Abstract This study was conducted to determine the role of foreign loans in overcoming the budget deficit. The approach method used is normative juridical and specifications of the research is descriptive analytical research and the results are analyzed qualitatively. The results of the study indicate that foreign loans as an alternative in overcoming the budget deficit must be managed properly so that the community can feel the benefits, in addition, government have to carefully calculate the capability to repay foreign loans that have been received. Foreign loans cannot be used as the main source of financing in overcoming the budget deficit. Hasil penelitian menunjukkan bahwa pinjaman luar negeri sebagai alternatif dalam mengatasi defisit anggaran harus dikelola dengan benar sehingga masyarakat dapat merasakan manfaatnya, di samping itu juga diperhitungkan secara cermat kemampuan untuk membayar kembali pinjaman luar negeri yang telah diterima. This research is aimed to find out legal basis of Government Officer responsibility as consequence of authority abused that cause state financial lost. This research used normative juridical method by using analytical descritive approach. This research found out that Government Officers (including treasurers, non treasurer public servants, or other officers), could be penalized to fine if there is mal-administration in their decission or actions that cause state financial lost. The fine will become personal responisbility if there is abuse of power. Otherwise, state financial lost will be compesate to government institutions as official responsibilitynif there is not any abuse of power. Government officers who defined to compensate government financial lost can be penalized with administrative penalty and/or criminal penalty. Criminal penalty will not release compensation obligation. Abstrak Penelitian ini bertujuan untuk mengetahui pertanggungjawaban Pejabat Pemerintahan sebagai akibat penyalahgunaan wewenang yang menimbulkan kerugian keuangan negara berdasarkan peraturan perundang-undangan. Metoda penelitian yang digunakan adalah yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Dari hasil penelitian dapat diketahui bahwa Pejabat Pemerintahan (termasuk di dalamnya bendahara, pegawai negeri bukan bendahara, atau pejabat lain), dapat dikenai tuntutan ganti kerugian negara/daerah jika Keputusan dan/atau Tindakan yang ditetapkan dan/atau dilakukan terdapat kesalahan administratif yang menimbulkan kerugian keuangan negara. Pengembalian kerugian negara dibebankan kepada Pejabat Pemerintahan sebagai tanggung jawab pribadi apabila ada unsur penyalahgunaan wewenang. Sedangkan pengembalian kerugian negara dibebankan kepada Badan Pemerintahan sebagai tanggung jawab jabatan apabila terjadi bukan karena adanya unsur penyalahgunaan wewenang. Oleh karena itu Pejabat Pemerintahan yang telah ditetapkan untuk mengganti kerugian negara/daerah dapat dikenai sanksi administratif dan/atau sanksi pidana. Putusan pidana tidak membebaskan dari tuntutan ganti rugi.
COVID-19 pandemic as non-nature disaster due to its impact on health, social, and economy as well, made the President attempted to treat them with public finance policy as implementation of his discretion authority in ruling the government during pandemic. This research was conducted by using empirical juridic approach, focused on analytical descriptive and the result was analyzed qualitatively. The result shows that Perpu No. 1 of 2020 that approved by The House later, represented is a constitutional discretion. In the operational aspect the Government published many regulations to follow up of Perppu Nomor 1 Tahun 2020 that used to resolve emergency condition due to COVID-19, therefore, government officers got immunity in implementing their duties based on goodwill and in accordance with regulations. Abstrak This research was conducted to find out legal consequencies as a result of discretion made by Government Officers in recruiting contract-based employees after Government Regulation Number 49 of 2018 concerning Management of Contract-based Public Servants (Manajemen PPPK). This research was conducted by using normative juridical method and analytical descritive approach. There is regulation regarding prohibition to recruit contract-based employees to fulfill lack of public servants position in government institutions. Hence, discretion cannot be used to comply manpower need, but still can be done through formation proposal of public servants and/or contract-based employees. Contract-based employees still have to conduct their job for maximum 5 years and have opportunity to be recruited as non-organic employees (non-organic public servants) as long as the employees comply conditions stated in Government Regulation Number 49 of 2019. Metode pendekatan yang digunakan adalah yuridis normatif, spesifikasi penelitian yang digunakan adalah deskriptif analitis. Terdapat ketentuan tentang larangan perekrutan Pegawai tidak tetap/non-PNS untuk mengisi jabatan ASN di instansi pemerintahan. Oleh karena itu diskresi tidak dapat lagi digunakan untuk memenuhi kebutuhan pegawai, namun dapat dilakukan melalui usul formasi CPNS dan/atau PPPK. Pegawai tidak tetap/non-PNS masih tetap melaksanakan tugas paling lama 5 (lima) tahun dan dapat diangkat menjadi PPPK apabila memenuhi persyaratan yang diatur dalam PP Nomor 49 Tahun 2018. Abstract This research was conducted to find out changes of Public Servants mental and behavior as a model in creating qualified bureaucracy reformation as a consequence of negative issues on Public Servants professionalism, particularly on their quality and performance. This research used a normative juridical method by using an analytical descriptive approach. The Government took strategic action in developing human resources of Public Servant through bureaucracy reformation policy focused on changing Public Servants mental and behavior. The change is intended not only for Public Servants but also for all related system. The focus of the change of bureaucratic is expected will create clean and accountable, effective, efficient bureaucratic and able to provide qualified public service as well. Abstract The professionalism of human resources of public servants in executing public service tasks, governmental tasks, and specific development tasks are often perceived with bad stigma, particularly in negative issues on quality and performance aspects. Based on this fact, Government of Surakarta Municipality perform strategic efforts in improving the professionalism of human resources of public servants to their quality and performance will increase as well as can realizing prime services to the citizen. This research uses an empirical juridical approach. While the specification of the research is analytical descriptive, and the source of data comprises of primary and secondary data. The result of research was analyzed quantitatively. Based on the research, it can be concluded that in improving the professionalism of human resources of public servants, the Government of Surakarta Municipality perform strategic efforts, namely: 1. They are fulfilling demand of number of human resources of public servants with specific qualification, 2 and improving capacity and quality of human resources of public servants that relevant to improve their competency, 3 and applying e-Performance as a system to evaluate performance of human resources of public servants in manage personal work load as well as organization, performance indicator achievement as a basic calculation of work achievement and incentive reward, 4 and applying discipline penalty in accordance to behavior of human resources of public servants. AbstractIn a governmental implementation, government officers execute the function of regulating, serving, developing, empowering, and protecting to create people's welfare. In the implementation of the functions, government officers have the authority to make a decision and action. Therefore government officers are forbidden abusing their authority. Supervision on authority abuse of government officers is conducted by APIP. The result of supervision by APIP is comprised of without mistakes, with administrative mistakes, or with an administrative mistake that potentially causes state financial loss. Legal consequences of government officers on authority abuse, which cause state financial loss due to maladministration, become the responsibility of the government officers themselves, respectively, by returning the same amount of state financial loss due to authority abuse. Based on the APIP supervision report, the government officers accused of doing authority abuse, may request to be assessed to find out whether there is authority abuse or not when the government officers decree and execute their policies, before it becomes criminal proceeding. The request is proposed to PTUN based on Regulation of Royal Court Number 4 of 2015. Dalam melaksanakan fungsi tersebut pejabat pemerintahan memperoleh wewenang untuk mengambil keputusan dan/atau tindakan, oleh karena itu maka pejabat pemerintahan dilarang menyalahgunakan wewenang. Pengawasan terhadap larangan penyalahgunaan wewenang tersebut dilakukan oleh APIP. Hasil pengawasan APIP berupa: tidak terdapat kesalahan, terdapat kesalahan administratif, atau terdapat kesalahan administratif yang menimbulkan kerugian keuangan negara. Akibat hukum pejabat pemerintahan terhadap penyalahgunaan wewenang yang menimbulkan kerugian keuangan negara karena adanya kesalahan administratif/maladministratif menjadi tanggung jawab pribadi dengan mengembalikan kerugian keuangan negara yang ditimbulkan sebagai akibat dari perbuatan yang dia lakukan. Berdasarkan hasil pengawasan APIP tersebut, pejabat pemerintahan yang dianggap telah melakukan penyalahgunaan wewenang, dapat mengajukan permohonan penilaian unsur ada tidaknya penyalahgunaan wewenang dalam mengeluarkan keputusan dan/atau tindakan kepada Peradilan Tata Usaha Negara berdasarkan Peraturan Mahkamah Agung Nomor 4 Tahun 2015, sebelum adanya proses pidana. Abstract: SKK Migas is a government agency that has the authority to carry out upstream oil and gas (oil and gas) business activities. SKK Migas plays an important role in the governance of national energy security in the oil and gas sector. SKK Migas in implementing the governance of upstream oil and gas business activities, there are several obstacles that must be faced and resolved by SKK Migas in the implementation of upstream oil and gas business activities in order to realize national energy security. The study aims to find out first, what is the legal position of the special work unit (SKK Migas) as the executor of upstream oil and gas business activities for the governance of national energy security. Second, what is the role of SKK Migas in national oil and gas governance to be able to encourage national energy security, and third is what are the obstacles and how are SKK Migas solutions in implementing governance for national energy security. This legal writing uses the use of empirical juridical methods and uses qualitative research specifications, namely research that describes, describes or describes the state of the object under study in accordance with the situation and conditions when the research was carried out. The data used are secondary data obtained through literature study by studying literature and legislation related to the problems to be discussed. This data consists of secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials.
