While the prison population of most occidental countries increased dramatically, the incarceration rate in Germany decreased significantly twice during the past thirty years: first in 1969 and second between 1983 and 1991. The present research tries to find out the reasons for these decreases. The first decrease is clearly the result of the 1969 reform of the German criminal law (reform which had positive as well as negative repercussions). The second decrease cannot be explained by legal reform and seems to result from a change of attitude on the part of judges and prosecutors towards criminals.

Les prisons suisses sont surpeuplées. L'auteur se propose donc de déterminer les causes de ce surpeuplement. Cette recherche démontre que l'augmentation, entre 1974 et 1984, du nombre d'années de détention infligées par les juges s'explique, pour une moitié environ, par une progression du nombre de prévenus condamnés et, pour une autre moitié, par l'augmentation de la sévérité des sanctions. Cette augmentation de la sévérité des sanctions, pour sa part, est attribuable, pour 89%, à l'augmentation de sévé- rite vis-à-vis des seules infractions à la Loi fédérale sur les stupéfiants révisée en 1975. En d'autres termes, cette révision est responsable du 44% de l'augmentation de la population carcérale entre 1974 et 1984.

Rezension: Deutsche Kolonialgeschichte in elf Fundstücken Koloniales Erbe als Familiengeschichte - Beutestücke in deutschen Wohnzimmern Paravent, Teeservice, Speere, Schild und Papagei: Nicola Kuhn stellt Artefakte vor, die viel über die Kolonialzeit erzählen. Von Missionaren, Militärs, Siedlern oder Händlern als Trophäen und Erinnerungsstücke mitgebracht, verbirgt sich hinter jedem Objekt immer auch die Tragödie eines besetzen Landes und seiner Menschen. Die Fundstücke bezeugen die extreme Gewalt wie das vermeintlich friedliche Miteinander, radikale Ausbeutung, doch auch Versuche von Annäherung. Zu Wort kommen auch die heutigen Besitzer, die einen Umgang mit diesem Erbe finden müssen. Erzählerisch entwirft Nicola Kuhn so ein Panorama deutscher Kolonialherrschaft. Sie ist der Meinung: Nach einem Jahrhundert des Schweigens ist es Zeit, sich ein Bild zu machen. Welt und Wohnzimmer sind fulminant erzählerisch miteinander verbunden. Nicola Kuhn ist Expertin für Raubkunst und renommierte Journalistin.
Kreditsicherheiten sind eine zentrale Institution der Wirtschaft, die die Verfügbarkeit von Kredit entscheidend beeinflusst. Kreditsicherungsrecht zeichnet sich dabei als ausgeprägte Querschnittmaterie an der Schnittstelle von Schuld-, Sachen- und Zwangsvollstreckungsrecht aus. Kreditsicherungsrecht steht auch unter grossem Modernisierungsdruck, denn der vom Gesetzgeber zur Verfügung gestellte Rahmen wird den Bedürfnissen der Wirtschaft längst nicht mehr gerecht. Das vorliegende Werk vermittelt einen systematischen Überblick über die Grundstrukturen des schweizerischen Kreditsicherungsrechts. Nach einer Einführung in die ökonomischen und vertraglichen Grundlagen werden die Realsicherheiten - Mobiliarsicherheiten (einschliesslich Eigentumsvorbehalt und Finanzierungsleasing), Forderungssicherheiten (einschliesslich Sicherungsrechte an Registerwertrechten, Aktien, Immaterialgüterrechten und Versicherungs- und Vorsorgeansprüchen), Finanzsicherheiten (Effekten- und Barsicherheiten sowie AGB-Pfandrecht) sowie Grundpfandsicherheiten (namentlich Schuldbrief und Bauhandwerkerpfandrecht) dargestellt. Behandelt werden ebenfalls die Personalsicherheiten (Bürgschaft, Garantie, Schuldbeitritt) sowie die Sicherheitsleistung im Bundesrecht. Die Darstellung des Buches wie auch der einzelnen Kapitel folgt dem Kreditsicherungsprozess, der mit der Begründung der Sicherheit beginnt und über die Schwebephase bis zum Eintritt bzw. Ausfall des Sicherungsfalls führt

According to regular reports from newspapers or television programs, advice books or fitness websites, walking is not only the most natural, but also the healthiest and most sustainable form of transport. Humans are evolutionarily born to walk, their bodies are downright conditioned to walk. At the same time, everyday human mobility raises questions of living together, of socio-economic differentiations, but above all of lifestyles and biographical influences. We are therefore dealing with culturally negotiated practices that make a physical movement process such as walking a subject that can be observed and examined in a variety of ways. What is important is therefore less the fact that everyone goes, but rather the identifiable cultural imprint of these practices and the associated levels of meaning, for example when long-distance hikes or modern pilgrimages evoke motives critical of the present and thus also social diagnostic evaluations.
Walking is therefore a major topic, but one in which precisely that empirical, cultural-scientific perspective that characterizes the European ethnology practiced at the University of Innsbruck (and elsewhere) can bring something new. From both a historical and contemporary ethnographic perspective, changes, economic cycles and negotiations that call for micro-perspective, empirical-field-related and qualitative-empathic surveys come into view. The contributions in this volume question the everyday practices of walking mobility by adopting a relational perspective in which physical walking practices are combined with experiences, ideas, projections, evaluations and adjustments. With the chosen focus on practices of walking, it is possible to understand in excerpts how powerful, social, gendered, religious, urban, scientific, textual-literary, spatial and material these practices always are.
