Alternative Wege der Betriebsprüfung am Beispiel der begleitenden Kontrolle
Der traditionelle Abgabenvollzug in Österreich ist ein besonderes Verwaltungsrecht und ist in diesem Sinne vom klassischen Ober- und Unterordnungsverhältnis, in dem die Behörde dem Abgabepflichtigem mit Befehl und Zwang gegenübertritt, geprägt. Mit dem Jahressteuergesetz 2018 wurde am 01.01.2019 die begleitende Kontrolle, als eine Alternative zur klassischen Außenprüfung, eingeführt. Die begleitende Kontrolle basiert auf einer Kooperation zwischen dem Abgabepflichtigen und der Abgabenbehörde. Das Herzstück der begleitenden Kontrolle sind der regelmäßige Kontakt, in Form von quartalsmäßigen Treffen, zwischen dem Abgabepflichtigen und der Abgabenbehörde sowie das unternehmensinterne Steuerkontrollsystem, das alle steuerlich relevanten Vorgänge abzubilden hat. Die begleitende Kontrolle geht auf die Studie der OECD zur Co-operative Compliance zurück. Diese Arbeit beschreibt den klassischen Abgabenvollzug in Österreich und zeigt warum dieser Abgabenbetrug, -hinterziehung und aggressive Steuerplanung begünstigen kann. Weiters werden Alternativen zum klassischen Abgabenvollzug dargestellt und beschrieben was die Kooperation zwischen Abgabepflichtigen und Abgabenbehörde ausmacht. Dies wird anhand der Studie der OECD zur Co-operative Compliance dargestellt. Als Ergebnis dieser Überlegungen zu einer kooperativen Beziehung wird dann auf die begleitende Kontrolle eingegangen. Dabei wird analysiert, wie sich die begleitende Kontrolle konkret auf den Steuerpflichtigen auswirkt, welche Vorkehrungen für den Wechsel in die begleitende Kontrolle zu treffen sind und wie die Kooperation die tägliche Arbeit beeinflusst. Ebenso werden die Eckpfeiler für den Aufbau und die Gestaltung des Steuerkontrollsystems, als Kern der begleitenden Kontrolle, dargelegt. Dies in Zusammenschau mit den international gängigen Standards zur Überprüfung interner Kontrollsysteme. ; The traditional procedure of collecting taxes by the state is a form of administrative law. This means that order and enforcement are part of this procedure. In 2018 Austria passed the law that sets an alternative to the traditional ways of conducting tax audits. It is called "begleitende Kontrolle". This alternative to auditing is based on a relationship between the state and the taxpayer that rests upon cooperation and trust. The essence of this new approach of tax collection by the state is: regular contact between the revenue body and the taxpayer, quarterly meetings as well as implementing an efficient tax control framework. This tax control framework shows all essential internal processes of the business, which have an impact on the tax base. This new approach of auditing is based on the "co-operative compliance" study released by the OECD in 2013. This thesis deals with the traditional system of collecting taxes in Austria and shows why this is likely to facilitate tax evasion and aggressive tax planning. In the next step alternative ways of auditing based on cooperation, especially on "co-operative compliance" are described. This thesis shows the crucial points of the "co-operative compliance". Based on the before mentioned OECD study the Austrian tax authority implemented a system of horizontal monitoring. This thesis details the Austrian system of horizontal monitoring. Furthermore Austrias horizontal monitoring is examined with regards to the impact on the taxpayers day-to-day work. Additionally, the requirements of starting the process of horizontal monitoring and the process itself will be explained.
