę zaangażowania społeczeństwa w podejmowanie decyzji i zapewnienie równych szans dla grup marginalizowanych.
