The increasing visibility of Islam in France and the vehemence of debates about it have often contributed to narrow public perceptions of secularism to a simplistic antireligious crusade, a misleading image disseminated by the media and politicians alike. Taking the opposite stand, this book embarks on a comprehensive effort to document the multiple areas in which French secularism plays out - in debates over "cults," places of worship, chaplaincy services in public institutions, the recognition of associations of worship, and more -, outlining and analizing the legal paths favored by the state in the regulation of religious diversity. This article examines the movements made by the Centre d'action laïque (CAL, Centre for Secular Action), a French-speaking structure of organized secularism in Belgium, in its definition of secularism over the last twenty years. Starting from an observation of the mobilization of secularism in the written output from the CAL, the article examines the extent to which its secular ideal has become secularized both in its vocabulary and in its commitments, no longer being necessarily determined by its relationship to religion. It reveals how the written output of the CAL is gradually distancing itself from a secularism constructed in opposition to, but also and perhaps in mirror image with, clericalism, to engage instead with topics previously unknown to secularism (such as sport, drugs and prostitution) so as to better respond with a philosophical secularism that a single position vis-à-vis religion can no longer always justify.

N'ayant jamais fait l'objet d'une définition officielle, même dans les rares États ayant pourtant officiellement proclamé le principe aux fondements de leur organisation constitutionnelle, la laïcité n'a pas de contenu propre. Les significations qu'on lui attribue évoluent au gré des contextes historiques et des enjeux politiques. Ce faisant, la liberté conceptuelle qui en découle favorise la diffusion de représentations multiples – toutes légitimes – de ce qu'est la laïcité, ce qui contribuent à nourrir le débat scientifique. La polysémie inhérente au terme « laïcité » rappelle ainsi au chercheur le caractère dynamique de la réalité sociale qu'il a pour but d'analyser. S'inscrivant dans cette perspective, ce texte insiste sur l'importance des recherches sociographiques sur la laïcité, l'étude de ses trajectoires historiques, de ses fondements philosophiques, de ses ancrages juridiques et des débats sociaux qu'elle suscite s'avérant désormais indispensable à l'analyse compréhensive de l'objet « laïcité ».

Après avoir montré pourquoi un État laïque ne peut se contenter d'ignorer le fait religieux, mais doit à l'inverse s'en saisir afin de garantir la liberté de conscience et de religion des citoyens, cet article propose d'explorer les conceptions de la religion véhiculées par le droit en contextes québécois et français. S'appuyant sur des sources primaires de nature juridique (textes de lois et jurisprudences), l'analyse retrace comment l'État définit la religion comme une notion fonctionnelle comportant des conséquences pour l'expression collective des groupes concernés.

Cet article a pour objectif d'éclairer les types dominants de la neutralité et leur évolution dans le modèle étatique français relatif à la prise en compte de la diversité religieuse. Il propose de procéder à une modélisation abstraite des types de neutralité décelables dans la gouvernance publique : la neutralité confessionnelle et la neutralité référentielle. La prégnance de ces types de neutralité dans la régulation de la diversité religieuse est illustrée à partir d'une étude des politiques relatives à la question sectaire, d'une part, et du traitement du port de signes/vêtements religieux, d'autre part. Parce que la neutralité est une exigence normative qui s'impose à l'État en limitant les raisons qu'il peut invoquer pour justifier les politiques qu'il adopte, les analyses présentées s'appuient sur des sources primaires qui ont toutes trait à l'action étatique.

In this working paper, I propose to analyze the treatment of the wearing of religious symbols in the public sphere in Quebec and France as political and juridical events that have crystallized, in different moments, certain kinds of secularism in each society. My goal is therefore to show how a religious symbol – and in particular those belonging to Islam – may reveal the potency of certain conceptions of secularism in a society, conceptions that may or may not find themselves re-inscribed in the law and as such consolidated by juridical secularism.

Dans cet article, nous proposons une analyse sociologique du moment juridique de mise en oeuvre de la régulation de la diversité religieuse qu'a constitué la décision du Conseil d'État du 27 juin 2008 refusant la nationalité française à une ressortissante marocaine qui portait la burqa. Nous entendons démontrer l'hypothèse selon laquelle cette décision s'inscrit dans un raidissement de la « laïcité narrative », un raidissement préalablement conforté par l'adoption du rapport de la Commission Stasi en 2003 puis par le vote de la loi du 15 mars 2004 relative au port de signes manifestant ostensiblement une appartenance religieuse dans les écoles, collèges et lycées publics. Nous montrons qu'harmonisant ainsi « laïcité narrative » et « laïcité juridique », cette décision du Conseil d'État a constitué un point d'ancrage solide au développement d'une rhétorique républicaine sur l'aménagement du religieux, alimentant en retour la « laïcité narrative ».

The objective of this article is to clarify dominant types of neutrality and their evolutions under the French state model, taking into special consideration religious diversity. It proposes to proceed to an abstract modelling of types of neutrality that are detectable in public governance: confessional neutrality and referential neutrality. The maturation of these types of neutrality in the regulation of religious diversity is illustrated using a study of policies relating to the sectarian question, on the one hand, and dealing with wearing religious signs/clothing, on the other hand. Given that neutrality is a normative requirement imposed on the state by limiting the reasons that can be invoked to justify the adopted policies, the analyses presented herewith rely on primary sources that all bear features of state action.
