El presente artículo aborda la protección de las personas mayores a la luz de los perfiles evolutivos del sistema europeo de derechos humanos. En efecto, desde una perspectiva de tutela multinivel de los derechos humanos, se analizan los estándares del Consejo de Europa y de la Unión, poniendo el acento en la Carta Social Europea y en la jurisprudencia del Comité Europeo de Derechos Sociales. Dicho análisis conduce a concluir que se está forjando un acervo europeo del Ius Senectutis de crucial importancia en el contexto de crisis sanitaria y humanitaria provocada por la pandemia de covid-19. Esos estándares europeos y sus sinergias con otros estándares internacionales y nacionales, en última instancia, están llamados a optimizar los derechos de las personas mayores y su dignidad en coherencia con el principio pro personae.
The European Social Charter (alongside the case-law of the European Committee of Social Rights) forms the most striking binding legal source for young people's social rights, providing a framework for synergies with both the European Union and the Council of Europe's other instruments and mechanisms in this area. In the current times of pandemic, the most important thing is preventing the COVID-19 crisis (which has economic, political and social dimensions) from becoming a crisis of values among young people. From this perspective, on the one hand, the paper focuses on access of young people to education, labour market and housing. On the other hand, it proposes measures aimed at raising awareness of the Social Charter among young people and to capitalise on it in practice instead of insisting on drafting a specific European instrument on their rights. Finally, the author insists that all Council of Europe Member States should accept (if they have not yet done so) in the spirit of the 'Turin process,' the collective complaints procedure and the revised European Social Charter.

This essay reflects on the relationship between economic analysis and the effectiveness and justiciability of social rights in Europe. If in the era of globalisation the market is accorded an important position when international and national legislation on social rights is drafted (and even in the initial phase of the preparation of such legislation, such as when forecasts are made of the economic impact or the so-called "feasibility" of social provisions), the author emphasises that consideration needs also to be given to the legal or dogmatic structure of these social rights, which are just as suitable as civil rights to be treated as justiciable norms. This essay also highlights the road towards a common European standard of social rights by promoting, among other elements, the synergy and potential complementarity that exists between the social case law of the Court of Luxembourg (European Union) and of the European Committee of Social Rights (Council of Europe). ; El presente trabajo reflexiona acerca de la relación entre el análisis económico y la efectividad y justiciabilidad de los derechos sociales en Europa. En efecto, si en la era de la globalización se confiere una posición relevante al mercado cuando se redactan las normas nacionales e internacionales sobre derechos sociales (incluso en la fase inicial –previendo el impacto económico de dichas normas, la denominada "factibilidad"), el autor pone de relieve que la estructura jurídica y dogmática de tales derechos sociales es tan idónea como la de los derechos civiles a la hora de garantizar su justiciabilidad. En tal sentido, se subraya el camino hacia un estándar común europeo en materia de derechos sociales promoviendo la sinergia y asegurando la complementariedad entre la jurisprudencia social del Tribunal de Luxemburgo (Unión Europea) y del Comité Europeo de Derechos Sociales (Consejo de Europa).

Constitutional Law, and Social Constitutionalism in particular, cannot avoid the analysis of the Sustainable Development Goals (SDG). Indeed, the 2030 Agenda constitutes an Agenda for Global Constitutionalism of an essentially social nature. From this perspective, the SDG integrate a kind of Universal Pillar of Social Rights and, as a result, inspire both the European social model and the realization of social rights in the national constitutional order. With these premises, the author analyzes the interpretive value and the effectiveness of the SDG in the Spanish constitutional system through illustrations of legislative, executive and judicial practice. However, as many other multi-level constitutionalism challenges, the SDG make up not only an agenda for the public authorities, but also a commitment for the whole citizenship and the third sector, without forgetting the commitment of the other relevant societal actors, including the academia. ; El Derecho Constitucional, y especialmente el Constitucionalismo Social, no puede quedar al margen del análisis de los Objetivos de Desarrollo Sostenible (ODS). En efecto, la Agenda 2030 constituye una Agenda de Constitucionalismo Global de naturaleza básicamente social. Desde esta perspectiva, los ODS integran una especie de Pilar Universal de Derechos Sociales y, como consecuencia, inspiran el modelo social europeo y la realización de los derechos sociales en el orden constitucional nacional. Con tales premisas, el autor somete a análisis el valor interpretativo y la efectividad de los ODS en el sistema constitucional español a través de ilustraciones de la práctica legislativa, ejecutiva y judicial. Sin embargo, como retos de constitucionalismo multinivel, los ODS conforman no sólo una agenda para los poderes públicos, sino asimismo un compromiso para el conjunto de la ciudadanía y del tercer sector, sin olvidar el compromiso de los demás actores de la sociedad, incluyendo la Academia.

El Profesor García Roca, Catedrático de Derecho Constitucional en la Universidad Complutense de Madrid, nos ofrece un nuevo trabajo monográfico sobre el CEDH que le confirman como uno de los máximos expertos en nuestro país sobre el texto convencional del Consejo de Europa y, más ampliamente, de Derecho Constitucional Europeo. En efecto, en esta ocasión, «la transformación constitucional» del CEDH nos brinda un valioso material de consulta para el ámbito académico y para el terreno de la praxis jurídica, erigiéndose la obra en un exponente de lo que podríamos denominar (parafraseando la idea de jurisprudencia o interpretación «evolutiva» del TEDH) «doctrina constitucional evolutiva» sobre el CEDH y el TEDH.
This review covers two years (2018 and 2019) in which the activities of the European Committee of Social Rights took on a broader and more significant dimension in the protection of human dignity. Firstly, the review mainly contains a selection of the conclusions adopted by the Committee through the reporting system belonging to the thematic groups "Labour rights" as well as "Children, Family and Migrants". Secondly, the achievements of 2018 and 2019 in terms of collective complaints strengthened the Charter's potential for protecting those situations of vulnerability and beneficiaries at greatest disadvantage. From this perspective, the review highlights conclusions and decisions from the Committee which are both of great significance for the protection of fundamental social rights and of practical relevance for all institutions and stakeholders involved in making Charter rights real and effective. Finally, the author concludes that raising awareness of the Committee's case-law, in the spirit of the "Turin Process", is the best way to consolidate the European Social Charter as a veritable European pact for the social stability of the Council of Europe's three pillars: democracy, rule of law and human rights. ; La presente crónica abarca dos años (2018 y 2019) en los que las actividades del Comité Europeo de Derechos Sociales adquirieron una dimensión más amplia y significativa en la protección de la dignidad humana. En el marco de toda una serie de debates, resoluciones y otros instrumentos tendentes a fortalecer la integración, participación y compromiso de la juventud a nivel local y regional, este artículo pone el acento en los derechos sociales de los jóvenes garantizados por la Carta Social Europea. Subraya el papel esencial de los entes locales y regionales, en virtud de sus competencias en el ámbito social, para facilitar el acceso y el ejercicio efectivo de los derechos sociales por parte de los jóvenes; a tal efecto, se pone el énfasis en el cumplimiento de la Carta Social y su jurisprudencia como fuentes de inspiración para la acción local y regional en este terreno. El artículo hace un llamamiento a los entes territoriales para alentar a sus autoridades nacionales a firmar y ratificar la Carta Social Europea revisada y aceptar el procedimiento de reclamaciones colectivas. También les invita a difundir el texto de la Carta Social a través de sus propios canales de comunicación y redes sociales, así como a sensibilizar sobre los derechos sociales de los jóvenes a través de diversas iniciativas. Para los gobiernos de los Estados miembros, propone desarrollar y coordinar sus acciones de concienciación sobre los derechos sociales de los jóvenes con los otros niveles de gobernanza y los gobiernos de los Estados Partes en la Carta Social, involucrando a los gobiernos locales y regionales en todo el proceso de implementación de este instrumento jurídico. ; n the framework of a series of debates, resolutions and other instruments to strengthen the integration, participation and engagement of young people at the local and regional levels, this essay focuses on the social rights of young people guaranteed by the European Social Charter. It underlines the essential role that local and regional authorities play by virtue of their competences in the social field, in facilitating the access and effective exercise of social rights by young people, the implementation of the Social Charter and its jurisprudence being a source of inspiration for local and regional to take action in this field. The paper calls on local and regional authorities to encourage their national authorities to sign and ratify the revised European Social Charter and to accept the collective complaints procedure. It also invites them to disseminate the text of the Charter through their own communication channels and social networks, and raise awareness of the social rights of young people through various initiatives. To the governments of member states, it proposes to develop and coordinate actions with other levels of governance and governments of the States Parties to the Charter, to raise awareness of young people¿s social rights and to involve local and regional authorities throughout the implementation of this legal instrument ; Dans le cadre de tout une série de débats, de résolutions et d¿autres instruments pour renforcer l¿intégration, la participation et l¿engagement des jeunes aux niveaux local et régional, le présent article met l¿accent sur les droits sociaux des jeunes garantis par la Charte sociale européenne. Abstract:This papers adopts as a starting hypothesis the relative degree of influence of international standards in the drafting of the 1978 Spanish Constitution and the absolute need to accommodate to the reality of an integrated State at supranational and international levels. In this sense, a first approach shows that, despite the potential role of constitutional clauses opening to international standards, and after four decades since the entry into force of the Spanish Magna Carta of 1978, constitutional justice and constitutional doctrine have not shown clear nor open behaviour towards international legal requirements, with the exception of its relative enthusiasm towards European parameters.Indeed, in the main part of this paper, the analysis of the past forty yearsof democratic constitutionalism under the 1978 Constitution reveals, first and foremost, an interpretative deficit based on more favourable international solutions, as well as an incorrect and unexplored view of the impact of international treaties within the constitutional system of sources of law.Secondly, the positive impact of international standards is examined in connection with both the «dogmatic part» (constitutional values, principlesand rights) and the «organic part» of the Constitution (separation of powers and territorial organization of the State), without forgetting the weight of international instruments in defending the constitutional order (ordinary —constitutional court— and extraordinary —constitutional amendment— mechanisms). Thirdly, the social responsibility of Universities in their teaching and research (especially in conflicting domestic situations) is submitted to scrutiny, in order to show its key role in transferring advanced knowledge to society without trivializing the importance of both international law and constitutional law in the democratic defense of the constitutional order. Finally, the place that constitutional norms occupy in international treaties, as well as the impact of notions such as (national) margin of appreciation, constitutional identity and others, are proposed so as to complete the analysis.The main conclusion of this paper holds the necessary feedback of internationaland constitutional standards, since these positive synergies (including a global judicial dialogue) will continue to promote the strengthening of a «constitutional feeling» under the 1978 Spanish Magna Carta, which is inserted in an increasingly globalized context. ; Resumen:La presente contribución adopta como hipótesis de partida la relativa influencia de los estándares internacionales en la redacción de la Constitución de 1978 y la absoluta necesidad de adaptación a la realidad del Estado supranacional e internacionalmente integrado. En este sentido, un primer enfoque permite comprobar que, a pesar del juego potencial de las disposiciones constitucionales de apertura internacional, y tras cuatro décadas de vigencia de la Carta Magna Española de 1978, la justicia constitucional y la doctrina constitucionalista no han mostrado una actitud clara y abierta hacia las exigencias jurídicas internacionales, con la excepción de un relativo entusiasmo hacia los parámetros europeos. En efecto, en la parte central del artículo, el análisis de los cuarenta años constitucionalismo democrático bajo la Constitución de 1978 revela, primeramente, un déficit de interpretación basado en soluciones internacionales más favorables, así como una incorrecta e inexplorada concepción del impacto de los tratados internacionales en el sistema constitucional de fuentes.En segundo término, se examina la proyección positiva de los estándares internacionales tanto en la «parte dogmática» (valores, principios y derechos constitucionales) como en la «parte orgánica» de la Constitución (separación de poderes y organización territorial del poder), sin olvidar el peso de los instrumentos internacionales en la defensa del orden constitucional (mecanismos ordinario —tribunal constitucional— y extraordinario —reforma constitucional—). En tercer lugar, se somete a escrutinio la responsabilidad social de la Universidad en sus tareas de enseñanza y de investigación (especialmente en situaciones domésticas conflictivas), con objeto de transferir un conocimiento avanzado a la sociedad sin banalizar o trivializar la importancia del Derecho internacional y del Derecho constitucional en la defensa democrática del orden constitucional.
