Self-government in the political system of Poland

One of the greatest achievements in the process of political transformation in Poland involves the broad decentralization of the public authorities, where a larger number of independent entities with public competences exist alongside a single center. Decentralization is embodied by self-government, which has therefore become an important element of the democratic regime co-creating a network of links related to the distribution of power, property and resources across society. Undoubtedly, self-government which works in favor of citizens' groups being organized as corporations contributes to the increased efficiency of public authorities in the territorial and special dimension. Based on this, self-government should be understood not as a unidimensional entity involved only in territorial relations. There is also special self-government, established according to different criteria, which plays an important role in the system of the representation of the interests of defined circles. It is divided into professional self-government and, first and foremost, business self-government. Importantly, self-governments should be approached from a slightly different angle – not only in the administrative and institutional context, but also from the point of view of the realization of the interests of organized social groups, that is in terms of governance, which can improve the functioning of local authorities, for instance as concerns the emergence of metropolitan areas. The harmonious development of all forms of self-government, irrespective of the type of bonds connecting its members, as well as the consolidation of participatory processes, is one of the prerequisites for a stable democratic regime.

Będący egzemplifikacją decentralizacji samorząd stał się zatem ważnym elementem demokratycznego systemu politycznego, współtworząc sieć powiązań odnoszących się do podziału władzy, majątku i zasobów w społeczeństwie. Nie ulega wątpliwości, że działając na rzecz zorganizowanych korporacyjnie grup obywateli samorząd przyczynia się do podniesienia efektywności funkcjonowania władzy publicznej w wymiarze terytorialnym i specjalnym. Wychodząc z tego założenia należy zauważyć, że samorząd nie jest pojęciem jednowymiarowym odnoszącym się wyłącznie do stosunków terytorialnych. Ważną rolę w systemie reprezentowania interesów określonych środowisk odgrywa także samorząd specjalny, który wyodrębnia się według innych kryteriów. W jego ramach wyróżniamy przede wszystkim samorząd zawodowy i gospodarczy. Warto również podkreślić, że samorząd należy obecnie rozpatrywać z nieco innej perspektywy, nie tylko ze względu na kontekst administracyjno-instytucjonalny, ale również z punktu widzenia realizacji interesów zorganizowanych grup społecznych, a więc w kategoriach governance, co może poprawić funkcjonowanie systemu władzy lokalnej, na przykład w kontekście kształtowania się obszarów metropolitalnych. Harmonijny rozwój wszystkich form samorządu, bez względu na charakter więzi łączących ich członków, a także wzmacnianie procesów partycypacyjnych jest zatem jednym z warunków petryfikacji demokratycznego systemu politycznego.

Samorząd zawodowy i gospodarczy w Polsce po 1989 roku

One of the greatest achievements of the socio-political transformation process in Poland is the profound decentralization of public governance. In administrative law, decentralization is perceived as a system with a larger number of independent hubs, vested with competences in terms of public law, and a single center. Therefore, decentralization is a process of delegating certain public functions which formerly were reserved for the central government to groups of citizens organized in corporations. Although local government exemplifies decentralization it is not a one-dimensional no- tion that refers exclusively to territorial relations. In the system of representation specialized self-government bodies, formed with different criteria, play a highly significant role represen- ting the interests of various groups. They are divided into self-governing bodies focused on the economy and the professions. Formal and legal homogeneity, though, does not translate into the appropriate political position of these two forms of self-governing bodies in Poland. While the professional self-governing body is clearly an association governed by public law, the so-called economic self-governing body is based on concepts that emphasize the volunta- ry nature of the ties between entrepreneurs, associated in chambers of commerce. The differences in their legal status and the resulting powers bear no influence on the fact that both economic and professional self-governing bodies are now facing equally serious threats in Poland. In both cases these are related to how the state approaches the extra-territo- rial form of decentralization. We can speak of different motivations here. The state, or rather the state administration, is excessively interested in the professional self-governing bodies and is curbing the autonomy they have traditionally been vested with. The situation is quite different with respect to the economic self-governing bodies, where the public authorities are scarcely interested in becoming involved in supporting them. It should be realized then, that the success of Polish decentralization reform will only be complete when all forms of self-government develop harmoniously irrespective of the rela- tions between their members, whose empowerment will serve democracy and strengthen civic society.
Samorząd wojewódzki w Polsce jako podmiot polityki rozwoju regionalnego ; Regional authorities in Poland as the subject of regional development policy
Jednym z największych osiągnięć procesu transformacji społeczno-politycznej w Polsce jest szeroka decentralizacja sfery władztwa publicznego. Obowiązująca obecnie ustawa o samorządzie gminnym doprowadziła do restytucji zjawiska władzy lokalnej w Polsce, a zarazem stanowiła pierwszy krok do dalszych reform samorządowych zwieńczonych ustanowieniem samorządu powiatowego i wojewódzkiego. Z dniem 1 stycznia 1999 r. wprowadzono zasadniczy trójstopniowy podział terytorialny państwa, którego jednostkami stały się gminy, powiaty i szczególnie nas interesujące województwa. Reforma samorządowa obejmując swoim zasięgiem województwa spowodowała, że nastąpiła istotna zmiana jakościowa, bowiem województwa - regiony uzyskały podmiotowość co usytuowało je na płaszczyźnie partnerskich relacji w stosunku do władz centralnych. Piętnaście lat funkcjonowania samorządu regionalnego w Polsce skłania do refleksji dotyczącej efektywności podjętych wówczas działań i kierunków dalszego rozwoju samorządu na poziomie województwa. Jest to niezwykle istotne, bowiem w demokratycznym, zdecentralizowanym państwie to właśnie samorządowy region odgrywa coraz większą rolę w promowaniu, stymulowaniu i finansowaniu ze środków publicznych inicjatyw służących rozwojowi społeczno-gospodarczemu. Od sprawnej realizacji tych zadań, a także zmiany zasad generowania przychodów budżetowych samorządu, zależy w głównej mierze przyszłe funkcjonowanie województw i to czy będą one mieć wystarczające środki na realizację programów rozwoju regionalnego. ; One of the greatest achievements of the socio-political transformation process in Poland is the extensive decentralization of public authorities. The current law on municipal government has brought about the restoration of the phenomenon of local governance in Poland, thus becoming the beginning of further local government reform, topped with the establishment of district and regional government. January 1, 1999 marks the introduction of the principal three-tier territorial division of the state, organized from then on into municipalities, counties and regions, the latter being of particular interest to us here. The reform of local government encompassed the regions, resulting in a significant qualitative change, as regions were granted the status of separate entities, thus becoming partners in relations with the centralauthorities. The fifteen years of regional government in Poland calls for reflections on the efficiency of the steps taken then, and the directions of further advancement of local government at a regional level. This issue is of utmost importance, since in a democratic, decentralized state, locally governed regions play an increasingly significant role in promoting, stimulating and providing public financing for initiatives serving socio-economic development. Effective fulfillment of these tasks, coupled with changing principles of how to generate the budget revenue of local governments, lies among the main conditions for the future operations of the regions, and ensuring appropriate means to implement regional development projects.

Obecnie obowiązujące regulacje prawne nie zapewniają izbom gospodarczym pozycji związków publicznoprawnych. Opierają się one na fakultatywnym charakterze więzi łączących przedsiębiorców, co jest główną przyczyną słabego rozwoju rodzimego samorządu gospodarczego, a właściwie quasi samorządu gospodarczego. Wynikająca z tego słabość strukturalna i programowa organizacji przedsiębiorców wydaje się być główną przeszkodą na drodze do stworzenia efektywnego systemu zarządzania lokalnego, który mógłby zniwelować zbyt asymetryczneobecnie relacje pomiędzy samorządem terytorialnym i reprezentacją przedsiębiorców. The role of economic self-government in Poland within the structures of the political regime ; Pozycja ustrojowa samorządu gospodarczego w Polsce
Since the beginning of the political transition in Poland an unproductive discussion hasbeen continued concerning the role of economic self-government in the system of localgovernment. The current legal regulations do not provide business chambers with thestatus of public legal unions. They tend to be based on the facultative nature of the tiesbetween entrepreneurs, which is the main cause of the weakness of the Polish economicself-government, or rather the economic quasi-self-government. The consequentialstructural and programmatic weakness of entrepreneurs' organisation seems to be themajor obstacle in creating an effective system of local governance that could equalisethe excessively asymmetric relations between the local government and the representation of entrepreneurs. It is beyond doubt that the lack of such structures in the area ofpublic institutions is the main reason for marginalising them by the government andlocal authorities, which do not see the need to make any concessions for the diffusedeconomic environment. Since the beginning of the political transition in Poland an unproductive discussion has been continued concerning the role of economic self-government in the system of local government. The current legal regulations do not provide business chambers with the status of public legal unions. They tend to be based on the facultative nature of the ties between entrepreneurs, which is the main cause of the weakness of the Polish economic self-government, or rather the economic quasi-self-government. The consequential structural and programmatic weakness of entrepreneurs' organisation seems to be the major obstacle in creating an effective system of local governance that could equalise the excessively asymmetric relations between the local government and the representation of entrepreneurs. It is beyond doubt that the lack of such structures in the area of public institutions is the main reason for marginalising them by the government and local authorities, which do not see the need to make any concessions for the diffused economic environment. Given this context, the most rational solution seems to be the creation of a common economic self-government, which will be incorporated into the system of public authorities.
Wielowymiarowość pojęcia samorządu – od związków terytorialnych do specjalnych ; The multidimensional nature of the concept of self-regulatory entities – from territorial to special associations
Przedmiotem zaprezentowanej w artykule analizy jest samorząd korporacyjny, którego podstawę stanowi związek osób o przymusowym charakterze członkostwa. W tym kontekście kluczowe stało się scharakteryzowanie istoty i kierunków rozwoju samorządu terytorialnego jako fundamentu władzy lokalnej. Samorząd korporacyjny nie jest jednak pojęciem jednowymiarowym odnoszącym się wyłącznie do stosunków terytorialnych. Bardzo ważną rolę w systemie reprezentowania interesów określonych środowisk odgrywa także samorząd specjalny, który wyodrębnia się według innych kryteriów. W jego ramach wyróżnić możemy związki personalne, reprezentujące interesy osób wykonujących profesje zaufania publicznego oraz związki ekonomiczne, których zadaniem jest rzecznictwo interesów środowiska gospodarczego. Odpowiednio do zaprezentowanego powyżej podziału, w ramach samorządu specjalnego wyróżniamy samorząd zawodowy i gospodarczy. Warto zauważyć, że w kontekście takich procesów jak globalizacja, metropolizacja czy demokracja uczestnicząca na samorząd należy spojrzeć z nieco innej perspektywy, nie tylko przez pryzmat społeczności zorganizowanych terytorialnie, ale również z punktu widzenia przedsiębiorców oraz osób wykonujących profesje zaufania publicznego, a więc w kategoriach governance. Jest to szczególnie istotne ze względu na potrzebę poszukiwania nowych, efektywnych i równoprawnych form współpracy pomiędzy jednostkami samorządu terytorialnego a organizacjami samorządu specjalnego. ; The analysis presented in this paper concerns corporate self-regulatory associations (in Polish: samorząd korporacyjny) based on the principle of mandatory mem- bership of individuals. In this context, it was necessary to outline the nature and directions of development of local governments (in Polish: samorząd terytorialny) as the core of local authorities. A corporate self-regulatory association, however, is not a unidimensional term that exclusively concerns territorial relations. The system that represents the interests of certain circles also encompasses a highly significant type of special self-regulatory entities (in Polish: samorząd specjalny) identified by different criteria. This includes personal associations that express the interests of individuals representing professions of public trust and business associations whose task is to act in the name of different economic circles. This division is reflected by professional and business self-regulatory associations respectively (in Polish: samorząd zawodowy and samorząd gospodarczy). In the context of globalisation, metropolisation and participatory democracy, self-regulatory associations should be viewed from a slightly different perspective - not only through the prism of communities organised in terms of territories, but also from the point of view of persons who perform professions of public trust, that is in terms of governance. This is particularly important on account of the necessity to seek new, effective and equal forms of collaboration between local government units and the organisations of special self-regulatory associations.
