Der Autor würdigt in vorliegender Untersuchung etablierte Theorien zur Erklärung des Verhältnisses von Völkerrecht zu Staatsrecht (Monismus, Dualismus). Aufgrund ihrer undifferenzierten absoluten Rechtsfolgen sowie wesentlicher Veränderungen des Völker- und Staatsrechts werden ihnen aber Aktualität und damit eine zufriedenstellende Erklärung des Verhältnisses im 21. Jahrhundert abgesprochen. Lando Kirchmair skizziert eine Alternative und richtet den Fokus auf die Entwicklung neuer theoretischer Grundlagen zum Verhältnis von Völkerrecht zu Staatsrecht.Teil A. begründet die Theorie des Rechtserzeugerkreises (TREK), welche als gemeinsamer Nenner von Völkerrecht und Staatsrecht identifiziert wird. Teil B. analysiert die Auswirkungen der TREK anhand des Beispiels der österreichischen Rechtsordnung. Während die herrschende Lehre die Rezeption von Völkerrecht in die österreichische Rechtsordnung vertritt, stellt die Arbeit die Integration des Völkerrechts in die nationale Stufenbauordnung in Frage. Entsprechend der TREK werden die einschlägigen Bestimmungen der österreichischen Rechtsordnung als Ermächtigungsnormen zum Abschluss völkerrechtlicher Bestimmungen verstanden.Um grundlegende und nicht spezifische Fragen einzelner (Völker-)Rechtsquellen zu adressieren, werden die Rechtswirkung von Völkervertragsrecht, Völkergewohnheitsrecht, allgemeiner Rechtsgrundsätze, Rechtsakte internationaler Organisationen und erstmals auch zwingendem Völkerrecht und einseitiger Rechtsgeschäfte in der österreichischen Rechtsordnung untersucht. Abstract
Climate change is one of the most alarming events today, which will very likely have devastating effects on a lot of people worldwide. This paper addresses the question as to how constitutional sustainability clauses can be enforced in the age of the climate crisis. It does so by looking into some difficulties of making the notion of future generations operable. First, the paper will briefly analyze two decisions by the Austrian Constitutional Court and the Norwegian Supreme Court, which have both rejected claims based on constitutional sustainability clauses referring to future generations. This is juxtaposed with a recent decision by the Federal Constitutional Court of Germany which invigorated Article 20a of the German Basic Law and thereby also future generations. Second, this paper aims at shedding light on the notion of future generations by looking into philosophical debates on the so-called non-identity problem. The question as to how to include future generations in the social contract and selected philosophical strategies to address it are discussed and introduced to the legal discourse. This seems to be a worthwhile goal as by now several scholars from various disciplines such as geography, political science, and applied ecology have opened up a debate on the role of social contracts concerning climate change. This paper seeks to further the debate by aiming to suggest a connection between philosophical social contract reasoning and constitutional sustainability clauses taking the example of Austria, Norway, and Germany.

AbstractThis case note discusses the role of the International Court of Justice (ICJ) in the protection of cultural heritage. Of particular relevance in this vein is the cultural heritage dimension of the International Convention on the Elimination of All Forms of Racial Discrimination and its interpretation by the ICJ in its provisional measures order of 7 December 2021 in the proceedings on the Application of the International Convention on the Elimination of all Forms of Racial Discrimination (Armenia v. Azerbaijan). In this order, the ICJ indicated provisional measures to protect the cultural heritage of minorities and their right to equal participation in cultural activities. Looking ahead, the case note briefly elaborates on the potential implications of this order and the proceedings for the broader debate on the human right to cultural heritage.

Abstract
Empirical analysis shows that judges at the International Court of Justice (ICJ) tend to vote (85 to 90%) for their country of nationality. In order to outweigh this imbalance – already predicted in 1920 when drafting the Statute of the Permanent Court of International Justice (PCIJ), the predecessor of the ICJ – the decision was taken to allow states which do not have a permanent judge of their nationality on the bench to nominate a judge ad hoc. The nationality bias is an important legitimacy issue for the Court. Inspired by Judge Thomas Buergenthal's public appeal and along the lines of Judge Bruno Simma's finding on the shift from 'bilateralism to community interest in international law', this article submits that a national judge at the ICJ should refrain from being a national judge by recusing herself when her home country is party to a case. In doing so she could protect herself from this nationality bias, which is a severe threat to (the appearance of) her impartiality and independence. Arguably, some one hundred years after the decision was taken against mandatory recusal on the basis of nationality when the Statute of the PCIJ was drafted, the international community is now demanding that individual judges of the principal judicial organ of the United Nations serve the community interest independently and impartially.

Die Restitutionsdebatte ist von großer gesellschaftlicher Bedeutung; einen juristischen, moralischen und politischen Königsweg scheint es indes nicht zu geben. Dieser Beitrag beleuchtet die bisher wenig beachteten, als Weltdokumentenerbe ausgezeichneten Bestände des Berliner Phonogramm-Archivs. Sie enthalten historische Klangaufnahmen aus aller Welt, die, so das Plädoyer dieses Beitrags, digitalisiert und sodann Open Access der Weltöffentlichkeit zur Verfügung gestellt werden sollten.

Die These dieses Beitrags lautet, dass sich unter dem recht unverfänglichen Label "Autonomie" der Anspruch auf Souveränität verbirgt: Auf europäische Souveränität. Souveränität nach innen - gegenüber den Mitgliedstaaten. Und Souveränität nach außen gegenüber der Völkerrechtsordnung und ihren Akteuren. Im Außenverhältnis gebärdet sich der EuGH wie ein Gericht eines transnationalen Staates. Dies werde ich im ersten Teil näher analysieren. Aber auch das Innenverhältnis zwischen EU und Mitgliedstaaten wird oft und heiß diskutiert. Das BVerfG hat hierfür in seinem PSPP-EZB-Urteil vom 5. Mai 2020 erneut einen eindrücklichen Nachweis geliefert. Obwohl Ursula von der Leyen dadurch "den Kern der europäischen Souveränität" gefährdet sah, und auch die Corona-Krise scheinbar das Erstarken des Nationalismus fördert, zeigt der Beitrag im zweiten Teil, dass im Innenverhältnis der EU zu ihren Mitgliedstaaten der europäische acquis im Grunde auch in der aktuellen Krise von den Mitgliedstaaten gewahrt wird. Dennoch sollte aus rechtlicher Sicht für das Innenverhältnis nicht der Souveränitätsbegriff in Stellung gebracht werden - weder aus europäischer noch aus nationaler Perspektive.

This article seeks to contribute to shifting the focus from an international, towards a regional cultural heritage protection in the Middle East and North Africa (MENA). While especially the destruction of Palmyra has drawn much of worldwide attention, this has wrongly led to an exaggerated impression of a region in need of international interventionism. An example of such an excessive internationalism is the call for international action triggered by the announced status change of the Hagia Sophia. In contrast to a too dominant international focus, this contribution aims to put a spotlight on the regional framework for the protection of cultural heritage in the MENA. By sketching regional cultural heritage protection, this article wants to contribute to laying the ground for future research on the topic, delving more into the normative potential as well as the empirical realities of the day-to-day protection of cultural heritage in the MENA.
