"Andrew Johnston examines EC regulation of national corporate governance systems through the lenses of economic theory and reflexive governance. By contrasting the normative demands of the neoclassical 'agency' model with those of the productive coalition model, he shows how their incompatibility required political compromise. Reflexive governance theory is then used to explain how progress has been possible. Through detailed analysis of both case law and positive regulation, the author highlights the move from positive to negative integration; the benefits as well as the limits of regulatory competition; and the significant role of reflexive techniques in both preventing market failure and enabling positive integration to proceed. Justified in their Actions takes an in-depth look at nearly two centuries of literature surrounding the Spithead and Nore Mutinies of 1797, one of the largest examples of collective action ever undertaken by any western military force. Despite arising from largely similar sources, the mutinies' end could not have been more different—that of the Channel Fleet at Spithead resulted in the Royal Navy's first pay raise in a century by Act of Parliament and a general pardon for all involved. The mutiny at the Nore, however, culminated in dozens of courts martial and over thirty hangings. In Justified in their Actions, the mutinies will be studied through the lens of the age-old debate of "sedition or ships' biscuits," as it becomes clear that over-analysis of a subject can be just as dangerous as not studying it at all.

This paper analyzes the influences of the timber industry on the development of the colony of New Zealand and its land law during the nineteenth century, especially in regard to the dispossession of the indigenous Maori population from the Kauri forests of the North Island. By conducting a case study of Mangakāhia v the New Zealand Timber Company, Ltd. (1882), this paper illustrates the manner by which Maori landowners were increasingly barred from full legal status by the New Zealand courts, and how the economic and political power of the timber industry allowed the Court of Appeals to essentially dismiss Mangakāhia's case out of hand.
