The analysis of scientific researches concerning professional training and qualification certification of engineers-land surveyors in Ukraine and abroad is carried out. The need to study, borrow the experience of one of the countries of the European Union and further adapt this certification in Ukraine is substantiated.Qualification requirements for certification of land surveying engineers in Ukraine and Poland are considered. A comparison of the qualification exam for a certified land surveyor is given. An analysis of the comparison of similar and different indicators for obtaining a certificate of land surveying engineer in Ukraine and Poland. Emphasis is placed on the quality of qualification selection of certified land surveyors.The proposals in the revision of the requirements for obtaining a qualification certificate of a land surveyor in Ukraine are given. In the future, the revision of the qualification certification requirements will help create objective equal opportunities for land relations specialists, improve the quality of land management documentation, as well as facilitate the adaptation of certification with our western neighbors - the European Union.Key words: certificate of land surveyor, certification, land management, surveying engineers, foreign experience, professional practice. ; Проведено аналіз наукових досліджень щодо професійної підготовки і кваліфікаційної сертифікації інженерів-землевпорядників, інженерів-геодезистів в Україні та за кордоном. Обґрунтовано потребу у вивченні, запозиченні досвіду однієї із країн Європейського Союзу та в подальшій адаптації даної сертифікації в Україні. Розглянуто кваліфікаційні вимоги для отримання сертифікації інженерів-землевпорядників, інженерів-геодезистів в Україні та Польщі. Наведено порівняння проведення кваліфікаційного іспиту на сертифікованого інженера-землевпорядника. Проведено аналіз порівняння схожих та відмінних показників щодо отримання сертифікату інженера-землевпорядника, інженера-геодезиста в Україні та Польщі. Акцентовано увагу на питанні якості проведення кваліфікаційного відбору сертифікованих інженерів-землевпорядників, інженера-геодезиста.Наведено пропозиції у перегляді вимог при отриманні кваліфікаційного сертифікату інженера-землевпорядника в Україні. В подальшому перегляд вимог кваліфікаційної сертифікації сприятиме створенню об'єктивних рівних можливостей фахівцям земельних відносин, покращенню якості у розробленні документації із землеустрою, а також адаптації сертифікації із нашими західними сусідами - країнами Європейського Союзу.Ключові слова: сертифікат інженера-землевпорядника, інженер-геодезист, сертифікація, землеустрій, закордонний досвід, професійна практика.

У статті охарактеризовано етапи трансформації сільськогосподарських підприємств та появу ринкових суб'єктів господарювання: фермерських господарств, сільськогосподарської кооперації та агрохолдингів. Описано проблеми розвитку та шляхи їх вирішення у контексті збалансованого землекористування.Ключові слова: сільськогосподарські підприємства, фермерське господарство, сільськогосподарські кооперативи, агрохолдинги. ; Planning and distribution economy with state ownership of agricultural enterprises, which were dominant in the early 90s the economy of the country, was unable to provide normal functioning of the agricultural land use in the conditions of transition to market relations. To switch to another economic system began a gradual process of transformation of agricultural enterprises. The result of this process was the change in the structure of agrarian enterprises due to privatization and raspaevaniya land, and appearance from small-scale farms to large agricultural enterprises. Today identified market actors (enterprises) in agriculture: business companies, private enterprises, production cooperatives, farmers, public enterprises, other forms of management.The most common kind of private business are farms. They are one of the most promising and effective forms of management with high agriculture, appropriate level of production organization, prudent attitude to the land and best landscaping. However, today the formation of farming in Ukraine has not yet reached the level of development, which is observed in economically developed countries. The overall economic decline and inadequate legislation has forced farmers to rely on themselves. Notes the insufficient level of their competitiveness, making it impossible to provide the expanded reproduction, determines the risk of insolvency and, as a consequence, leads to bankruptcy. Farmers receive government support, but it is weak and temporary, which greatly impedes their development. Practical state support only a few farms that can affect the distribution of funds.Agricultural cooperation is one of the effective forms of management, which aims to unite the producers in the direction of increase of efficiency of use of their resource potential. However, today there are a number of unresolved problems that hinder the effective development of agricultural cooperatives. Since 2000 years, the initiative in the development of the agrarian reform moves from state to agribusiness, a manifestation of which was the emergence of agroholdings. Non-agricultural economic entities have been actively involved in agricultural production and to make significant investments in the agricultural sector of the economy. The main motive of infusion of funds the hope was cheap to buy and expensive to sell, waiting for a quick profit at any cost. However, over time there is a gradual slowdown in the trend to the accumulation of land in the ownership of agricultural holdings and the transition to improve the efficiency of production. Activity of agricultural holdings leads to the displacement of traditional forms of agricultural production of farms. Development of rural areas needs to be addressed through focused public policy and assistance to farms, which are production facilities.Part of the process of formation of the economy is the agricultural enterprises of market type, the development of which depends on the complexity of the implementation of the governance arrangements that should ensure the sustainable use and protection of land. In order to create an optimal land use model and reduce the impact of erosion on agricultural land, a number of land conservation measures need to be introduced. The most effective set of measures that minimizes the manifestation of water erosion in erosion-hazardous areas is the contouring-reclamation organization of the territory. This complex of activities combines a protective reclamation structure that interacts with the terrain and soil protection technology of growing crops.In general, at the end of the 1980s, projects of contouring-reclamation organization of the territory were developed for sites that had a negative erosion effect throughout the territory of Ukraine. However, with the beginning of the 1990s, the practical implementation of measures to restructure the territory was suspended due to political transformations and lack of funds.In practice, one of the most striking examples of the implementation of design decisions is the territory of Lisnosankivsky village council of the Kupyansk district, whose Kharkiv territory is characterized by significant manifestations of erosion. For three decades, the staff of the soil protection laboratory conducted experiments on these sites. The possibility of achieving sustainable ecological indicators of soil erosion at field crop rotation -1.8 t / ha and soil protection crop rotation -1.5 t / ha was established.Similar objects that were implemented and implemented in the Kupyansk district of the Kharkiv region, were partially implemented on other erosion-hazardous sites in Polissya, Forest-steppe and Steppe regions of Ukraine. Today, most of these activities have exhausted their laid-out exploitation resources, some of the protected areas were destroyed as a result of the lack of state control, constant change of owners and the lack of motivation of actual land users.The negative manifestation of water erosion on arable land is characteristic not only for the territory of Ukraine. This process is widespread in different countries where the soil, relief and climatic conditions have similar characteristics of water erosion.One of the most successful foreign experience in minimizing the effects of water erosion, under similar conditions, on agricultural land is realized in the United States of America. Since the 1970s, agricultural producers (farmers) have attracted erosion-hazardous areas to cultivate and have grown crops that are in high demand on the market. Such activities have led to negative consequences. The biggest erosion problem in the early 1980s was the state of Missouri. The state of the state has a wide range of soils and terrain, which is characterized by the characteristics of water erosion and the development of a subtropical network.To stop, minimize the effects of water erosion in the United States began research and implementation of soil protection measures. In 1985, the Conservation Reserve Program (CRP) was approved. The purpose of this program was to withdraw from the cultivation of erosion-hazardous areas for 10-15 years, the development and implementation of contour-melioration organization of the territory. The funding for the CRP program was supposed by the tax on land sales. The result of this program for 30 years is the preservation of 9 billion tons of fertile soil from erosion, as well as reduced flushing of mineral fertilizers by 85%.The best results for soil conservation and minimization of the effects of water erosion across the state were achieved in Missouri. The soil washed in 2007 from 1 acre (0,405 hectares) and amounted to 4.2 tons and 5.3 tons for cultivating crops. That is, almost twice in 25 years. Approximate structure of the land fund was 1/3 of arable land, 1/3 of pasture and hayfields, and 1/3 of forest lands. This structure was achieved through the reservation of agricultural land.Domestic and foreign experience of the embodiment of contour-reclamation organization of the territory in areas with manifestation of erosion processes, testifies to the possibility of using them under arable land. However, these sites will require constant monitoring and restrictions on use.It has been practically confirmed that the key measure in the preserved soils from water erosion, in the presence of contour-land reclamation organization of the territory, will depend on the correct economic activity of the actual land user.Repeated introduction into active cultivation of erosion sites will adversely affect soil fertility and crop yield. The current classification of land uses for residential and public development was analyzed and proved to be in need of improvement. Proposals for its improvement within the researched category of land based on current land legislation and other normative legal acts are given. It has been proven that the existing list of the main types of land plots (which are based on the content of Article 38 of the Land Code of Ukraine) in the current classification is incomplete and not fully justified. Examples of unjustified assignment of land plots of other land categories to the category of land for residential and public development were revealed. In accordance with this, a 4-level structure of the classification of types of land use for residential and public development is proposed.Taking into account the military aggression of the Russian Federation against Ukraine, it is currently impossible to use part of the land plots for their main purpose. From these positions, it is proposed to additionally highlight "technologically polluted lands as a result of hostilities" within the framework of the above-mentioned classifier. Scientific approaches to the role of regime-forming objects in the formation of restrictions on land use, which have been studied by scholars of economic and legal profiles, are considered. The approaches to the formation of the classifier of regime-forming objects by certain relevant groups in relation to the zones with the limited regime of land use and the territories that are formed around them are analyzed. The classification of territorial restrictions by groups and their territorial restrictions on land use is given.It is established that in the current legislative and regulatory framework there is no classification of regime-forming objects that form restrictions on land use. The list of restrictions on land use, land plots, as well as the list of territorial zones do not contain a complete list of possible regime-forming objects in land use, which needs to be clarified and supplemented.The list of restrictions on the use of land (land plots) and territorial zones is analyzed on the example of the territories of water bodies in accordance with current legislation. It is established that the existing information on restrictions on land use (land plots) on the example of water bodies, which is reflected on the Public Cadastral Map of Ukraine, is characterized by conditional (visual) reflection, which creates conflicts and abuses in determining such restrictions.Keywords: classification, regime-forming object, restrictions on land use, territories of water bodies. ; Розглянуто наукові підходи щодо ролі режимоутворюючих об'єктів на формування обмежень у використанні земель, які досліджувалися науковцями економічного та юридичного профілів. Проаналізовано підходи щодо формування класифікатору режимоутворюючих об'єктів за певними відповідними групами по відношенню до зон з обмеженим режимом використання земель та територій, які формуються навколо них. Наведено класифікацію територіальних обмежень за групами та їх територіальними обмеженнями у використанні земель.Встановлено, що в діючій законодавчій та нормативно-правовій базі відсутня класифікація режимоутворюючих об'єктів, які формують обмеження у використанні земель. Наведений перелік обмежень щодо використання земель, земельних ділянок, а також перелік територіальних зон не містять повного переліку можливих режимоутворюючих об'єктів у використанні земель, що потребує уточнення та доповнення.Проаналізовано перелік обмежень щодо використання земель (земельних ділянок) та територіальних зон на прикладі територій водних об'єктів згідно діючого законодавства. Встановлено, що існуюча інформація про обмеження щодо використання земель (земельних ділянок) на прикладі територій водних об'єктів, яка відображена на Публічній кадастровій карті України, характеризується умовним (візуальним) відображення, що породжує колізії та зловживання при визначені такого обмеження.Ключові слова: класифікація, режимоутворюючий об'єкт, обмеження у використанні земель, території водних об'єктів.

The normative legal acts, scientific publications and land management projects on the organization of the territory in particular of the state scientific institutions and enterprises of the National Academy of Agrarian Sciences of Ukraine (hereinafter - NAAS) are analyzed. It is established that in the current legislation there is no type of land management documentation to address the organization of land use of state institutions and enterprises of NAAS. Emphasis is placed on the need to develop an industry standard that will take into account the specifics of land use of NAAS institutions and enterprises, which include land, research fields, nurseries, valuable land for research, which must be taken into account when developing land management documentation. The definition of the term organization of the territory is offered. The design of regulatory documents (industry standard) in accordance with DSTU 1.5: 2015, which indicates the typical structural elements that need to be shown when developing the standard. The branch standard of the land management project concerning the organization of the territory of land use of the state establishments and the enterprises of NAAS is offered taking into account specific functional features of use of the agricultural lands of the state establishments and the enterprises of NAAS. ; Проаналізовано нормативно-правові акти, наукові публікації та проекти землеустрою щодо організації території зокрема державних наукових установ та підприємств Національної академії аграрних наук України (далі - НААН). Встановлено, що в чинному законодавстві відсутній вид документації із землеустрою, щодо вирішення питань організації території землекористувань державних установ та підприємств НААН. Наголошено та обґрунтовано на необхідності розроблення галузевого стандарту, що враховуватиме специфіку використання земель землекористувань установ та підприємств НААН, що мають у своєму складі земельні ділянки, дослідні поля, розсадники, цінні землі для ведення наукових досліджень ,що необхідно враховувати при розробленні документації із землеустрою. Запропоновано визначення терміну організація території. Розглянуто оформлення нормативних документів (галузевого стандарту) відповідно до ДСТУ 1.5:2015, що вказує на типові структурні елементи, які необхідні показати при розроблені стандарту. Запропоновано галузевий стандарт проекту землеустрою щодо організації території землекористування державних установ та підприємств НААН враховуючі специфічні функціональні особливості використання сільськогосподарських земель державних установ та підприємств НААН.

Проаналізовано нормативно-правові акти та наукові публікації стосовно проведення робіт із інвентаризації земель державних установ та підприємств Національної академії аграрних наук України (далі ― НААН) та встановлено, що в чинному законодавстві та щойно прийнятому «Порядку проведення інвентаризації земель» згідно Постанови Кабінету Міністрів України № 476 від 5 червня 2019 р. відсутні норми, які б враховували специфіку використання земель науковими організаціями та мають у своєму складі дослідні поля та цінні землі для ведення наукових досліджень, які необхідно враховувати при внесенні даних до Державного земельного кадастру, а також реєстрі речових прав на них. Акцентовано увагу на проблемі правової невизначеності меж земель державних установ та підприємств НААН. Розглянуто специфічні функціональні особливості використання сільськогосподарських земель державних установ та підприємств НААН. У цьому зв'язку запропоновано структуру, зміст та склад основних положень галузевого стандарту із інвентаризації земель державних установ та підприємств НААН, який стане регулівним інструментом для виготовлення технічної документації із землеустрою щодо здійснення такого виду робіт, а отримана інформація буде основою для розв'язання назрілих проблем стосовно сільськогосподарських земель, що перебувають у користуванні цих державних установ та підприємств НААН.Ключові слова: стандартизація, галузевий стандарт, інвентаризація земель, науково-дослідне землекористування ; Regulatory acts and scientific publications relating to the works on inventory of lands of state institutions and enterprises of the National Academy of Agrarian Sciences of Ukraine (hereinafter – NAAS) have been analyzed. It was revealed that the current legislation and just adopted "Procedure of Inventory of Lands" subject to the Decree of the Cabinet of Ministers of Ukraine No.476 of June 5th, 2019 does not include any norms that would consider the specifics of the land use by scientific organizations; their research fields and valuable lands for conducting scientific research should be taken into account when entering the data in the State Land Cadastre, as well as the property rights to them should be registered. The attention is drawn to the problem of legal uncertainty concerning boundaries of lands of state institutions and enterprises of NAAS. The specific functional peculiarities of agricultural land use by state institutions and enterprises of NAAS are considered.In this regard, the structure, content and composition of the main provisions of the industry standard for land inventory of state institutions and enterprises of the NAAS are proposed, which will become a regulatory tool for the preparation of the technical documentation on land management for the implementation of this type of work, and the information obtained will be the basis for the resolution of mature problems concerning the agricultural lands used by these state institutions and enterprises of NAAS.Key words: standardization, industry standard, land inventory, land use for scientific research.

Проаналізовано нормативно-правові акти та наукові публікації щодо проведення розподілу (перерозподілу) земель за цільовим призначенням та видами використання на прикладі землекористувань установ та підприємств Національної академії аграрних наук України (далі - НААН). Встановлено, що в чинному законодавстві відсутній вид документації із землеустрою, щодо вирішення питань розподілу (перерозподіл) земель за видами використання. Враховувати специфіку використання земель землекористувань установ та підприємств НААН, що мають у своєму складі земельні ділянки, дослідні поля, розсадники, цінні землі для ведення наукових досліджень ,що необхідно враховувати при розробленні документації із землеустрою. Обгрунтовано необхідність запровадження наукового обґрунтування щодо визначення цільового призначення та виду використання, як розділу в документації із землеустрою Запропоновано структуру, зміст та склад документації із землеустрою де запропоновано розділ основних положень розподілу (перерозподілу) земель за видами використання в системі землекористувань установ та підприємств НААН.Ключові слова: землеустрій, наукове обґрунтування, розподіл (перерозподіл) земель, науково-дослідне землекористування. ; The normative legal acts and scientific publications on the distribution (redistribution) of land by purpose and types of use are analyzed on the example of land uses of institutions and enterprises of the National Academy of Agrarian Sciences of Ukraine (hereinafter - NAAS). It is established that in the current legislation there is no type of documentation on land management, concerning the decision of questions of distribution (redistribution) of land by types of use. To take into account the specifics of land use by the NAAS institutions and enterprises, which have land plots, research fields, nurseries, valuable lands for scientific research, which should be taken into account when developing documentation on land management.The necessity of introducing scientific justification for determining the purpose and type of use as a section in the land documentation documentation is proposed.Keywords: land management, scientific justification, land distribution (redistribution), research land use.

It is emphasized that the issue of establishing the boundaries of the territories of territorial communities currently remains relevant in Ukraine and presents new challenges caused by the state of war. The sequence (stages) of land management works related to establishing the boundaries of the territories of territorial communities is proposed. It is assumed that in the post-war period, the boundaries of the territories of territorial communities may be limited in their establishment, if these boundaries were located in the area of military (combat) operations or were under temporary occupation, encirclement (blockade). Attention is focused on the difficulties associated with the financial capacity of territorial communities in ordering work on the development of land management projects to establish the boundaries of these communities in the event of a return to peaceful life. The existence of disputes regarding the common borders between certain adjacent territorial communities made it necessary to introduce the possibility of partially establishing the borders of the territories of territorial communities in relation to crossing the border.Ways of improving the process of establishing the boundaries of the territories of territorial communities and adapting it to the conditions of the state of war and the post-war period are proposed, through the examples of post-war boundary establishment in foreign countries.
