Improving EU and US Immigration Systems' Capacity for Responding to Global Challenges: Learning from experiences ; Crime and migration has been a subject of debate over many decades. The present review of the literature attempts to synthesize the available evidence from statistics, crime victimization surveys, self-report surveys and other sources regarding offending and victimization rates among migrants and native populations, discriminatory decision-making by victims, police and criminal justice officials, attitudes to the police and explanations. The paper concludes that crime among migrants is a problem that policy-makers should not ignore. A number of policy changes are proposed.

Auf der Grundlage des empirischen Datenmaterials aus der schweizerischen 'Self-report-Untersuchung' von 1992/93, in welcher insgesamt 970 Jugendliche von 14 bis 21 Jahren zu begangenen Delikten befragt worden sind, werden die situativen Variablen der Gewaltneigungen, insbesondere die physische Konstitution der männlichen Jugendlichen und die illegale Verwendung von Waffen analysiert. Es wird von der Annahme ausgegangen, daß die körperliche Überlegenheit eine situative Bedingung und ein wichtiger Machtfaktor für gewaltsames Verhalten von zumeist männlichen Jugendlichen darstellt, wobei sich Opfererfahrungen und Gewaltneigungen gegenseitig verstärken können. Durch den Ansatz des 'Situational Approach' können vor allem die 'Verlagerungseffekte' untersucht werden, d.h. die Frage, inwieweit das Wegfallen von bestimmten 'Gelegenheitsstrukturen' (z.B. Waffenbesitz) delinquentes Verhalten bei Jugendlichen mindern kann. Im Sinne von notwendigen Präventionskonzepten lassen sich einige situative Bedingungen durch gezielte Maßnahmen verändern, z.B. durch Sicherung von Objekten, Erhöhung des subjektiv eingeschätzten Risikos für Gewalthandeln oder durch die Schaffung eines sozialen Klimas der Mißbilligung von Gewalt. Evidence from Switzerland and many other countries shows that legislative action making the use of safety belts compulsory is consistently followed by a massive increase in the use of safety belts. This effect is even stronger if the law provides for a sanction (usually a fine) in case of failure to use the safety belt. However, cross-section analysis with Swiss data reveals no effect of different police strategies affecting the sanction certainty, no matter whether a time-lag is introduced or not. Indeed, most of the variance in safety belt use accross regions is explained by a measure of popularity of the safety belt law. The symbolic effect of sanctions seems, therefore, to be more important than their eventual deterrent effect (through the certainty variable). This interpretation finds support in the writtings of Max Weber, Theodor Geiger, and Niklas Luhmann on law, power and society.

Op 6 juni 1982 heeft een ruime meerderheid van kiezers een herzie- ning van het zwitserse strafwetboek goedgekeurd, dewelke als doel had het misdadig geweld, het terrorisme en de geweldadige betogingen beter te bes- trijden. De kantonale analyse van de resultaten toont aan dat noch het volume van misdadig geweld, noch de frekwentie en de hevigheid van de betoging van jongeren het resultaat van de kiesverrichting hebben beïnvloed en dit niettegenstaande de onder dit opzicht aanzienlijke ver- schillen tussen de kantons. De structurele variabelen, noch het aantal kiezers behorend tot linkse partijen, noch de algemene frekwentie van de marginale politieke acties, ondernomen buiten het kader van een partij of een instelling (betogingen, eerder politieke stakingen enz . . . ) bleken belan- grijk te zijn. Daarentegen, de marginale acties voor het Jura-separtisme en dize tegen de bouw van kerncentrales schijnen een zeer sterke invloed tc hebben gehad op de stemming van 6 juni 1982.

Crime has become a major problem in public opinion in recent years. It is therefore of prime importance to know the extent of the prevalence and incidence of delinquency in Switzerland, and more specifically delinquency concerning aggravated behaviour (in particular sexual violence and serious bodily harm to persons). The descriptive study of the commission of this delinquency inevitably leads us to focus on the two other aspects of this phenomenon: victimization and acceptance of violence. The main question is: What are the frequencies of violent behaviour and experiences in Switzerland and what are the relationships between personal experiences of victimisation and the commission of acts of physical and sexual violence on the other hand among men? Other factors concerning the respondent's personality, life and immediate social environment are also assessed. The more subtle forms of psychological violence are not taken into consideration.
